<Pnumber>1</Pnumber>
<P2para>
<Text>For the purposes of this section, a police officer has a notifiable membership if membership of the organisation in question might reasonably be regarded as affecting the officer’s ability to discharge his duties effectively and impartially.</Text>
</P2para>
</P2>

<Pnumber>2</Pnumber>
<P2para>
<Text>The Chief Constable may give guidance to police officers in connection with notifiable memberships.</Text>
</P2para>
</P2>

<Pnumber>3</Pnumber>

<Text>Before issuing any guidance under subsection (2), the Chief Constable shall consult—</Text>

<Text>the Board;</Text>

<Text>the Secretary of State; and</Text>

<Text>the Northern Ireland Human Rights Commission.</Text>

<Pnumber>4</Pnumber>
<P2para>
<Text>The Chief Constable shall publish any guidance issued under subsection (2).</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/5/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/5" id="section-51-5">
<Pnumber>5</Pnumber>
<P2para>
<Text>The Chief Constable shall require each police officer to inform him—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/5/a/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/5/a" id="section-51-5-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>of any notifiable membership which that police officer believes he has; or</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/5/b/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/5/b" id="section-51-5-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>if he believes he has no notifiable memberships, of that belief.</Text>
</P3para>
</P3>
</P2para>
</P2>

<Pnumber>6</Pnumber>
<P2para>
<Text>In imposing a requirement on a police officer under subsection (5) the Chief Constable shall—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/6/a/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/6/a" id="section-51-6-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>draw the attention of that officer to the provisions of this section; and</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/6/b/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/6/b" id="section-51-6-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>give a general explanation of the purposes for which the information required may lawfully be used.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/7/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/7" id="section-51-7">
<Pnumber>7</Pnumber>
<P2para>
<Text>The Chief Constable—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/7/a/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/7/a" id="section-51-7-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>shall, subject to paragraphs (b) and (c), retain information received under this section for so long as the person to whom it relates remains a police officer;</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/7/b/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/7/b" id="section-51-7-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>shall amend that information where the police officer to whom it relates informs the Chief Constable that there has been a change in his notifiable memberships; and</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/7/c/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/7/c" id="section-51-7-c">
<Pnumber>c</Pnumber>
<P3para>
<Text>shall destroy the information within one year from the date on which the person to whom it relates ceases to be a police officer.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/8/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/8" id="section-51-8">
<Pnumber>8</Pnumber>
<P2para>
<Text>No information received by the Chief Constable under this section is to be disclosed unless the person making the disclosure is a person to whom this subsection applies and the disclosure is made—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>to the Ombudsman or an officer of the Ombudsman or to any other person in connection with the exercise of any function of the Ombudsman;</Text>
</P3para>
</P3>

<Pnumber>b</Pnumber>

<Text>as permitted by section 63 of the 1998 Act;</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/8/c/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/8/c" id="section-51-8-c">
<Pnumber>c</Pnumber>

<Text>to the Board in connection with the exercise of any of its functions;</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/8/d/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/8/d" id="section-51-8-d">
<Pnumber>d</Pnumber>

<Text>for the purposes of any criminal, civil or disciplinary proceedings;</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/8/e/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/8/e" id="section-51-8-e">
<Pnumber>e</Pnumber>

<Text>in the form of a summary or other general statement which does not identify any person to whom the information relates;</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/8/f/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/8/f" id="section-51-8-f">
<Pnumber>f</Pnumber>

<Text>to, or with the consent of, the person to whom the information relates; or</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/8/g/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/8/g" id="section-51-8-g">
<Pnumber>g</Pnumber>

<Text>to another person to whom this subsection applies.</Text>

<Pnumber>9</Pnumber>

<Text>Subsection (8) applies to—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>the Chief Constable;</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/9/b/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/9/b" id="section-51-9-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>a police officer engaged in carrying out on behalf of the Chief Constable his functions under this section;</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/9/c/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/9/c" id="section-51-9-c">
<Pnumber>c</Pnumber>
<P3para>
<Text>the Board, each of its members and the members of its staff; and</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/9/d/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/9/d" id="section-51-9-d">
<Pnumber>d</Pnumber>
<P3para>
<Text>a member of the police support staff engaged in carrying out on behalf of the Chief Constable his functions under this section.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/10/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/10" id="section-51-10">
<Pnumber>10</Pnumber>
<P2para>
<Text>Any person who discloses information in contravention of subsection (8) shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 5 on the standard scale.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/11/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/11" id="section-51-11">
<Pnumber>11</Pnumber>
<P2para>
<Text>It is a defence for a person charged with an offence under subsection (10) to show that, before the disclosure was made, he obtained the information otherwise than in his capacity as a person to whom subsection (8) applies.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/12/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/12" id="section-51-12">
<Pnumber>12</Pnumber>
<P2para>
<Text>But subsection (11) does not provide a defence if it is shown that the person concerned used his position as a person to whom subsection (8) applies in order to obtain the information.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/13/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/13" id="section-51-13">
<Pnumber>13</Pnumber>
<P2para>
<Text>The annual report of the Chief Constable under section 58 shall contain statistical information on the notifiable memberships of police officers of which he has been informed under this section.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/32/section/51/14/enacted" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/32/section/51/14" id="section-51-14">
<Pnumber>14</Pnumber>
<P2para>
<Text>For the purposes of this section a person is a member of an organisation if he belongs to it by virtue of his admission to any sort of membership provided for by its constitution.</Text>
