				</ukm:Metadata><Primary><Body DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/body" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/body" NumberOfProvisions="7" RestrictStartDate="2004-04-01"><P1group RestrictStartDate="2000-07-20"><Title> Offences.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3" id="section-3"><Pnumber>3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/1" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/1" id="section-3-1"><Pnumber>1</Pnumber><P2para><Text>A person to whom information is supplied under section 1 (“a recipient”) is guilty of an offence if, without lawful authority, he discloses that information.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/2" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/2" id="section-3-2"><Pnumber>2</Pnumber><P2para><Text>A person who is or has been employed by a recipient, or engaged in the provision of services to a recipient, is guilty of an offence if, without lawful authority, he discloses information supplied to the recipient under section 1.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/3" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/3" id="section-3-3"><Pnumber>3</Pnumber><P2para><Text>It is not an offence under this section—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/3/a" id="section-3-3-a"><Pnumber>a</Pnumber><P3para><Text>to disclose information in the form of a summary or collection of information so framed as not to enable information supplied under section 1 relating to any particular person to be ascertained from it; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/3/b" id="section-3-3-b"><Pnumber>b</Pnumber><P3para><Text>to disclose information which has previously been disclosed to the public with lawful authority.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/4" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/4" id="section-3-4"><Pnumber>4</Pnumber><P2para><Text>It is a defence for a person charged with an offence under this section to prove that at the time of the alleged offence he believed—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/4/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/4/a" id="section-3-4-a"><Pnumber>a</Pnumber><P3para><Text>that he was making the disclosure in question with lawful authority, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/4/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/4/b" id="section-3-4-b"><Pnumber>b</Pnumber><P3para><Text>that the information in question had previously been disclosed to the public with lawful authority,</Text></P3para></P3><Text>and he had no reasonable cause to believe otherwise.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/5" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/5" id="section-3-5"><Pnumber>5</Pnumber><P2para><Text>For the purposes of this section, a disclosure is to be regarded as made with lawful authority if, but only if, it is made—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/5/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/5/a" id="section-3-5-a"><Pnumber>a</Pnumber><P3para><Text>by a person exercising functions in relation to television licences and using the information in a way permitted by section 2;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/5/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/5/b" id="section-3-5-b"><Pnumber>b</Pnumber><P3para><Text>in accordance with any enactment or order of a court;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/5/c" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/5/c" id="section-3-5-c"><Pnumber>c</Pnumber><P3para><Text>for the purpose of instituting, or otherwise for the purposes of, proceedings before a court; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/5/d" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/5/d" id="section-3-5-d"><Pnumber>d</Pnumber><P3para><Text>with the consent of the person to whom the information relates or of any person authorised to act on that person’s behalf.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/6" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/6" id="section-3-6"><Pnumber>6</Pnumber><P2para><Text>A person guilty of an offence under this section is liable—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/6/a" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/6/a" id="section-3-6-a"><Pnumber>a</Pnumber><P3para><Text>on summary conviction, to imprisonment for a term not exceeding six months or a fine not exceeding the statutory maximum or both; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/2000/15/section/3/6/b" IdURI="http://www.legislation.gov.uk/id/ukpga/2000/15/section/3/6/b" id="section-3-6-b"><Pnumber>b</Pnumber><P3para><Text>on conviction on indictment, to imprisonment for a term not exceeding two years or a fine or both.</Text></P3para></P3></P2para></P2></P1para></P1></P1group></Body></Primary></Legislation>
