SCHEDULE 3 The Agency’s functions under other enactments

Part I Functions under the 1990 Act

Section 40 (codes of practice)

(1)

The Agency may, after consulting the Secretary of State—

(a)

give directions to food authorities under section 40(2)(b) as to steps to be taken in order to comply with codes of practice under section 40; and

(b)

enforce any such directions.

(2)

The Agency may undertake consultation with representative organisations regarding proposals for codes of practice under section 40.
