Exercise of functions by best value authorities
18 Contracting out.
(1)
Section 70 of the M1Deregulation and Contracting Out Act 1994 (contracting out functions of local authorities) shall apply in relation to functions of any F1relevant best value authority (other than excluded functions within the meaning of section 71) as it applies in relation to certain functions of local authorities.
(2)
An order under section 70 as applied by subsection (1) above may be made only—
(a)
by the Secretary of State, and
(b)
if he considers the order necessary or expedient for the purpose of permitting or facilitating compliance with the requirements of this Part.

In this section “relevant best value authority” means a best value authority which is not a local authority for the purposes of section 70 of the Deregulation and Contracting Out Act 1994.
