8E+WThe power of the governing body of a maintained school to control the occupation and use of the premises of the school shall be subject to any arrangements made under or by virtue of—
(a)an agreement made under paragraph 1 or 2 of Schedule 10 to the M1Education Reform Act 1988 or a determination made in accordance with paragraph 62 or 63 of Schedule 8 to the M2Further and Higher Education Act 1992; or
(b)an agreement made under paragraph 1 or 2 of Schedule 5 to the M3Further and Higher Education Act 1992 or a determination made in accordance with paragraph 3 or 4 of that Schedule.]
