98 Provisions supplemental to sections 96 and 97.S

(1)Sections 96 and 97 apply in relation to the acquisition of interests in land by government departments which possess compulsory purchase powers as they apply in relation to the acquisition of interests in land by authorities who are not government departments.

(2)In sections 96 and 97—

  • acquiring authority” has the same meaning as in the M1Land Compensation (Scotland) Act 1963;

  • agricultural” and “agricultural land” have the meaning given in section 86 of the M2Agriculture (Scotland) Act 1948 and references to the farming of land include references to the carrying on in relation to the land of any agricultural activities;

  • agricultural unit” has the meaning given in section 122(1); and

  • government departments which possess compulsory purchase powers” means government departments being authorities possessing compulsory purchase powers within the meaning of the M3Land Compensation (Scotland) Act 1963.
