Any dispute arising between the nominated undertaker and the Board under this Part of this Schedule shall, if the parties agree, be determined by arbitration, but shall otherwise be determined by F1the appropriate Minister.

In sub-paragraph (1) above, the reference to the appropriate Minister—
a
in the case of a dispute concerning land drainage or flood defence, is to the Secretary of State and the Minister of Agriculture, Fisheries and Food acting jointly, and
b
in the case of any other dispute, is to the Secretary of State.
