Subject to subsection (2) below, in this Act “personal injury” includes any disease and any impairment of a person’s physical or mental condition and references to a claim or action for personal injury include references to such a claim or action brought by virtue of the M1Law Reform (Miscellaneous Provisions) Act 1934 and to a claim or action brought by virtue of the M2Fatal Accidents Act 1976.

In the application of this Act to Scotland “personal injury” has the F1meaning given by section 10(1) of the M3Damages (Scotland) Act 1976 F1same meaning as in the Damages (Scotland) Act 2011 .

In the application of subsection (1) above to Northern Ireland for the references to the Law Reform (Miscellaneous Provisions) Act 1934 and to the Fatal Accidents Act 1976 there shall be substituted respectively references to the M3Law Reform (Miscellaneous Provisions) Act (Northern Ireland) 1937 and the M4Fatal Accidents (Northern Ireland) Order 1977.
