48 Insanity as ground of acquittal in summary proceedings.
After subsection (3) of section 375 of the 1975 Act (insanity in bar of trial) there shall be inserted the following subsection—
“(3A)
Where, in the case of any person charged summarily in the sheriff court, evidence is brought before the court that the person was insane at the time of doing the act or making the omission constituting the offence with which he is charged and the person is acquitted, the court shall state whether the person was insane at that time and, if so, whether he was acquitted on that ground.”.
