In section 38 of the M1Magistrates’ Courts Act 1980 (power of magistrates’ court to commit offender to Crown Court for sentence), in subsection (2)(b)—
a
the words from “committed” to “21 years old” shall be omitted; and
b
for the words “sentence of imprisonment” there shall be substituted the words “
custodial sentence
”
.
Sch. 9 does not extend to Scotland in so far as it relates to s. 17(1) of the Video Act 1984 see s. 172(16)
