Prisoners and Criminal Proceedings (Scotland) Act 1993

2(1)Subject to sub-paragraph (2) and [F1to section 10(4) of this Act], the new provisions shall apply only to persons who are sentenced (or on whom detention is imposed) on or after the relevant date; and notwithstanding any repeal or amendment effected by or by virtue of this Act, but subject to that sub-paragraph [F2, to the following provisions of this Schedule and to the exception in the definition of “existing provisions” in paragraph 1 above,], the existing provisions shall continue to apply to persons sentenced (or on whom detention has been imposed) before that date.S

(2)Section 3 of this Act [F3, and sections 12 and 17 of this Act in so far as relating to a licence granted, or person released, by virtue of this sub-paragraph,]shall apply irrespective of the date on which a person is sentenced (or on which detention is imposed on him).
