40(1)In [F1sections 895(2) and 995(4) of the Companies Act 2006] (compromises with creditors and protection of minorities by the Secretary of State), any reference to a company or body corporate which is liable to be wound up includes a reference to a company or body corporate which would be so liable but for section 25 of the Water Industry Act 1991.E+W
(2)In section 459(3) of that Act of 1985, for the words βthe Water Act 1989β there shall be substituted the words β the Statutory Water Companies Act 1991 β.
