</docDate></block></preface><preamble><formula name="enactingText"><p>Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—</p></formula></preamble><body eId="body"><section eId="section-1"><num>1</num><heading> Amendment of section 5 of Wildlife and Countryside Act 1981.</heading><subsection eId="section-1-1"><num>(1)</num><content><p>Section 5 of the principal Act (prohibition of certain methods of killing or taking wild birds) shall be amended as follows.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><content><p>At the end of subsection (1)(d) “<term refersTo="#term-or" eId="term-or">or</term>” shall be omitted.</p></content></subsection><subsection eId="section-1-3"><num>(3)</num><content><p><mod>At the end of subsection (1)(e) there shall be inserted—<quotedText startQuote="“">; or
                </quotedText><quotedStructure endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><level class="para1"><num>(f)</num><content><p>knowingly causes or permits to be done an act which is mentioned in the foregoing provisions of this subsection and which is not lawful under subsection (5),</p></content></level></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection><subsection eId="section-1-4"><num>(4)</num><content><p><mod>The following subsection shall be inserted after subsection (4)—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(4A)</num><content><p>In any proceedings under subsection (1)(f) relating to an act which is mentioned in subsection (1)(a) it shall be a defence to show that the article was set in position for the purpose of killing or taking, in the interests of public health, agriculture, forestry, fisheries or nature conservation, any wild animals which could be lawfully killed or taken by those means and that he took or caused to be taken all reasonable precautions to prevent injury thereby to wild birds.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection></section><section eId="section-2"><num>2</num><heading> Amendment of section 11 of Wildlife and Countryside Act 1981.</heading><subsection eId="section-2-1"><num>(1)</num><content><p>Section 11 of the principal Act (prohibition of certain methods of killing or taking wild animals) shall be amended as follows.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><intro><p>In subsection (1)—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>at the end of paragraph (b) “<term refersTo="#term-or" eId="term-or">or</term>” shall be omitted; and</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p><mod>at the end of paragraph (c) there shall be inserted—<quotedText startQuote="“">; or
                    </quotedText><quotedStructure endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(d)</num><content><p>knowingly causes or permits to be done an act which is mentioned in the foregoing provisions of this section,</p></content></level></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></subsection><subsection eId="section-2-3"><num>(3)</num><intro><p>In subsection (2)—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p>at the end of paragraph (d) “<term refersTo="#term-or" eId="term-or">or</term>” shall be omitted; and</p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p><mod>at the end of paragraph (e) there shall be inserted—<quotedText startQuote="“">; or
                    </quotedText><quotedStructure endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(f)</num><content><p>knowingly causes or permits to be done an act which is mentioned in the foregoing provisions of this subsection,</p></content></level></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></subsection><subsection eId="section-2-4"><num>(4)</num><content><p>In subsection (3)(a), after “position” there shall be inserted “or knowingly causes or permits to be set in position”.</p></content></subsection><subsection eId="section-2-5"><num>(5)</num><content><p>In subsection (5), after “(e)”, there shall be inserted “and in any proceedings for an offence under subsection (1)(d) or (2)(f) relating to an act which is mentioned in any of those paragraphs”.</p></content></subsection><subsection eId="section-2-6"><num>(6)</num><content><p><mod>The following subsection shall be added after subsection (6)—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(7)</num><content><p>In any proceedings for an offence under subsection (2)(f) relating to an act which is mentioned in subsection (2)(a) it shall be a defence to show that the article was set in position for the purpose of killing or taking, in the interests of public health, agriculture, forestry, fisheries or nature conservation, any wild animals which could be lawfully killed or taken by those means and that he took or caused to be taken all reasonable precautions to prevent injury thereby to any wild animals included in Schedule 6.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection></section><section eId="section-3"><num>3</num><heading> Short title, interpretation, commencement and extent.</heading><subsection eId="section-3-1"><num>(1)</num><content><p>This Act may be cited as the Wildlife and Countryside (Amendment) Act 1991.</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><content><p>In this Act references to the principal Act are references to the <noteRef href="#c931638" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Wildlife and Countryside Act 1981.</p></content></subsection><subsection eId="section-3-3"><num>(3)</num><content><p>This Act shall come into force at the end of the period of two months beginning with the day it is passed.</p></content></subsection><subsection eId="section-3-4"><num>(4)</num><content><p>This Act shall not have effect in relation to anything done before it comes into force.</p></content></subsection><subsection eId="section-3-5"><num>(5)</num><content><p>This Act does not extend to Northern Ireland.</p></content></subsection></section></body></act></akomaNtoso>
