and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1990/42/section/167/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1990/42/section/167/1/b" id="section-167-1-b"><Pnumber>b</Pnumber><P3para><Text>on the production of such a recording, to afford the constable an opportunity of causing a copy of it to be made.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1990/42/section/167/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1990/42/section/167/2" id="section-167-2"><Pnumber>2</Pnumber><P2para><Text>An order made under this section shall describe the programme to which it relates in a manner sufficient to enable that programme to be identified.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1990/42/section/167/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1990/42/section/167/3" id="section-167-3"><Pnumber>3</Pnumber><P2para><Text>A person who without reasonable excuse fails to comply with any requirement of a constable made by virtue of subsection (1) shall be guilty of an offence and liable on summary conviction to a fine not exceeding the third level on the standard scale.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1990/42/section/167/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1990/42/section/167/4" id="section-167-4"><Pnumber>4</Pnumber><P2para><Text>No order shall be made under this section in respect of any recording in respect of which a warrant could be granted under any of the following provisions, namely—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1990/42/section/167/4/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1990/42/section/167/4/a" id="section-167-4-a"><Pnumber>a</Pnumber><P3para><Text>section 3 of the <CommentaryRef Ref="c16548621"/>Obscene Publications Act 1959;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1990/42/section/167/4/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1990/42/section/167/4/b" id="section-167-4-b"><Pnumber>b</Pnumber><P3para><Text>section 24 <Addition ChangeId="key-5594e14a7b5cea15408a489500830dd2-1559828793087" CommentaryRef="key-5594e14a7b5cea15408a489500830dd2">or 29H</Addition>  of the <CommentaryRef Ref="c16548631"/>Public Order Act 1986;
