IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/3" id="section-2A-3"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">3</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">If this subsection applies—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/3/a" id="section-2A-3-a"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">the statement shall be admissible as evidence of the matter stated, but</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/3/b" id="section-2A-3-b"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">the accused shall not be committed for trial in England and Wales, or be found to have a case to answer or be convicted, solely on the basis of the statement.</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/4" id="section-2A-4"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">4</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">Subsection (6) below applies if evidence is given that—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/4/a" ChangeId="d30p475" CommentaryRef="c1215105">at any time before being charged with the offence the accused, on being questioned under caution by a constable, failed to mention a fact which is material to the offence and which he could reasonably be expected to mention, and</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/4/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/4/b" id="section-2A-4-b"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">before being questioned he was permitted to consult a solicitor.</Addition></Text></P3para></P3></P2para></P2><P2 CommentaryRef="c1215105">5</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">Subsection (6) below also applies if evidence is given that—</Addition></Text><P3 CommentaryRef="c1215105">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">on being charged with the offence or informed by a constable that he might be prosecuted for it the accused failed to mention a fact which is material to the offence and which he could reasonably be expected to mention, and</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/5/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/5/b" id="section-2A-5-b"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">before being charged or informed he was permitted to consult a id="section-2A-6-a"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">the court or jury, in considering any question whether the accused belongs or belonged at a particular time to a specified organisation, may draw from the failure inferences relating to that question, but</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/6/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/6/b" id="section-2A-6-b"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">the accused shall not be committed for trial in England and Wales, or be found to have a case to answer or be convicted, solely on the basis of the inferences.</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/7" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/7" id="section-2A-7"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">7</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">Subject to any directions by the court, evidence tending to establish the failure may be given before or after evidence tending to establish the fact which the accused is alleged to have failed to mention.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/8" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/8" id="section-2A-8"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">8</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">This section does not—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/8/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/8/a" id="section-2A-8-a"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">prejudice the admissibility of evidence admissible apart from this section;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/8/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/8/b" id="section-2A-8-b"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">preclude the drawing of inferences which could be drawn apart from this section;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/8/c" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/8/c" id="section-2A-8-c"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">c</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">prejudice an enactment providing (in whatever words) that an answer or evidence given by a person in specified circumstances is not admissible in evidence against him or some other person in any proceedings or class of proceedings (however described, and whether civil or criminal).</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/9" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/9" id="section-2A-9"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">9</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">In subsection (8)(c) above the reference to giving evidence is a reference to giving it in any manner (whether by giving information, making discovery or disclosure, producing documents or otherwise).</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/10" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/10" id="section-2A-10"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">10</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">In any proceedings in Scotland for an offence under section 2(1)(a) above in which the accused is charged with belonging to a specified organisation, where the court or jury draws an inference as mentioned in subsection (6) above any evidence that he belongs or, as the case may be, belonged to the organisation shall be sufficient evidence of that matter.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/11" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/11" id="section-2A-11"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">11</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">In this section “</Addition><Term id="term-police-officer"><Addition ChangeId="d30p475" CommentaryRef="c1215105">police officer</Addition></Term><Addition ChangeId="d30p475" CommentaryRef="c1215105">” means a member of—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/11/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/11/a" id="section-2A-11-a"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">a police force within the meaning of the </Addition><Addition ChangeId="d30p475" CommentaryRef="c1215105"><CommentaryRef Ref="c1215106"/>Police Act 1996 or the </Addition><Addition ChangeId="d30p475" CommentaryRef="c1215105"><CommentaryRef Ref="c1215107"/>Police (Scotland) Act 1967, or</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/11/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/11/b" id="section-2A-11-b"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">the Royal Ulster Constabulary.</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/2A/12" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/2A/12" id="section-2A-12"><Pnumber><Addition ChangeId="d30p475" CommentaryRef="c1215105">12</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p475" CommentaryRef="c1215105">This section does not apply to a statement made or failure occurring before the day on which the Criminal Justice (Terrorism and Conspiracy) Act 1998 was
