and</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/1/c" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/1/c" id="section-18A-1-c"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">c</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">he does not disclose the information or other matter to a constable as soon as is reasonably practicable after it comes to his attention.</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/2" id="section-18A-2"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">2</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">Subsection (1) above does not make it an offence for a professional legal adviser to fail to disclose any information or other matter which has come to him in privileged circumstances.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/3" id="section-18A-3"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">3</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">It is a defence to a charge of committing an offence under this section that the person charged had a reasonable excuse for not disclosing the information or other matter in question.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/4" id="section-18A-4"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">4</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">Where a person discloses to a constable—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/4/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/4/a" id="section-18A-4-a"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">his suspicion or belief that another person is providing financial assistance for terrorism; or</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/4/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/4/b" id="section-18A-4-b"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">any information or other matter on which that suspicion or belief is based;</Addition></Text></P3para></P3><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">the disclosure shall not be treated as a breach of any restriction imposed by statute or otherwise.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/5" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/5" id="section-18A-5"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">5</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">Without prejudice to subsection (3) or (4) above, in the case of a person who was in employment at the relevant time, it is a defence to a charge of committing an offence under this section that he disclosed the information or other matter in question to the appropriate person in accordance with the procedure established by his employer for the making of such disclosures.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/6" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/6" id="section-18A-6"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">6</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">A disclosure to which subsection (5) above applies shall not be treated as a breach of any restriction imposed by statute or otherwise.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/7" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/7" id="section-18A-7"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">7</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">In this section “</Addition><Term id="term-providing-financial-assistance-for-terrorism"><Addition ChangeId="d30p4196" CommentaryRef="c1215222">providing financial assistance for terrorism</Addition></Term><Addition ChangeId="d30p4196" CommentaryRef="c1215222">” means doing any act which constitutes an offence under section 9, 10 or 11 above or, in the case of an act done otherwise than in the United Kingdom, which would constitute such an offence if done in the United Kingdom.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/8" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/8" id="section-18A-8"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">8</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">For the purposes of subsection (7) above, having possession of any property shall be taken to be doing an act in relation to it.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/9" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/9" id="section-18A-9"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">9</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">For the purposes of this section, any information or other matter comes to a professional legal adviser in privileged circumstances if it is communicated, or given, to him—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/9/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/9/a" id="section-18A-9-a"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">by, or by a representative of, a client of his in connection with the giving by the adviser of legal advice to the client;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/9/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/9/b" id="section-18A-9-b"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">by, or by a representative of, a person seeking legal advice from the adviser; or</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/9/c" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/9/c" id="section-18A-9-c"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">c</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">by any person—</Addition></Text><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/9/c/i" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/9/c/i" id="section-18A-9-c-i"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">i</Addition></Pnumber><P4para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">in contemplation of, or in connection with, legal proceedings; and</Addition></Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/9/c/ii" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/9/c/ii" id="section-18A-9-c-ii"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">ii</Addition></Pnumber><P4para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">for the purpose of those proceedings.</Addition></Text></P4para></P4></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/10" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/10" id="section-18A-10"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">10</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">No information or other matter shall be treated as coming to a professional legal adviser in privileged circumstances if it is communicated or given with a view to furthering any criminal purpose.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/11" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/11" id="section-18A-11"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">11</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">A person guilty of an offence under this section shall be liable—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1989/4/section/18A/11/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1989/4/section/18A/11/a" id="section-18A-11-a"><Pnumber><Addition ChangeId="d30p4196" CommentaryRef="c1215222">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p4196" CommentaryRef="c1215222">on summary conviction, to imprisonment for a term not exceeding six months or a fine not exceeding the statutory maximum or to both;
