10Nothing in paragraphs 4 and 6 to 9 above shall apply in relation to the appointment of a person to work at a school to which section 44 of this Act for the time being applies, or in relation to a person so employed, where—
(a)the person concerned is to be, or is, employed to work solely in connection with the provision of meals; and
[F1(b)less than 50 per cent. of the person’s remuneration will be, or is, met from the school’s delegated budget.]
