RestrictStartDate="2022-03-17"><Number>Part I</Number><Title> Constitution and Administration of the Court</Title><P1group RestrictExtent="S" ConfersPower="true" RestrictStartDate="2015-04-01"><Title> Composition of Court.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2" id="section-2"><Pnumber>2</Pnumber><P1para><Text>The Court shall be composed of an Inner House and an Outer House constituted in accordance with the following provisions of this section.</Text><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/2" id="section-2-2"><Pnumber>2</Pnumber><P2para><Text>Subject to subsection (3) below, the Inner House shall be composed of two Divisions, namely, the First Division comprising the Lord President and  <Substitution ChangeId="d29p131" CommentaryRef="c20833901">five</Substitution> senior judges of the Court, and the Second Division comprising the Lord Justice Clerk and  <Substitution ChangeId="d29p135" CommentaryRef="c20833061">five</Substitution> other senior judges of the Court.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/2A" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/2A" id="section-2-2A"><Pnumber><Addition ChangeId="d29p139" CommentaryRef="c10176171">2A</Addition></Pnumber><P2para><Text><Addition ChangeId="d29p139" CommentaryRef="c10176171">The Scottish Ministers may  </Addition><Addition ChangeId="d29p139" CommentaryRef="c10176171"><Addition ChangeId="d29p146" CommentaryRef="c20833501">, after consulting the Lord President,</Addition></Addition><Addition ChangeId="d29p139" CommentaryRef="c10176171"> from time to time by order amend subsection (2) above so as to alter or further alter the number of senior judges in the two Divisions.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/2B" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/2B" id="section-2-2B"><Pnumber><CommentaryRef Ref="c10176171"/><Addition ChangeId="d29p139" CommentaryRef="c10176171">2B</Addition></Pnumber><P2para><Text><Addition ChangeId="d29p139" CommentaryRef="c10176171">The power conferred by subsection (2A) above may be exercised—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/2B/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/2B/a" id="section-2-2B-a"><Pnumber><Addition ChangeId="d29p139" CommentaryRef="c10176171">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d29p139" CommentaryRef="c10176171">in relation only to one; or</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/2B/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/2B/b" id="section-2-2B-b"><Pnumber><Addition ChangeId="d29p139" CommentaryRef="c10176171">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d29p139" CommentaryRef="c10176171">differently in relation to each,</Addition></Text></P3para></P3><Text><Addition ChangeId="d29p139" CommentaryRef="c10176171">of the two Divisions.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/2C" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/2C" id="section-2-2C"><Pnumber><CommentaryRef Ref="c10176171"/><Addition ChangeId="d29p139" CommentaryRef="c10176171">2C</Addition></Pnumber><P2para><Text><Addition ChangeId="d29p139" CommentaryRef="c10176171">An order under this section shall be made by statutory instrument.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/2D" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/2D" id="section-2-2D"><Pnumber><CommentaryRef Ref="c10176171"/><Addition ChangeId="d29p139" CommentaryRef="c10176171">2D</Addition></Pnumber><P2para><Text><Addition ChangeId="d29p139" CommentaryRef="c10176171">No order shall be made under this section unless a draft of the instrument containing it has been laid before and approved by resolution of the Scottish Parliament.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/3" id="section-2-3"><Pnumber><Substitution ChangeId="d29p186" CommentaryRef="c20833651">3</Substitution></Pnumber><P2para><Text><Substitution ChangeId="d29p186" CommentaryRef="c20833651">The Lord President may from time to time constitute, from among the judges of the Court, an extra Division of the Inner House for the purpose of hearing and disposing of causes pending before the Inner House; and any reference in this Act or in any other enactment to a Division of the Inner House shall be construed as including a reference to such an extra Division.</Substitution></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/4" id="section-2-4"><Pnumber>4</Pnumber><P2para><Text><Addition ChangeId="d29p200" CommentaryRef="c20833701">Subject to </Addition><Addition ChangeId="d29p200" CommentaryRef="c20833701"><Substitution ChangeId="key-eb999c1d9e2322ea6efdb0ca137c0b35-1478063803904" CommentaryRef="key-eb999c1d9e2322ea6efdb0ca137c0b35">an act of sederunt under section 103(1) of the Courts Reform (Scotland) Act 2014,</Substitution></Addition> the quorum for a Division of the Inner House shall be three judges.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/5" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/5" id="section-2-5"><Pnumber>5</Pnumber><P2para><Text>The Outer House shall be composed of the judges of the Court (other than the judges of the Inner House while they are sitting in the Inner House) sitting singly, and any reference in this Act or in any other enactment to a Lord Ordinary shall be construed as a reference to a judge sitting singly in the Outer House.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/6" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/6" id="section-2-6"><Pnumber><Addition ChangeId="d29p210" CommentaryRef="c10176221">6</Addition></Pnumber><P2para><Text><Addition ChangeId="d29p210" CommentaryRef="c10176221">Subject to </Addition><Addition ChangeId="d29p210" CommentaryRef="c10176221"><Addition ChangeId="d29p217" CommentaryRef="c10176231">subsections (7) and (8)</Addition></Addition><Addition ChangeId="d29p210" CommentaryRef="c10176221">below, where a vacancy arises in a Division of the Inner House the Lord President and the Lord Justice Clerk, with the consent of the Secretary of State and after such consultation with judges as appears to them to be appropriate in the particular circumstances, shall appoint a Lord Ordinary to fill that vacancy.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1988/36/section/2/7" IdURI="http://www.legislation.gov.uk/id/ukpga/1988/36/section/2/7" id="section-2-7"><Pnumber>7</Pnumber><P2para><Text>Subsection (6) above shall not apply in the case of such a vacancy arising by reason of the death or resignation of the Lord President or the Lord Justice Clerk.</Text></P2para></P2><P2 CommentaryRef="c10176241">8</Addition></Pnumber><P2para><Text><Addition ChangeId="d29p228" CommentaryRef="c10176241">The Scottish Ministers shall not give their consent under subsection (6) above to an appointment filling a vacancy in one of the two Divisions of the Inner House unless they are satisfied that the state of business in the Inner House requires that the vacancy be
