RestrictStartDate="2021-06-28"><Title><CommentaryRef Ref="key-0d03825f91249cd359874544b160a3ce"/> The Serious Fraud Office.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1" id="section-1"><Pnumber>1</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/1" id="section-1-1"><Pnumber>1</Pnumber><P2para><Text>A Serious Fraud Office shall be constituted for England and Wales and Northern Ireland.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/2" id="section-1-2"><Pnumber>2</Pnumber><P2para><Text>The Attorney General shall appoint a person to be the Director of the Serious Fraud Office (referred to in this Part of this Act as “<Term id="term-the-director">the Director</Term>”), and he shall discharge his functions under the superintendence of the Attorney General.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/3" id="section-1-3"><Pnumber>3</Pnumber><P2para><Text>The Director may investigate any suspected offence which appears to him on reasonable grounds to involve serious or complex fraud.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/4" id="section-1-4"><Pnumber>4</Pnumber><P2para><Text>The Director may, if he thinks fit, conduct any such investigation in conjunction either with the police or with any other person who is, in the opinion of the Director, a proper person to be concerned in it.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/5" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/5" id="section-1-5"><Pnumber>5</Pnumber><P2para><Text>The Director may—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/5/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/5/a" id="section-1-5-a"><Pnumber>a</Pnumber><P3para><Text>institute and have the conduct of any criminal proceedings which appear to him to relate to such fraud; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/5/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/5/b" id="section-1-5-b"><Pnumber>b</Pnumber><P3para><Text>take over the conduct of any such proceedings at any stage.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/6" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/6" id="section-1-6"><Pnumber>6</Pnumber><P2para><Text>The Director shall discharge such other functions in relation to fraud as may from time to time be assigned to him by the Attorney General.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/6A" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/6A" id="section-1-6A" RestrictStartDate="2021-06-28"><Pnumber><Addition ChangeId="key-180e6af1f04773e1f06a1a1f35dd06b5-1552065043540" CommentaryRef="key-180e6af1f04773e1f06a1a1f35dd06b5">6A</Addition></Pnumber><P2para><Text><Addition ChangeId="key-180e6af1f04773e1f06a1a1f35dd06b5-1552065043540" CommentaryRef="key-180e6af1f04773e1f06a1a1f35dd06b5">The Director has the functions conferred on him by, or in relation to,  </Addition><Addition ChangeId="key-180e6af1f04773e1f06a1a1f35dd06b5-1552065043540" CommentaryRef="key-180e6af1f04773e1f06a1a1f35dd06b5"><Substitution ChangeId="key-9ff53e84e19ca8ce4d8a936a67d9feee-1552309067413" CommentaryRef="key-9ff53e84e19ca8ce4d8a936a67d9feee">Part 2, 4, 5, 7</Substitution></Addition><Addition ChangeId="key-180e6af1f04773e1f06a1a1f35dd06b5-1552065043540" CommentaryRef="key-180e6af1f04773e1f06a1a1f35dd06b5">  or 8 of the Proceeds of Crime Act 2002 (c. 29) (</Addition><Addition ChangeId="key-180e6af1f04773e1f06a1a1f35dd06b5-1552065043540" CommentaryRef="key-180e6af1f04773e1f06a1a1f35dd06b5"><Substitution ChangeId="key-d7e264a52271490fc3e46d9303ce3f0f-1552309150799" CommentaryRef="key-d7e264a52271490fc3e46d9303ce3f0f">confiscation proceedings in England and Wales and Northern Ireland, civil recovery proceedings, money laundering and investigations</Substitution></Addition><Addition ChangeId="key-180e6af1f04773e1f06a1a1f35dd06b5-1552065043540" CommentaryRef="key-180e6af1f04773e1f06a1a1f35dd06b5">).</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/7" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/7" id="section-1-7"><Pnumber>7</Pnumber><P2para><Text>The Director may designate for the purposes of subsection (5) above any member of the Serious Fraud Office who is—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/7/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/7/a" id="section-1-7-a"><Pnumber>a</Pnumber><P3para><Text>a barrister in England and Wales or Northern Ireland;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/7/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/7/b" id="section-1-7-b"><Pnumber>b</Pnumber><P3para><Text>a solicitor of the  <Substitution ChangeId="key-7c06a5abf8309867139a280649b8c18a-1552293851596" CommentaryRef="key-7c06a5abf8309867139a280649b8c18a">Senior Courts</Substitution>; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/12/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/12/b" id="section-1-12-b"><Pnumber>b</Pnumber><P3para><Text>in the Crown Court in Northern Ireland, the rights of audience enjoyed by barristers employed by the Director of Public Prosecutions for Northern Ireland.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/13" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/13" id="section-1-13"><Pnumber>13</Pnumber><P2para><Text>Subject to subsection (14) below, the reference in subsection (12)(a) above to rights of audience enjoyed by  <Substitution ChangeId="key-5d8e62788e24d46b4fd6ca63f14e4285-1552296052607" CommentaryRef="key-5d8e62788e24d46b4fd6ca63f14e4285">solicitors of the Court of Judicature of Northern Ireland</Substitution>  is a reference to such rights enjoyed in the Crown Court in Northern Ireland as restricted by any direction given by the Lord Chief Justice of Northern Ireland under section 50 of the <CommentaryRef Ref="c3792501"/>Judicature (Northern Ireland) Act 1978.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/14" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/14" id="section-1-14"><Pnumber>14</Pnumber><P2para><Text>For the purpose of giving any member so designated who is a barrister in Northern Ireland or a  <Substitution ChangeId="key-5d8e62788e24d46b4fd6ca63f14e4285-1552296291196" CommentaryRef="key-5d8e62788e24d46b4fd6ca63f14e4285">solicitor of the Court of Judicature of Northern Ireland</Substitution>  additional rights of audience in the Crown Court in Northern Ireland, the Lord Chief Justice of Northern Ireland may direct that any direction given by him under the said section 50 shall not apply to such members.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/15" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/15" id="section-1-15"><Pnumber>15</Pnumber><P2para><Text>Schedule 1 to this Act shall have effect.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/16" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/16" id="section-1-16"><Pnumber>16</Pnumber><P2para><Text>For the purposes of this section (including that Schedule) references to the conduct of any proceedings include references to the proceedings being discontinued and to the taking of any steps (including the bringing of appeals and making of representations in respect of applications for bail) which may be taken in relation to them.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1987/38/section/1/17" IdURI="http://www.legislation.gov.uk/id/ukpga/1987/38/section/1/17" id="section-1-17"><Pnumber>17</Pnumber><P2para><Text>In the application of this section (including that Schedule) to Northern Ireland references to the Attorney General are to be construed as references to him in his capacity as  <Substitution ChangeId="key-996c164290194695861d12ba3830a6a8-1552065815884" CommentaryRef="key-996c164290194695861d12ba3830a6a8">Advocate General for Northern Ireland</Substitution>.</Text></P2para></P2></P1para></P1></P1group></Pblock></Part></Body></Primary><Commentaries><Commentary id="c3792471" Type="F"><Para><Text>S. 1(9)-(11) repealed (31.7.2000) by <Citation URI="http://www.legislation.gov.uk/id/ukpga/1999/22" id="c00003" Year="1999" Class="UnitedKingdomPublicGeneralAct" Number="22">1999 c. 22</Citation>, <CitationSubRef CitationRef="c00003" id="c00004" URI="http://www.legislation.gov.uk/id/ukpga/1999/22/section/106" SectionRef="section-106">s. 106</CitationSubRef>, <CitationSubRef CitationRef="c00003" id="c00005" URI="http://www.legislation.gov.uk/id/ukpga/1999/22/schedule/15" Operative="true" SectionRef="schedule-15">Sch. 15 Pt II</CitationSubRef> (with <CitationSubRef CitationRef="c00003" id="c00006" URI="http://www.legislation.gov.uk/id/ukpga/1999/22/schedule/14/paragraph/7/2" SectionRef="schedule-14-paragraph-7-2">Sch. 14 paras. 7(2)</CitationSubRef>, <CitationSubRef CitationRef="c00003" id="c00007" URI="http://www.legislation.gov.uk/id/ukpga/1999/22/schedule/14/paragraph/36/9" SectionRef="schedule-14-paragraph-36-9">36(9)</CitationSubRef>);
