ukl:ChangeId="key-6b44c833d5e71b29e2c2c08b632c6291-1706288394466" ukl:CommentaryRef="key-6b44c833d5e71b29e2c2c08b632c6291"><noteRef uk:name="commentary" href="#key-6b44c833d5e71b29e2c2c08b632c6291" class="commentary"/>and section 24ZA</ins>, this Part applies to premises consisting of the whole or part of a building if the building or part contains two or more flats.</p></content></subsection><subsection eId="section-21-3"><num>(3)</num><intro><p>This Part does not apply to any such premises at a time when—</p></intro><level class="para1" eId="section-21-3-a"><num>(a)</num><intro><p>the interest of the landlord in the premises is held by  <ins class="first" ukl:ChangeId="key-d35f214d65458c220e12fb46188dc8e4-1501485098596" ukl:CommentaryRef="key-d35f214d65458c220e12fb46188dc8e4"><noteRef uk:name="commentary" href="#key-d35f214d65458c220e12fb46188dc8e4" class="commentary"/>—</ins></p></intro><level class="para2" eId="section-21-3-a-i"><num><ins class="last" ukl:ChangeId="key-d35f214d65458c220e12fb46188dc8e4-1501485098596" ukl:CommentaryRef="key-d35f214d65458c220e12fb46188dc8e4">(i)</ins></num><content><p>an exempt landlord or a resident landlord, <ins class="first" ukl:ChangeId="key-c8f2f4389692ffa321c878498e95242e-1501485206129" ukl:CommentaryRef="key-c8f2f4389692ffa321c878498e95242e"><noteRef uk:name="commentary" href="#key-c8f2f4389692ffa321c878498e95242e" class="commentary"/>or</ins></p></content></level><level class="para2" eId="section-21-3-a-ii"><num><ins ukl:ChangeId="key-c8f2f4389692ffa321c878498e95242e-1501485206129" ukl:CommentaryRef="key-c8f2f4389692ffa321c878498e95242e">(ii)</ins></num><content><p><ins class="last" ukl:ChangeId="key-c8f2f4389692ffa321c878498e95242e-1501485206129" ukl:CommentaryRef="key-c8f2f4389692ffa321c878498e95242e">the Welsh Ministers in their new towns residuary capacity,</ins></p></content></level></level><level class="para1" eId="section-21-3-b"><num>(b)</num><content><p>the premises are included within the functional land of any charity.</p></content></level></subsection><subsection eId="section-21-3A"><num><ins class="first" ukl:ChangeId="d29p3137" ukl:CommentaryRef="c16944122"><noteRef uk:name="commentary" href="#c16944122" class="commentary"/>(3A)</ins></num><content><p><ins class="last" ukl:ChangeId="d29p3137" ukl:CommentaryRef="c16944122">But this Part is not prevented from applying to any premises because the interest of the landlord in the premises is held by a resident landlord if at least one-half of the flats contained in the premises are held on long leases which are not tenancies to which Part 2 of the Landlord and Tenant Act 1954 (c. 56) applies.</ins></p></content></subsection><subsection eId="section-21-4"><num>(4)</num><intro><p>An application for an order under section 24 may be made—</p></intro><level class="para1" eId="section-21-4-a"><num>(a)</num><content><p>jointly by tenants of two or more flats if they are each entitled to make such an application by virtue of this section, and</p></content></level><level class="para1" eId="section-21-4-b"><num>(b)</num><content><p>in respect of two or more premises to which this Part applies;</p></content></level><wrapUp><p>and, in relation to any such joint application as is mentioned in paragraph (a), references in this Part to a single tenant shall be construed accordingly.</p></wrapUp></subsection><subsection eId="section-21-5"><num>(5)</num><content><p>Where the tenancy of a flat contained in any such premises is held by joint tenants, an application for an order under section 24 in respect of those premises may be made by any one or more of those tenants.</p></content></subsection><subsection eId="section-21-6"><num>(6)</num><content><p>An application to the court for it to exercise in relation to any premises <ins class="first last" ukl:ChangeId="d29p3177" ukl:CommentaryRef="c10161741"><noteRef uk:name="commentary" href="#c10161741" class="commentary"/>any jurisdiction</ins> to appoint a receiver or manager shall not be made by a tenant (in his capacity as such) in any circumstances in which an application could be made by him for an order under section 24 appointing a manager to act in relation to those premises.</p></content></subsection><subsection eId="section-21-7"><num>(7)</num><content><p>References in this Part to a tenant do not include references to a tenant under a tenancy to which Part II of the <noteRef href="#c10161751" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Landlord and Tenant Act 1954 applies.</p></content></subsection><subsection eId="section-21-8"><num><ins class="first" ukl:ChangeId="key-f1ac15986777cc76f828f22f512f82b3-1501519353773" ukl:CommentaryRef="key-f1ac15986777cc76f828f22f512f82b3"><noteRef uk:name="commentary" href="#key-f1ac15986777cc76f828f22f512f82b3" class="commentary"/>(8)</ins></num><intro><p><ins ukl:CommentaryRef="key-f1ac15986777cc76f828f22f512f82b3">(b)</ins></num><content><p><ins class="last" ukl:ChangeId="key-f1ac15986777cc76f828f22f512f82b3-1501519353773" ukl:CommentaryRef="key-f1ac15986777cc76f828f22f512f82b3">in relation to premises in Wales, a leasehold valuation
