http://www.legislation.gov.uk/ukpga/1984/47Repatriation of Prisoners Act 1984An Act to make provision for facilitating the transfer between the United Kingdom and places outside the British Isles of persons for the time being detained in prisons, hospitals or other institutions by virtue of orders made in the course of the exercise by courts and tribunals of their criminal jurisdiction.1984-07-26texttext/xmlenStatute Law Database2026-04-22Expert Participation2026-03-22 1984 c. 47An Act to make provision for facilitating the transfer between the United Kingdom and places outside the British Isles of persons for the time being detained in prisons, hospitals or other institutions by virtue of orders made in the course of the exercise by courts and tribunals of their criminal jurisdiction.[26th July 1984]BE IT ENACTED by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—11Subject to the following provisions of this section, where—athe United Kingdom is a party to international arrangements providing for the transfer between the United Kingdom and a country or territory outside the British Islands of persons to whom subsection (7) below applies, andbthe relevant Minister and the appropriate authority of that country or territory have each agreed to the transfer under those arrangements of a particular person (in this Act referred to as “the prisoner”), andcin a case in which the terms of those arrangements provide for the prisoner to be transferred only with his consent, the prisoner's consent has been given,the relevant Minister shall issue a warrant providing for the transfer of the prisoner into or out of the United Kingdom.2The relevant Minister shall not issue a warrant under this section, and, if he has issued one, shall revoke it, in any case where after the duty under subsection (1) above has arisen and before the transfer in question takes place circumstances arise, or are brought to the relevant Minister’s attention, which in his opinion make it inappropriate that the transfer should take place.3The relevant Minister shall not issue a warrant under this section providing for the transfer of any person into the United Kingdom unless—athat person is a British citizen; orbthe transfer appears to the relevant Minister to be appropriate having regard to any close ties which that person has with the United Kingdom; orcit appears to the relevant Minister that the transfer is such a transfer for the purpose of the temporary return of the prisoner to the United Kingdom as may be provided for by virtue of section 4(1)(b) below.4The relevant Minister shall not issue a warrant under this section, other than one superseding an earlier warrant, unless he is satisfied that all reasonable steps have been taken to inform the prisoner in writing in his own language—aof the substance, so far as relevant to the prisoner’s case, of the international arrangements in accordance with which it is proposed to transfer him,bof the effect in relation to the prisoner of the warrant which it is proposed to issue in respect of him ...,cin the case of a transfer into the United Kingdom, of the effect in relation to the prisoner of the law relating to his detention under that warrant (including the effect of any enactment or instrument under which he may be released earlier than provided for by the terms of the warrant),din the case of a transfer out of the United Kingdom, of the effect in relation to the prisoner of so much of the law of the country or territory to which he is to be transferred as has effect with respect to transfers under those arrangements, andeof the powers of the relevant Minister under section 6 of this Act;and, the relevant Minister shall not issue a warrant superseding an earlier warrant under this section unless the requirements of this subsection were fulfilled in relation to the earlier warrant.5 In such a case as is referred to in subsection (1)(c) above, the relevant Minister shall not issue a warrant under this section unless he is satisfied that the prisoner's consent was given in a manner authorised by the international arrangements in accordance with which the prisoner is to be transferred and was so given either—aby the prisoner himself; orbin circumstances where it appears to the relevant Minister inappropriate by reason of the physical or mental condition or the youth of the prisoner for the prisoner to act for himself, by a person appearing to the relevant Minister to be an appropriate person to have acted on the prisoner’s behalf.6A consent given for the purposes of subsection (1)(c) above shall not be capable of being withdrawn after a warrant under this section has been issued in respect of the prisoner; and, accordingly, a purported withdrawal of that consent after that time shall not affect the validity of the warrant, or of any provision which by virtue of section 6 below subsequently supersedes provisions of that warrant, or of any direction given in relation to the prisoner under section 2(3) below.7This subsection applies to a person if he is for the time being required to be detained in a prison, a hospital or any other institution either—aby virtue of an order made in the course of the exercise by a court or tribunal in the United Kingdom, or in any country or territory outside the British Islands, of its criminal jurisdiction; orbunder any of the provisions of this Act or any similar provisions of the law of any part of the United Kingdom or of the law of any country or territory outside the British Islands.7AIn subsection (7)(a) the reference to an order made by a court or tribunal in the United Kingdom in the course of the exercise of its criminal jurisdiction includes an order made (anywhere) by—athe Court Martial;bthe Service Civilian Court;cthe Court Martial Appeal Court; ordthe Supreme Court on an appeal brought from the Court Martial Appeal Court.8In subsection (7)(b) above the reference to provisions similar to any of the provisions of this Act shall be construed as a reference to any provisions which have effect with respect to —athe transfer between different countries and territories (or different parts of a country or territory) of persons who are required to be detained in prisons, hospitals or other institutions by virtue of orders made in the course of the exercise by courts and tribunals of their criminal jurisdiction; orbthe transfer between different countries and territories (or different parts of a country or territory) of responsibility for the detention and release of persons who are required to be so detained in one of those countries or territories (or parts of a country or territory) but are present in the other country or territory (or part of a country or territory).9In this section “relevant Minister” means–athe Scottish Ministers in a case where the person who is the subject of the proposed transfer is for the time being required to be detained in a prison, a hospital or any other institution either–iin Scotland; oriiin the country or territory referred to in subsection (1)(b) above if it is proposed to transfer him from that country or territory to Scotland; ...aathe Department of Justice in Northern Ireland in a case where the person who is the subject of the proposed transfer is for the time being required to be detained in a prison, a hospital or any other institution either—iin Northern Ireland; oriiin the country or territory referred to in subsection (1)(b) above if it is proposed to transfer him from that country or territory to Northern Ireland; andbthe Secretary of State in any other case.21The effect of a warrant under section 1 under section 1 providing for the transfer of the prisoner out of the United Kingdom shall be to authorise—athe taking of the prisoner to any place in any part of the United Kingdom, his delivery at a place of departure from the United Kingdom into the custody of an appropriate person and his removal by that person from the United Kingdom to a place outside the United Kingdom; orbthe taking of the prisoner to any place in any part of the United Kingdom, his removal from the United Kingdom and his delivery, at the place of arrival from the United Kingdom, into the custody of an appropriate person.1AIn subsection (1) “appropriate person” means a person representing the appropriate authority of the country or territory to which the prisoner is to be transferred.2Subject to subsections (3) to (5) below, the order by virtue of which the prisoner is required to be detained at the time such a warrant is issued in respect of him shall continue to have effect after his removal from the United Kingdom so as to apply to him if he is again in the United Kingdom at any time when under that order he is to be, or may be, detained.3If, at any time after the removal of the prisoner from the United Kingdom, it appears to the relevant Minister appropriate to do so in order that effect may be given to the international arrangements in accordance with which the prisoner was transferred, the relevant Minister may give a direction varying the order referred to in subsection (2) above or providing for that order to cease to have effect.3AIn subsection (3) above, “relevant Minister” means–athe Scottish Ministers where the order referred to in subsection (2) above relates to a person who has been removed from Scotland by virtue of a warrant issued under section 1 above; ...aathe Department of Justice in Northern Ireland where the order referred to in subsection (2) above relates to a person who has been removed from Northern Ireland by virtue of a warrant issued under section 1 above; andbthe Secretary of State in any other case.4The power by direction under subsection (3) above to vary the order referred to in subsection (2) above shall include power by direction—ato provide for how any period during which the prisoner is, by virtue of a warrant under section 1 , out of the part of the United Kingdom in which that order has effect is to be treated for the purposes of that order; andbto provide for the prisoner to be treated as having been— ireleased on licence under section 28(5) of the Crime (Sentences) Act 1997 or under Chapter 6 of Part 12 of the Criminal Justice Act 2003; or iireleased on licence under section 1(2), (3) or (4), 1AB, 2(4) or 7(1) or (2) of the Prisoners and Criminal Proceedings (Scotland) Act 1993; iiareleased subject to a supervised release order made under section 209 of the Criminal Procedure (Scotland) Act 1995;iiireleased on licenceunder Article 6(3) of the Life Sentences (Northern Ireland) Order 2001 or discharged on licence Article 46 of the Criminal Justice (Children)(Northern Ireland) Order 1998 (release and discharge on licence of, respectively, persons serving imprisonment for life and children in detention for grave crimes); oriiiareleased on licence under Article 17 or 19 of the Criminal Justice (Northern Ireland) Order 2008;ivfor the purposes of Part II of the Treatment of Offenders (Northern Ireland) Order 1976 (conviction within certain period after discharge), discharged from prison or a young offenders centre in pursuance of rules made under section 13 of the said Act of 1953.5Except in relation to any period during which a restriction order is in force in respect of the prisoner, subsection (2) above shall not apply in relation to a hospital order; and, accordingly, a hospital order shall cease to have effect in relation to the prisoner—aat the time of his removal from the United Kingdom if no restriction order is in force in respect of him at that time; andbif at that time a restriction order is in force in respect of him, as soon after his removal as the restriction order ceases to have effect.6In subsection (5) above—“hospital order” means an order made under section 37 of the Mental Health Act 1983, section 175 or 376 of the Criminal Procedure (Scotland) Act 1975 or Article 44 of the Mental Health (Northern Ireland) Order 1986 or a compulsion order under section 57A of the Criminal Procedure (Scotland) Act 1995 or any order or direction made under another enactment but having the same effect as an order made under one of those provisions; and“restriction order” means an order made under section 41 of the said Act of 1983, section 178 or 379 of the said Act of 1975 or Article 47 of the said Order of 1986 or any order or direction made under another enactment but having the same effect as an order made under one of those provisions.7References in this section to the order by virtue of which the prisoner is required to be detained at the time a warrant under section 1 is issued in respect of him include references to any order by virtue of which he is required to be detained after the order by virtue of which he is required to be detained at that time ceases to have effect.31The effect of a warrant under section 1 providing for the transfer of the prisoner into the United Kingdom shall be to authorise—athe bringing of the prisoner into the United Kingdom from a place outside the United Kingdom;bthe taking of the prisoner to such place in any part of the United Kingdom, being a place at which effect may be given to the provisions contained in the warrant by virtue of paragraph (c) below, as may be specified in the warrant; andcthe detention of the prisoner in any part of the United Kingdom in accordance with such provisions as may be contained in the warrant, being provisions appearing to the relevant Minister to be appropriate for giving effect to the international arrangements in accordance with which the prisoner is transferred.2Subject to section 4(2) to (4) below, a provision shall not be contained by virtue of subsection (1)(c) above in a warrant under section 1 unless it satisfies the following two conditions, that is to say—ait is a provision with respect to the detention of a person in a prison, a hospital or any other institution; andbit is a provision which at the time the warrant is issued may be contained in an order made either—iin the course of the exercise of its criminal jurisdiction by a court in the part of the United Kingdom in which the prisoner is to be detained; oriiotherwise than by a court but for the purpose of giving effect to an order made as mentioned in sub-paragraph (i) above.3In determining for the purposes of paragraph (c) of subsection (1) above what provisions are appropriate for giving effect to the international arrangements mentioned in that paragraph, the relevant Minister shall, to the extent that it appears to him consistent with those arrangements to do so, have regard to the inappropriateness of the warrant’s containing provisions which—aare equivalent to more than the maximum penalties (if any) that may be imposed on a person who, in the part of the United Kingdom in which the prisoner is to be detained, commits an offence corresponding to that in respect of which the prisoner is required to be detained in the country or territory from which he is to be transferred; orbare framed without reference to the length—iof the period during which the prisoner is, but for the transfer, required to be detained in that country or territory; andiiof so much of that period as will have been, or be treated as having been, served by the prisoner when the said provisions take effect.4Subject to subsection (6) below and the Schedule to this Act, a provision contained by virtue of subsection (1)(c) above in a warrant under section 1 shall for all purposes have the same effect as the same provision contained in an order made as mentioned in sub-paragraph (i) or, as the case may be, sub-paragraph (ii) of subsection (2) (b) above.5A provision contained by virtue of subsection (1)(c) above in a warrant under this Act shall take effect with the delivery of the prisoner to the place specified in the warrant for the purposes of subsection (1)(b) above.6Subsection (4) above shall not confer any right of appeal on the prisoner against provisions contained by virtue of subsection (1)(c) above in a warrant under section 1.7 Part 1 of the Schedule to this Act shall have effect, subject to section 4(4) below, with respect to the operation of certain enactments in relation to provisions contained by virtue of subsection (1)(c) above in a warrant under section 1.8For the purposes of determining whether at any particular time any such order as is mentioned in subsection (2)(b) above could have been made as so mentioned, there shall be disregarded both—aany requirement that certain conditions must be satisfied before the order is made; andbany restriction on the minimum period in respect of which the order may be made.9. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .10. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .3A1This section applies where—aa person has been transferred into the United Kingdom under a warrant under section 1, andbthe international arrangements in accordance with which the person has been transferred contain a speciality provision.2The person must not, unless a condition in subsection (3) is met—abe prosecuted for any offence committed before the departure of that person from the country or territory from which that person has been transferred, orbbe detained or otherwise subjected to any restriction of liberty for any offence committed before the departure of that person from the country or territory from which that person has been transferred, other than the offence in respect of which the person has been transferred.3For the purposes of subsection (2), the conditions are as follows—athe person has consented to the transfer;bthe offence is an offence which is not punishable with imprisonment or another form of detention;cthe offence is an offence in respect of which the person will not be detained in connection with the person's trial, sentence or appeal;dthe person is given an opportunity to leave the United Kingdom and—ithe person does not do so before the end of the permitted period, oriiif the person does so before the end of the permitted period, the person subsequently returns to Great Britain;eafter the transfer has taken place, the person has made a renunciation of the application of subsection (2) to the offence;fthe appropriate authority of the country or territory from which the person has been transferred consents to the prosecution of the offence.4For the purpose of subsection (3)(d) the “permitted period” is 45 days starting with the day on which the person's sentence ends.5For the purpose of subsection (3)(e) a renunciation must be made before a court before which the person may be prosecuted for that offence.6In this section a “speciality provision” means a provision preventing or limiting the prosecution, detention or other restriction of liberty of the person (“P”) for any offence committed before the departure of P from the country or territory from which P has been transferred, other than for the offence in respect of which P has been transferred.41A single warrant under section 1 may provide for the transfer of the prisoner both out of and into (or into and out of) the United Kingdom if it appears to the relevant Minister that the transfers are to be for the purpose of the temporary return of the prisoner either—afrom the United Kingdom to a country or territory outside the British Islands from which he has previously been transferred into the United Kingdom, or from which responsibility for his detention and release has previously been transferred to the United Kingdom, under this Act or any other enactment; orbto the United Kingdom from a country or territory outside the British Islands to which he has previously been transferred, or to which responsibility for his detention and release has previously been transferred, from the United Kingdom under this Act.2The provisions contained by virtue of section 3(1)(c) above in a warrant under section 1 issued for the purpose of the temporary return of the prisoner to a country or territory outside the British Islands may, where the prisoner is required when that warrant is issued to be detained in accordance with provisions so contained in an earlier warrant under section 1 or section 4A, require the prisoner to continue, after his return to the part of the United Kingdom in which the provisions contained in the earlier warrant have effect, to be detained in accordance with those earlier provisions.3A warrant issued under section 1 containing, with respect to provisions contained in an earlier warrant under section 1 or section 4A, any such requirement as is referred to in subsection (2) above, shall provide that any period during which the prisoner is out of the part of the United Kingdom in which the provisions contained in the earlier warrant have effect and is in custody is to be treated (except to such extent as may be specified in the warrant in order that effect may be given to the international arrangements in question) as a period during which the prisoner is detained under the provisions contained in the earlier warrant.4The provisions contained by virtue of section 3(1)(c) above in a warrant under section 1 issued for the purpose of the temporary return of the prisoner to the United Kingdom may require the prisoner to be detained in accordance with any order which on his return will apply in respect of him in pursuance of section 2(2) above; and the Schedule to this Act shall not apply in relation to the provisions so contained in such a warrant.5In this section “relevant Minister” means–athe Scottish Ministers in a case where the prisoner is a person who is either–idetained in Scotland and the transfers are for the purpose of a temporary return of the prisoner to a country or territory outside the British Islands from which he has previously been transferred into Scotland under this Act or any other enactment; oriidetained in a country or territory outside the British Islands to which he has previously been transferred from Scotland under this Act; ...aathe Department of Justice in Northern Ireland in a case where the prisoner is a person who is either—idetained in Northern Ireland and the transfers are for the purpose of a temporary return of the prisoner to a country or territory outside the British Islands from which he has previously been transferred into Northern Ireland under this Act or any other enactment; oriidetained in a country or territory outside the British Islands to which he has previously been transferred from Northern Ireland under this Act; andbthe Secretary of State in any other case.6Any reference in subsection (5)(a) to the prisoner having previously been transferred into or from Scotland includes a reference to responsibility for his detention and release having previously been transferred to or from the Scottish Ministers (as the case may be).7Any reference in subsection (5)(aa) to the prisoner having previously been transferred into or from Northern Ireland includes a reference to responsibility for his detention and release having previously been transferred to or from the Department of Justice in Northern Ireland (as the case may be).4A1This section enables responsibility for the detention and release of a person to whom subsection (2) or (3) applies to be transferred between the relevant Minister in the United Kingdom and the appropriate authority in a country or territory outside the British Islands.2A person falls within this subsection if that person—ais a person to whom section 1(7) applies by virtue of—ian order made in the course of the exercise by a court or tribunal in any part of the United Kingdom of its criminal jurisdiction; oriiany of the provisions of this Act or any similar provisions of the law of any part of the United Kingdom; andbis present in a country or territory outside the British Islands.3A person falls within this subsection if that person—ais a person to whom section 1(7) applies by virtue of —ian order made in the course of the exercise by a court or tribunal in a country or territory outside the British Islands of its criminal jurisdiction; oriiany provisions of the law of such a country or territory which are similar to any of the provisions of this Act; andbis present in the United Kingdom.4Terms used in subsection (2)(a) and (3)(a) have the same meaning as in section 1(7).5Subject to the following provisions of this section, where—athe United Kingdom is a party to international arrangements providing for the transfer between the United Kingdom and a country or territory outside the British Islands of responsibility for the detention and release of persons to whom subsection (2) or (3) applies,bthe relevant Minister and the appropriate authority of that country or territory have each agreed to the transfer under those arrangements of responsibility for the detention and release of a particular person to whom subsection (2) or (3) applies (in this Act referred to as “the relevant person”), andcin a case in which the terms of those arrangements provide for the transfer of responsibility to take place only with the relevant person's consent, that consent has been given,the relevant Minister shall issue a warrant providing for the transfer of responsibility for the detention and release of the relevant person from the relevant Minister (where subsection (2) applies) or to the relevant Minister (where subsection (3) applies).6The relevant Minister shall not issue a warrant under this section providing for the transfer of responsibility for the detention and release of a person to the relevant Minister unless—athat person is a British citizen;bthe transfer appears to the relevant Minister to be appropriate having regard to any close ties which that person has with the United Kingdom.7The relevant Minister shall not issue a warrant under this section where, after the duty in subsection (5) has arisen, circumstances arise or are brought to his attention which in his opinion make it inappropriate that the transfer of responsibility should take place.8The relevant Minister shall not issue a warrant under this section (other than one superseding an earlier warrant) unless he is satisfied that all reasonable steps have been taken to inform the relevant person in writing in his own language—aof the substance, so far as relevant to the case, of the international arrangements in accordance with which it is proposed to transfer responsibility for his detention and release;bof the effect in relation to the relevant person of the warrant which it is proposed to issue under this section;cin the case of a person to whom subsection (2) applies, of the effect in relation to his case of so much of the law of the country or territory concerned as has effect with respect to transfers under those arrangements of responsibility for his detention and release;din the case of a person to whom subsection (3) applies, of the effect in relation to his case of the law relating to his detention under that warrant and subsequent release (including the effect of any enactment or instrument under which he may be released earlier than provided for by the terms of the warrant); andeof the powers of the relevant Minister under section 6;and the relevant Minister shall not issue a warrant superseding an earlier warrant under this section unless the requirements of this subsection were fulfilled in relation to the earlier warrant.9A consent given for the purposes of subsection (5)(c) shall not be capable of being withdrawn after a warrant under this section has been issued in respect of the relevant person; and, accordingly, a purported withdrawal of that consent after that time shall not affect the validity of the warrant, or of any provision which by virtue of section 6 subsequently supersedes provisions of that warrant, or of any direction given in relation to the prisoner under section 4B(3).10In this section “relevant Minister” means—athe Scottish Ministers in a case where the person who is the subject of the proposed transfer of responsibility is—ia person to whom subsection (2) applies who is for the time being required to be detained at a place in Scotland; oriia person to whom subsection (3) applies, if it is proposed that he will be detained at a place in Scotland;aathe Department of Justice in Northern Ireland in a case where the person who is the subject of the proposed transfer of responsibility is—ia person to whom subsection (2) applies who is for the time being required to be detained at a place in Northern Ireland; oriia person to whom subsection (3) applies, if it is proposed that he will be detained at a place in Northern Ireland;bthe Secretary of State, in any other case.4B1The effect of a warrant under section 4A relating to a person to whom subsection (2) of that section applies shall be to transfer responsibility for the detention and release of that person from the relevant Minister (as defined in section 4A(10)) to the appropriate authority of the country or territory in which he is present.2Subject to subsections (3) to (6), the order by virtue of which the relevant person is required to be detained at the time such a warrant is issued in respect of him shall continue to have effect after the transfer of responsibility so as to apply to him if he comes to be in the United Kingdom at any time when under that order he is to be, or may be, detained.3If, at any time after the transfer of responsibility, it appears to the relevant Minister appropriate to do so in order that effect may be given to the international arrangements in accordance with which the transfer took place, the relevant Minister may give a direction—avarying the order referred to in subsection (2); orbproviding for the order to cease to have effect.4In subsection (3) “relevant Minister” means—athe Scottish Ministers, where Scotland is the part of the United Kingdom in which the order referred to in subsection (2) has effect; ...aathe Department of Justice in Northern Ireland, where Northern Ireland is the part of the United Kingdom in which the order referred to in subsection (2) has effect; andbthe Secretary of State in any other case.5The power by direction under subsection (3) to vary the order referred to in subsection (2) includes power by direction—ato provide for how any period during which the detention and release of the relevant person is, by virtue of a warrant under section 4A, the responsibility of a country or territory outside the United Kingdom is to be treated for the purposes of the order; andbto provide for the relevant person to be treated as having been released or discharged as mentioned in any paragraph of section 2(4)(b).6Except in relation to any period during which a restriction order is in force in respect of the relevant person, subsection (2) shall not apply in relation to a hospital order; and, accordingly, a hospital order shall cease to have effect in relation to that person—aat the time of the transfer of responsibility, if no restriction order is in force in respect of him at that time; andbif at that time a restriction order is in force in respect of him, as soon after the transfer of responsibility as the restriction order ceases to have effect.7In subsection (6) “hospital order” and “restriction order” have the same meaning as in section 2(6).8References in this section to the order by virtue of which a person is required to be detained at the time a warrant under section 4A is issued in respect of him include references to any order by virtue of which he is required to be detained after the order by virtue of which he is required to be detained at that time ceases to have effect.4C1The effect of a warrant under section 4A relating to a person to whom subsection (3) of that section applies shall be to transfer responsibility for the detention and release of that person to the relevant Minister (as defined in section 4A(10)) and to authorise—athe taking of that person in custody to such place in any part of the United Kingdom as may be specified in the warrant, being a place at which effect may be given to the provisions contained in the warrant by virtue of paragraph (b); andbthe detention of that person in any part of the United Kingdom in accordance with such provisions as may be contained in the warrant, being provisions appearing to the relevant Minister to be appropriate for giving effect to the international arrangements in accordance with which responsibility for that person is transferred.2A provision shall not be contained by virtue of subsection (1)(b) in a warrant under section 4A unless it satisfies the following two conditions, that is to say—ait is a provision with respect to the detention of a person in a prison, a hospital or any other institution; andbit is a provision which at the time the warrant is issued may be contained in an order made either—iin the course of the exercise of its criminal jurisdiction by a court in the part of the United Kingdom in which the person is to be detained; oriiotherwise than by a court but for the purpose of giving effect to an order made as mentioned in sub-paragraph (i).3Section 3(3) applies for determining for the purposes of paragraph (b) of subsection (1) above what provisions are appropriate for giving effect to the international arrangements mentioned in that paragraph in a relevant person's case as it applies for the purposes of section 3(1)(c) in the case of a prisoner who is to be transferred into the United Kingdom.4Subject to subsection (6) and Part 2 of the Schedule to this Act, a provision contained by virtue of subsection (1)(b) in a warrant under section 4A shall for all purposes have the same effect as the same provision contained in an order made as mentioned in sub-paragraph (i) or, as the case may be, sub-paragraph (ii) of subsection (2)(b).5A provision contained by virtue of subsection (1)(b) in a warrant under section 4A shall take effect with the delivery of the relevant person to the place specified in the warrant for the purposes of subsection (1)(a).6Subsection (4) shall not confer any right of appeal on the relevant person against provisions contained by virtue of subsection (1)(b) in a warrant under this section.7Part 2 of the Schedule to this Act shall have effect with respect to the operation of certain enactments in relation to provisions contained by virtue of subsection (1)(b) in a warrant under section 4A.8For the purposes of determining whether at any particular time any such order as is mentioned in subsection (2)(b) could have been made as so mentioned, there shall be disregarded both—aany requirement that certain conditions must be satisfied before the order is made; andbany restriction on the minimum period in respect of which the order may be made.4D1The Secretary of State or the Scottish Ministers or the Department of Justice in Northern Ireland may issue a certificate stating that the issuing authority—aconsiders that there are reasonable grounds for believing that a person in the United Kingdom is a person falling within section 4A(3), andbhas requested written confirmation from the country or territory concerned of the details of that person's case.2The issuing authority may send the certificate (with any other documents appearing to the authority to be relevant) to the appropriate judge with a view to obtaining the issue of a warrant under subsection (3).3The appropriate judge may, on receiving the certificate, issue a warrant for the arrest of the person concerned if the judge is satisfied that there are reasonable grounds for believing that the person falls within section 4A(3).4The warrant may be executed anywhere in the United Kingdom by any designated person (and it is immaterial whether or not he is in possession of the warrant or a copy of it).5A person arrested under this section shall, as soon as is practicable—abe given a copy of the warrant for his arrest; andbbe brought before the appropriate judge.6The appropriate judge may order that a person before him who is the subject of a certificate under this section is to be detained from the time the order is made until the end of the period of seven days beginning with the day after that on which the order is made.7The purpose of an order under subsection (6) is to secure the detention of the person concerned while—awritten confirmation is obtained from a representative of the country or territory concerned of the details of his case;bit is established whether he is a person falling within section 4A(3); andcany application for an order under section 4E(6) is made in respect of him.8Subject to subsection (9), a person detained under such an order may be released at any time during the period mentioned in subsection (6) and shall be released at the end of that period (if not released sooner).9Subsection (8) ceases to apply to the detained person if, during that period, an order under section 4E is made in respect of him.10It is immaterial for the purposes of subsection (6) whether or not the person concerned has previously been arrested under this section.4E1The Secretary of State or the Scottish Ministers or the Department of Justice in Northern Ireland may issue a certificate stating that the issuing authority—aconsiders that a person in the United Kingdom is a person falling within section 4A(3), andbhas received written confirmation from a representative of the country or territory concerned of the details of that person's case;and it is immaterial for the purposes of this section whether or not the person concerned has been previously arrested or detained under section 4D.2The issuing authority may send the certificate (with a copy of the written confirmation mentioned in subsection (1)(b) and any other documents appearing to that authority to be relevant) to the appropriate judge with a view to obtaining the issue of a warrant under subsection (3).3The appropriate judge may, on receiving the certificate, issue a warrant for the arrest of the person concerned if the judge is satisfied that there are reasonable grounds for believing that the person falls within section 4A(3).4The warrant may be executed anywhere in the United Kingdom by any designated person (and it is immaterial whether or not that person is in possession of the warrant or a copy of it).5A person arrested under this section shall, as soon as is practicable—abe given a copy of the warrant for his arrest; andbbe brought before the appropriate judge.6The appropriate judge may, on the application of the Secretary of State or the Scottish Ministers or the Department of Justice in Northern Ireland, order that a person before the judge who—ais the subject of a certificate under this section, andbthe judge is satisfied is a person falling within section 4A(3),shall be detained from the time the order is made until the end of the period of fourteen days beginning with the day after that on which the order is made.7The purpose of an order under subsection (6) is to secure the detention of the person concerned until—ait is determined whether to issue a warrant under section 4A; andbif so determined, such a warrant is issued.8Subject to subsection (9), a person detained under such an order may be released at any time during the period mentioned in subsection (6) and shall be released at the end of that period (if not released sooner).9Subsection (8) ceases to apply to the detained person if, during that period, a warrant under section 4A is issued in respect of him.10It is immaterial for the purposes of subsection (6) whether or not the person concerned has previously been arrested or detained under section 4D or arrested under this section.4F1This section has effect for the purposes of sections 4D and 4E.2A “designated person” is a person designated by the Secretary of State or the Scottish Ministers or the Department of Justice in Northern Ireland .3The appropriate judge is—ain England and Wales, any District Judge (Magistrates' Courts) who is designated for those purposes by the Lord Chief Justice after consulting the Lord Chancellor;bin Scotland, the sheriff of Lothian and Borders; andcin Northern Ireland, any county court judge or resident magistrate who is designated for those purposes by the Lord Chief Justice of Northern Ireland after consulting the Lord Chancellor.4A designation under subsection (2) or (3)(a) or (c) may be made—afor the purposes of section 4D or 4E (or both); andbfor all cases or only for cases (or cases of a description) specified in the designation.5A designated person shall have all the powers, authority, protection and privileges of a constable in any part of the United Kingdom in which a person who may be arrested under section 4D or 4E is for the time being.51Where a warrant has been issued under section 1 the following provisions of this section (apart from subsection (9)) shall have effect for the purposes of the warrant, except (without prejudice to section 3(4) above or any enactment contained otherwise than in this Act) in relation to any time when the prisoner is required to be detained in accordance with provisions contained in the warrant by virtue of section 3(1)(c) above.2The prisoner shall be deemed to be in the legal custody of the relevant Minister at any time when, being in the United Kingdom or on board a British ship, a British aircraft or a British hovercraft, he is being taken under the warrant to or from any place, or being kept in custody under the warrant.3The relevant Minister may, from time to time, designate any person as a person who is for the time being authorised for the purposes of the warrant to take the prisoner to or from any place under the warrant, or to keep the prisoner in custody under the warrant.4A person authorised by or for the purposes of the warrant to take the prisoner to or from any place or to keep the prisoner in custody shall have all the powers, authority, protection and privileges—aof a constable in any part of the United Kingdom in which that person is for the time being; orbif he is outside the United Kingdom, of a constable in the part of the United Kingdom to or from which the prisoner is to be taken under the warrant.5If the prisoner escapes or is unlawfully at large, he may be arrested without warrant by a constable and taken to any place to which he may be taken under the warrant under this Act.6In subsection (2) above—“British aircraft” means a British-controlled aircraft within the meaning of section 92 of the Civil Aviation Act 1982 (application of criminal law to aircraft), or one of Her Majesty’s aircraft;“British hovercraft” means a British-controlled hovercraft within the meaning of the said section 92 as applied in relation to hovercraft by virtue of provision made under the Hovercraft Act 1968, or one of Her Majesty’s hovercraft; and“British ship” means a British ship within the meaning of the Merchant Shipping Act 1995, or one of Her Majesty’s ships;and in this subsection reference to Her Majesty’s aircraft, hovercraft or ships are references to the aircraft, hovercraft or, as the case may be, ships which belong to, or are exclusively employed in the service of, Her Majesty in right of the government of the United Kingdom.7In subsection (5) above “constable”, in relation to any part of the United Kingdom, means any person who is a constable in that or any other part of the United Kingdom or any person who, at the place in question has, under any enactment (including subsection (4) above), the powers of a constable in that or any other part of the United Kingdom.8In this section “relevant Minister” means–athe Scottish Ministers where the warrant provides for the transfer of a prisoner to or from Scotland; ...aathe Department of Justice in Northern Ireland where the warrant provides for the transfer of a prisoner to or from Northern Ireland; andbthe Secretary of State in any other case.9Where—aa warrant under section 4A has been issued, andbthe relevant person is a person to whom subsection (3) of that section applies,subsections (2) to (8) above apply for the purposes of that warrant (but with the modifications contained in subsection (10)), except (without prejudice to section 4C(4) or any enactment contained otherwise than in this Act) in relation to any time when the relevant person is required to be detained in accordance with provisions contained in the warrant by virtue of section 4C(1)(b).10In their application for the purposes of a warrant under section 4A those subsections shall have effect as if—aany reference to the warrant under section 1 (however expressed) were a reference to the warrant under section 4A;bany reference to the prisoner were a reference to the relevant person;cin subsection (4)—iin paragraph (a) for “that person” there were substituted “ the authorised person ”; andiiparagraph (b) were omitted; ...din subsection (8)(a) for “transfer of a prisoner to or from Scotland” there were substituted “ transfer of responsibility for the detention and release of the relevant person to the Scottish Ministers” ; andein subsection (8)(aa) for “transfer of a prisoner to or from Northern Ireland” there were substituted “transfer of responsibility for the detention and release of the relevant person to the Department of Justice61Subject to section 1(4) above, if at any time it appears to the relevant Minister appropriate, in order that effect may be given to any such arrangements as are mentioned in section 1(1)(a) above or in a case falling within section 1(2) above, for a warrant under section 1 to be revoked or varied, he may, as the case may require—arevoke that warrant; orbrevoke that warrant and issue a new warrant under that section containing provision superseding some or all of the provisions of the previous warrant.1ASubject to section 4A(8), if at any time it appears to the relevant Minister appropriate, in order that effect may be given to any such arrangements as are mentioned in section 4A(5)(a) for a warrant under section 4A to be revoked or varied, he may as the case may require—arevoke that warrant; orbrevoke that warrant and issue a new warrant under section 4A containing provision superseding some or all of the provisions of the previous warrant.2Subject to subsection (3)(c) below, the provision that may be contained in a new warrant issued by virtue of subsection (1)(b) or (1A)(b) above shall be any provision that could have been contained in the previous warrant.3A new warrant issued by virtue of subsection (1)(b) or (1A)(b) above may provide—athat a provision contained in it is to be treated as having taken effect when the provisions which that provision supersedes took effect;bthat things done under or for the purposes of the superseded provisions are, accordingly, to be treated as having been done under or for the purposes of the provision contained in the new warrant; andcthat an enactment in force at the time the new warrant is issued is, for the purposes of subsection (2) above or this subsection, to be treated as having been in force when the superseded provisions took effect.4The powers conferred by this section shall be exercisable notwithstanding any defect in the warrant which is revoked.5In this section “relevant Minister” means–athe Scottish Ministers in a case where— ithe warrant was issued under section 1 and provides for the transfer of the prisoner to or from Scotland; oriithe warrant was issued under section 4A and provides for the transfer of responsibility for the detention and release of the relevant person to those Ministers;aathe Department of Justice in Northern Ireland in a case where—ithe warrant was issued under section 1 and provides for the transfer of the prisoner to or from Northern Ireland; oriithe warrant was issued under section 4A and provides for the transfer of responsibility for the detention and release of the relevant person to the Department of Justice;bthe Secretary of State in any other case.6A1The relevant Minister may issue a transit order where—athe United Kingdom is a party to international arrangements providing for the transfer between the United Kingdom and a country or territory outside the British Islands of persons to whom subsection (2) applies; andbthe relevant Minister has received a request from the appropriate authority of that country or territory in accordance with those arrangements for the transit of a person to whom subsection (2) applies through a part of the United Kingdom.2A person falls within this subsection if—athat person is for the time being required to be detained in a prison, a hospital or any other institution either—iby virtue of an order made in the course of the exercise by a court or tribunal in a country or territory outside the British Islands of its criminal jurisdiction; oriiby virtue of any provisions of the law of such a country or territory which are similar to any of the provisions of this Act; andbexcept in a case where a transit request is made in the circumstances described in section 6D (1), that person is present in a country or territory outside the British Islands.3The relevant Minister may issue a transit order where—ainternational arrangements apply to any of the Channel Islands or the Isle of Man which provide for the transfer between that island and a country or territory outside the British Islands of persons to whom subsection (4) applies; andbthe relevant Minister has received a request from the appropriate authority of that island for the transit of a person to whom subsection (4) applies through a part of the United Kingdom.4A person falls within this subsection if—athat person is for the time being required to be detained in a prison, a hospital or any other institution either—iby virtue of an order made in the course of the exercise of its criminal jurisdiction by a court or tribunal in the island from which the transit request is made; oriiby virtue of any provisions of the law of that island which are similar to any of the provisions of this Act; andbexcept in a case where a transit request is made in the circumstances described in section 6D(1), that person is present in that island.5Terms used in subsection (2)(a) or (4)(a) have the same meaning as in section 1(7).6In this section and sections 6B, 6C and 6D “transit order” means an order issued by the relevant Minister, in respect of a person who has been the subject of a request within subsection (1)(b) or (3)(b), which authorises the detention of that person in any part of the United Kingdom at any time when that person is in transit.7In subsection (6) “detention” includes detention while the person is being taken from one place to another place within the United Kingdom.8A person may be detained pursuant to a transit order only for as long as is reasonable and necessary to allow the transit to take place.9In this section and section 6B “relevant Minister” means—athe Scottish Ministers, in a case where it is proposed that the person who is the subject of a request under subsection (1)(b) or (3)(b) will, whilst in transit—ibe present only in Scotland, oriiarrive in Scotland before being taken to another part of the United Kingdom;aathe Department of Justice in Northern Ireland, in a case where it is proposed that the person who is the subject of a request under subsection (1)(b) or (3)(b) will, whilst in transit—ibe present only in Northern Ireland, oriiarrive in Northern Ireland before being taken to another part of the United Kingdom;bthe Secretary of State, in any other case.10For the purposes of this section and sections 6B and 6C a person who is the subject of a transit order is “in transit” at any time during the period beginning with the arrival of that person in the United Kingdom and ending with the removal of that person from the United Kingdom .6B1A person who is the subject of a transit order is deemed to be in the legal custody of the relevant Minister at any time when that person is in transit.2A constable may for the purposes of a transit order detain a person who is the subject of that order.3The relevant Minister may, from time to time, designate any person as a person who is for the time being authorised for the purposes of a transit order to detain a person under the order.4A person authorised under subsection (3) has all the powers, authority, protection and privileges of a constable in any part of the United Kingdom in which the person who is the subject of the transit order is for the time being.5If a person who is the subject of a transit order escapes or is unlawfully at large, that person may be arrested without warrant by a constable.6A constable may search a person who is the subject of a transit order, and any item in the possession of that person, for any item which that person might use—ato cause physical injury to that person or to any other person; orbto assist that person to escape from detention.7The power conferred by subsection (6) does not authorise a constable to require a person to remove any clothing other than an outer coat, jacket, headgear or gloves.8The power conferred by subsection (6) includes power to use reasonable force where necessary.9A constable searching a person in the exercise of the power conferred by subsection (6) may seize any item found if the constable has reasonable grounds for believing that the person searched might use the item —ato cause physical injury to that person or to any other person; orbto assist that person to escape from detention.10Any item seized from a person under subsection (9) may be retained while that person is in transit.11In this section “constable” means—aany person who is a constable in any part of the United Kingdom or who has, under any enactment (including subsection (4) above), the powers of a constable in any part of the United Kingdom , orbany person who is a prison officer within the meaning of section 117(1) of the Criminal Justice and Public Order Act 1994.12A person who is a constable by virtue of subsection (11)(a) has, for the purposes of section 6A, this section and section 6C, all the powers, authority, protection and privileges of a constable in any part of Great Britain in which a person who is the subject of a transit order is for the time being.6C1Where—aa transit order is issued by the Minister for one part of the United Kingdom (“jurisdiction A”), andbit is proposed that the person who is the subject of the order will whilst in transit be taken to another part of the United Kingdom (“jurisdiction B”),the Minister for jurisdiction A must notify the Minister for jurisdiction B.2Notification need not be given where the Minister for jurisdiction B has agreed in writing to the transit order.3Unless the Minister for jurisdiction B agrees in writing to the transit order, the order authorises the detention of the person subject to it in jurisdiction A only.4But where the person escapes or is unlawfully at large, the order also authorises—athe arrest of the person under section 6B(5) in a part of the United Kingdom other than jurisdiction A, andbthe detention of the person in that part by a constable (within the meaning of that section) for the purpose of taking the person to jurisdiction A.5For the purposes of this section—athe Minister for England and Wales, is the Secretary of State,bthe Minister for Scotland is the Scottish Ministers, andcthe Minister for Northern Ireland is the Department of Justice in Northern Ireland.6D1This section applies where—aa person is being transferred between two countries or territories outside the United Kingdom in accordance with international arrangements between those two countries or territories providing for the transfer of persons within section 6A(2)(a) or (4)(a),bthe United Kingdom is a party to international arrangements of the kind mentioned in section 6A(1)(a) with at least one of those countries or territories such that the country or territory can make a request under section 6A(1)(b), andcthe person makes an unscheduled arrival in the United Kingdom.2A constable may detain a person to whom subsection (1) applies until the expiry of the period of 72 hours beginning with the person's arrival in the United Kingdom or until a transit order is issued under section 6A in respect of that person, whichever is the sooner.3In this section “constable” means any person who is a constable in any part of the United Kingdom or who has, under any enactment (including section 6B(4) above), the powers of a constable in any part of the United Kingdom.4A person who is a constable by virtue of subsection (3) has for the purposes of this section all the powers, authority, protection and privileges of a constable in the part of the United Kingdom in which the person mentioned in subsection (2) is for the time being.71Subject to subsection (2) below, any expenses incurred by the Secretary of State for the purposes of this Act shall be defrayed out of money provided by Parliament.2Subject to subsections (3) and (4) below, it shall be the duty of the relevant Minister, in the case of the transfer of a person into the United Kingdom under this Act, to secure the payment to him by that person, or from some other source, of the amount of any expenses incurred by him in connection with the conveyance of that person to the United Kingdom; and for this purpose the relevant Minister shall have the same power as in any other case where he assists the return of a person to the United Kingdom to require a person to give an undertaking to pay the relevant Minister the whole or any part of that amount, to enforce such an undertaking and to make such other arrangements for recovering that amount as he thinks fit.3Subsection (2) above shall not apply to the extent that in any case it appears to the relevant Minister that it would be unreasonable for him to exercise any of the powers conferred by that subsection either because of the exceptional circumstances of the case or because the means of the prisoner are insufficient to meet the expenses and their recovery, whether immediately or at some future time, from the prisoner or from any other source is impracticable.3AIn subsections (2) and (3) above, “relevant Minister” means–athe Scottish Ministers where the transfer is to Scotland; ...aathe Department of Justice in Northern Ireland where the transfer is to Northern Ireland; andbthe Secretary of State in any other case.4The expenses mentioned in subsections (2) and (3) above shall not include—aany expenses of providing an escort for a person transferred into the United Kingdom under this Act; orbany expenses of the conveyance of such a person beyond the place at which he first arrives in the United Kingdom.5The Secretary of State shall pay any sums received by him by virtue of subsection (2) above into the Consolidated Fund.5AThe Scottish Ministers shall pay any sums received by them by virtue of subsection (2) above into the Scottish Consolidated Fund.81In this Act, except in so far as the context otherwise requires— “enactment” includes an enactment comprised in, or in an instrument under, an Act of the Scottish Parliament; ...“order” includes any sentence, direction, warrant or other means of giving effect to the decision of a court or tribunal; and“the prisoner” has the meaning given by section 1(1)(b) above; and “the relevant person” has the meaning given by section 4A(5)(b). 2In this Act a reference to criminal jurisdiction, in relation to a court or tribunal in a country or territory outside the British Islands, includes a reference to any jurisdiction which would be a criminal jurisdiction but for the age or incapacity of the persons in respect of whom it is exercised.2AIn this Act—a“international arrangements” includes any arrangements between the United Kingdom and a British overseas territory, andbreferences to a country or territory being a party to international arrangements include references to the country or territory being required to comply with provisions of a Framework Decision of the Council of the European Union (and references to international arrangements are to be construed accordingly).3In any proceedings, the certificate of the relevant Minister—athat a particular country or territory is a party to any such international arrangements as are mentioned in section 1(1)(a) or 4A(5)(a) above,bthat the appropriate authority of a country or territory which is a party to such international arrangements as are mentioned in section 1(1)(a) has agreed to the transfer of a particular person in accordance with any such arrangements, bathat the appropriate authority of a country or territory which is a party to such international arrangements as are mentioned in section 4A(5)(a) has agreed to the transfer of responsibility for the detention and release of a particular person in accordance with those arrangements, orcthat, for the purposes of any provision of this Act, a particular person is or represents the appropriate authority of any country or territory,shall be conclusive of the matter certified.4In subsection (3) above, “relevant Minister” means–athe Scottish Ministers where the proceedings relate to a transfer which they have the responsibility under this Act to make or consider making; ...aathe Department of Justice in Northern Ireland where the proceedings relate to a transfer which it has the responsibility under this Act to make or consider making; andbthe Secretary of State in any other case.8A1The Secretary of State may, by virtue of this subsection, make an agreement under section 1(1)(b) or 4A(5)(b) if—athe agreement is one that could be made by the Department of Justice in Northern Ireland by virtue of section 1(9)(aa) or 4A(10)(aa), andbthe Secretary of State’s decision to make the agreement is arrived at (wholly or partly) on the basis of protected information.2Subject to subsection (3), if the Secretary of State makes an agreement by virtue of subsection (1) in any case, in this Act references to the relevant Minister are to be read, for that case, as references to the Secretary of State (and the definitions of “relevant Minister” are to be read accordingly).3In the case of an agreement under section 4A(5)(b), subsection (2) does not apply to—athe references in sections 4A(1) and 4B(1);bthe last two references in section 4A(5);cthe second reference in section 4A(6);dthe first reference in section 4C(1);ethe reference in paragraph 9 of the Schedule.4The Secretary of State may notify the Department of Justice that no agreement is to be made under section 1(1)(b) or 4A(5)(b) in relation to a particular person without the Secretary of State’s agreement; and the Department may not make such an agreement in relation to that person without the Secretary of State’s agreement.5But the Secretary of State may give a notification or refuse his agreement only if his decision to do so is arrived at (wholly or partly) on the basis of protected information.6In this section “protected information” means information the disclosure of which may, in the opinion of the Secretary of State, be against the interests of national security.91This Act may be cited as the Repatriation of Prisoners Act 1984.2This Act shall come into force on such day as the Secretary of State may by order made by statutory instrument appoint.3 ... This Act extends to Northern Ireland.3A. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .4Her Majesty may by Order in Council make provision for extending the provisions of this Act, with such exceptions, adaptations and modifications as may be speficied in the Order, to any of the Channel Islands, to the Isle of Man or to any colony.SCHEDULEPart 11 This Part of this Schedule applies where a warrant is issued under section 1 of this Act providing for the transfer of the prisoner into the United Kingdom; and in this Part of this Schedule “the relevant provisions” means the provisions contained in the warrant by virtue of section 3(1)(c) of this Act or, in the case of a warrant which contains such a requirement as is referred to in section 4(2) of this Act, the provisions in accordance with which the prisoner continues, in pursuance of that requirement, to be detained.21In determining for the purposes of any of the enactments relating to release on licence whether the prisoner has at any time served a particular proportion or part of his sentence specified in that provision, the prisoner’s sentence shall, subject to sub-paragraph (2) below, be deemed to begin with the day on which the relevant provisions take effect.2If the warrant specifies a period to be taken into account for the purposes of this paragraph, the amount of time the prisoner has served shall, so far only as the question whether he has served a particular part of a life sentence is concerned, be deemed to be increased by that period.3. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .3A. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .3ZAThe Secretary of State may specify in the warrant that the prisoner is to be treated for the purposes of the enactments relating to release on licence as if the sentence to be served by the prisoner was imposed in respect of—aa particular offence under the law of England and Wales,bsuch an offence carried out in a certain manner or in certain circumstances, orcsuch an offence in relation to which certain findings were made by the court before which the prisoner was convicted or sentenced for the offence;and if that is done those enactments have effect accordingly.3ZBAn offence may be specified under sub-paragraph (3ZA) only if it corresponds to the offence in respect of which the prisoner is required to be detained in the country or territory from which the prisoner is transferred (“the overseas offence”).3ZCA specification under sub-paragraph (3ZA)(b) may be made only if, in the opinion of the Secretary of State, findings made by the court before which the prisoner was convicted or sentenced for the overseas offence show that the overseas offence was committed in the manner or circumstances to be specified (or in a corresponding manner or corresponding circumstances).3ZDA finding may be specified under sub-paragraph (3ZA)(c) only if, in the opinion of the Secretary of State, findings made by the court before which the prisoner was convicted or sentenced for the overseas offence show that the finding to be specified could properly have been made by a court in England and Wales dealing with the prisoner.3ZESub-paragraph (3ZA) does not result in the enactments relating to release on licence applying in a way in which they could not apply in relation to a sentence imposed in respect of the offence specified under that sub-paragraph—athat was committed at the same time as the overseas offence was committed, orbin respect of which a conviction was made, or sentence passed, at the same time as occurred in respect of the overseas offence.3ZFThe Secretary of State may amend a warrant (whether issued before or after sub-paragraph (3ZA) comes into force and whether or not the transfer it authorised has taken place) so as to specify the matters there referred to.4In this paragraph—“the enactments relating to release on licence” means section 28(5) and (7) of the Crime (Sentences) Act 1997 , Chapter 6 of Part 12 of the Criminal Justice Act 2003 and section 28 of the Offender Management Act 2007 ;“sentence”, means the provision included in the warrant which is equivalent to sentence.1In determining, for the purposes of sections 1(1) to (3), 1AB(3), 1AA, 2(2) and (7), 3AA and 7(1) of the Prisoners and Criminal Proceedings (Scotland) Act 1993 (c. 9), in their application to prisoners repatriated to Scotland (eligibility for early release from a sentence), whether the prisoner has at any time served a particular proportion or part of the sentence, the sentence shall, subject to sub-paragraph (2) below, be deemed to begin with the day on which the relevant provisions take effect.2If the warrant specifies a period to be taken into account for the purposes of section 1(3) , 2(2) or (7) or 3AA of that Act (eligibility of long-term and life prisoners as respects release on licence) , or of section 1AB(3) of that Act in the case of a long-term prisoner to whom that section applies—athe amount of time the prisoner has served; andbwhere the sentence is a determinate one, the sentence,shall, so far only as the question whether he has served any particular proportion or part of the sentence is concerned, be deemed to be increased by that period.3The question whether the prisoner is a short-term or a long-term prisoner for the purposes of any of the sections mentioned in sub-paragraph (1) above shall be determined by reference to the length of the sentence imposed in the country or territory from which he is transferred.3AIf sub-paragraph (3B) or (3C) applies by virtue of an offence in relation to which a determinate sentence is to be served, Part 1 of the Prisoners and Criminal Proceedings (Scotland) Act 1993 applies to the prisoner as if that offence was within section 1AB(2) of that Act (terrorist offences carrying restricted eligibility for release on licence).3BThis sub-paragraph applies if the warrant specifies that the offence or any of the offences in relation to which a sentence is to be served corresponds to an offence specified in Part 1 or 2 of Schedule 1A to the Prisoners and Criminal Proceedings (Scotland) Act 1993 (terrorism offences carrying restricted eligibility for release on licence).3CThis sub-paragraph applies if the warrant specifies that—athe offence or any of the offences in relation to which a sentence is to be served (“the overseas offence”) corresponds to an offence under the law of Scotland (“the corresponding offence”),bsection 31 of the Counter-Terrorism Act 2008 (sentences for offences aggravated by terrorist connection) would have been capable of applying in relation to the corresponding offence if—iit had been committed at the same time as the overseas offence, andiithe prisoner had been convicted of and sentenced for it in Scotland at the same time respectively as the conviction and sentencing for the overseas offence, andcfindings made by the court before which the prisoner was tried or sentenced for the overseas offence would, had the prisoner been tried and sentenced in Scotland for the corresponding offence, have justified its being found proved for the purposes of that section that the corresponding offence was aggravated by reason of having a terrorist connection.3DThe Scottish Ministers may amend a warrant (whether issued before or after sub-paragraph (3A) comes into force and whether or not the transfer it authorises has taken place) so as to specify the matters referred to in sub-paragraph (3B) or (3C).3EIf sub-paragraph (3F), (3G) or (3H) applies by virtue of an offence in relation to which a determinate sentence is to be served, Part 1 of the Prisoners and Criminal Proceedings (Scotland) Act 1993 applies to the prisoner as if the prisoner were serving a sentence imposed under section 205ZC of the Criminal Procedure (Scotland) Act 1995 in respect of an offence specified in Part 2 of Schedule 5ZB to that Act (sentence with a fixed licence period imposed in respect of an offence involving or connected with a threat to national security).3FThis sub-paragraph applies if the warrant specifies that the offence or any of the offences in relation to which a sentence is to be served corresponds to an offence specified in any of paragraphs 9 to 11, or paragraph 13 in a case where the listed offence is an offence specified in any of paragraphs 9 to 11, of Part 2 of Schedule 5ZB to the Criminal Procedure (Scotland) Act 1995 (certain offences under the Official Secrets Acts or the National Security Act 2023).3GThis sub-paragraph applies if the warrant specifies that—athe offence or any of the offences in relation to which a sentence is to be served (“the overseas offence”) corresponds to an offence under the law of Scotland (“the corresponding offence”),bthe overseas offence was committed on or after the day on which section 16 of the National Security Act 2023 came into force,cthe corresponding offence—iis a “relevant electoral offence” within the meaning of that section, andiiis punishable on indictment with imprisonment for more than 2 years, anddfindings made by the court before which the prisoner was tried or sentenced for the overseas offence would, had the prisoner been tried and sentenced in Scotland for the corresponding offence, have justified a determination under that section that the foreign power condition is met in relation to the conduct that constitutes the offence.3HThis sub-paragraph applies if the warrant specifies that—athe offence or any of the offences in relation to which a sentence is to be served (“the overseas offence”) corresponds to an offence under the law of Scotland (“the corresponding offence”),bthe overseas offence was committed on or after the day on which section 21 of the National Security Act 2023 came into force,cthe corresponding offence—iis not an offence mentioned in subsection (6) of that section, andiiis punishable on indictment with imprisonment for more than 2 years, anddfindings made by the court before which the prisoner was tried or sentenced for the overseas offence would, had the prisoner been tried and sentenced in Scotland for the corresponding offence, have justified a determination under that section that the foreign power condition is met in relation to the conduct that constitutes the offence.3IThe Scottish Ministers may amend a warrant (whether issued before or after sub-paragraph (3E) comes into force and whether or not the transfer it authorises has taken place) so as to specify the matters referred to in sub-paragraph (3F), (3G) or (3H).4For the purposes of Schedule 6 to the Prisoners and Criminal Proceedings (Scotland) Act 1993, a prisoner’s sentence shall be deemed to have been imposed on the day on which the relevant provisions take effect.5In this paragraph, “sentence”, except in sub-paragraph (3) above, means the provision included in the warrant which is equivalent to a sentence.2A1This paragraph applies to a prisoner repatriated to Northern Ireland.2In determining for the purposes of Chapter 4 of Part 2 of the Criminal Justice (Northern Ireland) Order 2008 whether the prisoner has at any time served a particular proportion or part of his sentence specified in that Chapter, the prisoner's sentence shall subject to sub-paragraph (3), be deemed to begin with the day on which the relevant provisions take effect.3If the warrant specifies a period to be taken into account for the purposes of this paragraph, the amount of time the prisoner has served shall, so far only as the question whether he has served a particular proportion or part of his sentence, be deemed to be increased by that period.4Where the prisoner's sentence is for a term of less than 12 months, Chapter 4 of Part 2 of the Criminal Justice (Northern Ireland) Order 2008 shall apply as if the sentence were for a term of 12 months or more.4AIf sub-paragraph (4B) or (4C) applies by virtue of an offence in relation to which a determinate sentence is to be served, Chapter 4 of Part 2 of the Criminal Justice (Northern Ireland) Order 2008 applies to the prisoner as if that offence was within Article 20A(2) (terrorist offences carrying restricted eligibility for release on licence).4BThis sub-paragraph applies if the warrant specifies that the offence or any of the offences in relation to which a sentence is to be served corresponds to an offence specified in Part 2, 4, 5 or 7 of Schedule 2A to the Criminal Justice (Northern Ireland) Order 2008 (terrorism offences carrying restricted eligibility for release on licence).4CThis sub-paragraph applies if the warrant specifies that—athe offence or any of the offences in relation to which a sentence is to be served (“the overseas offence”) corresponds to an offence under the law of Northern Ireland (“the corresponding offence”),bsection 30 of the Counter-Terrorism Act 2008 would have applied to the corresponding offence if—iit had been committed at the same time as the overseas offence, andiithe prisoner had been convicted of and sentenced for it in Northern Ireland at the same time respectively as the conviction and sentencing for the overseas offence, andcfindings made by the court before which the prisoner was tried or sentenced for the overseas offence would, had the prisoner been tried and sentenced in Northern Ireland for the corresponding offence, have justified a determination under that section that the corresponding offence had a terrorist connection.4DThe Department of Justice may amend a warrant (whether issued before or after sub-paragraph (4A) comes into force and whether or not the transfer it authorises has taken place) so as to specify the matters referred to in sub-paragraph (4B) or (4C).4EIf sub-paragraph (4F), (4G) or (4H) applies by virtue of an offence in relation to which a determinate sentence is to be served, Chapter 4 of Part 2 of the Criminal Justice (Northern Ireland) Order 2008 applies to the prisoner as if the prisoner were serving a sentence imposed under Article 15A of the Order in respect of an offence specified in Schedule 2B to the Order (sentence with a fixed licence period imposed in respect of an offence involving or connected with a threat to national security).4FThis sub-paragraph applies if the warrant specifies that the offence or any of the offences in relation to which a sentence is to be served corresponds to an offence specified in any of paragraphs 1 to 3, or paragraph 5 in a case where the ancillary offence relates to an offence specified in any of paragraphs 1 to 3, of Schedule 2B to the Criminal Justice (Northern Ireland) Order 2008 (certain offences under the Official Secrets Acts or the National Security Act 2023).4GThis sub-paragraph applies if the warrant specifies that—athe offence or any of the offences in relation to which a sentence is to be served (“the overseas offence”) corresponds to an offence under the law of Northern Ireland (“the corresponding offence”),bthe overseas offence was committed on or after the day on which section 16 of the National Security Act 2023 came into force,cthe corresponding offence—iis a “relevant electoral offence” within the meaning of that section, andiiis punishable on indictment with imprisonment for more than 2 years, anddfindings made by the court before which the prisoner was tried or sentenced for the overseas offence would, had the prisoner been tried and sentenced in Northern Ireland for Ireland (“the corresponding offence”),bthe overseas offence was committed on or after the day on which section 20 of the National Security Act 2023 came into force,cthe corresponding offence—iis not an offence mentioned in subsection (2) of that section, andiiis punishable on indictment with imprisonment for more than 2 years, anddfindings made by the court before which the prisoner was tried or sentenced for the overseas offence would, had the prisoner been tried and sentenced in Northern Ireland for the corresponding offence, have justified a determination under that section that the foreign power condition is met in relation to the conduct that constitutes the offence.4IThe Department of Justice may amend a warrant (whether issued before or after sub-paragraph (4E) comes into force and whether or not the transfer it authorises has taken place) so as to specify the matters referred to in sub-paragraph (4F), (4G) or (4H).5In this paragraph “sentence” means the provision included in the warrant which is equivalent to sentence.2B1This paragraph applies to a prisoner if—athe prisoner has been transferred to England and Wales in pursuance of a warrant under section 1,bthe prisoner is serving a sentence for an offence which corresponds to murder under the law of England and Wales, andcby virtue of that sentence the prisoner is a fixed-term prisoner for the purposes of Chapter 6 of Part 12 of the Criminal Justice Act 2003 (“the 2003 Act”).2If, apart from this sub-paragraph, section 243A of the 2003 Act (duty to release certain prisoners serving less than 12 months) would apply to the prisoner, Chapter 6 of Part 12 of that Act and the following provisions of this paragraph have effect in relation to the prisoner as if section 244 of that Act applied to the prisoner.3If section 244 of the 2003 Act (duty to release prisoners not subject to special provision for release) applies to the prisoner, Chapter 6 of Part 12 of that Act has effect in relation to the prisoner as if the requisite custodial period for the purposes of that section were—awhere the prisoner is serving one sentence, two-thirds of the sentence, andbwhere the prisoner is serving two or more concurrent or consecutive sentences, the period determined under section 263(2) and 264(2B) or (2E) of the 2003 Act.4If, apart from this sub-paragraph, the prisoner could be released on licence under section 246 of the 2003 Act, the prisoner must not be released under that section.5If—athe prisoner is recalled to prison under section 254 of the 2003 Act, andbapart from this sub-paragraph, section 255B or 255BA of that Act (automatic release) would apply to the prisoner following the prisoner’s recall,section 255C of that Act (prisoners excluded from automatic release) applies to the prisoner instead.6Section 256AZBA of the 2003 Act (referral of release decisions to High Court) has effect in relation to the prisoner as if the offence mentioned in sub-paragraph (1)(b) of this paragraph were specified in section 256AZBB(1) of that Act (specified offences for the purposes of section 256AZBA).7If section 264 of the 2003 Act (consecutive terms) applies to the prisoner, that section has effect in relation to the prisoner as if the minimum custodial period in relation to the prisoner’s sentence for the offence mentioned in sub-paragraph (1)(b) of this paragraph were two-thirds of the sentence.8Section 264B of the 2003 Act (consecutive terms: supplementary) does not apply to the prisoner.3. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .51References in—athe Mental Health Act 1983, andbthe Mental Health (Northern Ireland) Order 1986,to the date of an order under that Act or that Order shall have effect, in relation to any of the relevant provisions which is equivalent to such an order, as references to the day on which the relevant provisions take effect.2Where the relevant provisions include provision equivalent to a hospital order within the meaning of the said Act of 1983 or such an order and a restriction order within the meaning of that Act, the prisoner may (in addition to any application he may make under that Act) apply to the appropriate tribunal at any time in the period of six months beginning with the day on which the relevant provisions take effect.2AFor the purposes of sub-paragraph (2) above “the appropriate tribunal” means—athe First-tier Tribunal, in any case where the prisoner is detained in England;bthe Mental Health Review Tribunal for Wales, in any case where the prisoner is detained in Wales; andcthe Mental Health Review Tribunal for Northern Ireland, in any case where the prisoner is detained in Northern Ireland.3References howsoever expressed in—athe Mental Health (Care and Treatment) (Scotland) Act 2003, andbthe Criminal Procedure (Scotland) Act 1995,to the date of an order of the type referred to in the definition of hospital order or restriction order in section 2(6) of this Act shall have effect, in relation to any of the relevant provisions which is equivalent to such an order, as a reference to the day on which the relevant provisions take effect.4Where the relevant provisions include provisions equivalent in Scotland to such an order, the prisoner may at any time in the period of six months beginning with the day on which the relevant provisions take effect, appeal to the Sheriff to order his discharge; and (without prejudice to section 3(4) of this Act) in any appeal under this paragraph the provisions of the said Act of 1984 in respect of appeals by a patient subject to such an order apply to an appeal by the prisoner where he is subject to any such equivalent provision as they apply to a patient who is subject to such an order.6The relevant provisions shall be disregarded for the purposes of the application, in relation to any offence of which the prisoner was convicted in a country or territory outside the British Islands, of—athe Rehabilitation of Offenders Act 1974, except section 1(2) (person not rehabilitated unless he serves sentence etc.); andbthe Rehabilitation of Offenders (Northern Ireland) Order 1978, except Article 3(2) (person not rehabilitated unless he serves sentence etc.).7For the purposes of section 1 of the Representation of the People Act 1981 (disqualification of certain offenders for membership of the House of Commons), the prisoner shall, while detained in accordance with the relevant provisions, be deemed to be detained in pursuance of the order in pursuance of which, at the time of his transfer into the United Kingdom, he was required to be detained in the country or territory from which he was transferred.8Where the relevant provisions include provision equivalent to such a sentence as is mentioned in paragraph (2) of Article 63 of the Firearms (Northern Ireland) Order 2004 (possession of firearm by person previously convicted of crime), that paragraph shall apply in relation to the prisoner as if for the reference in that paragraph to the period of eight years from the date so mentioned there were substituted a reference to the period of eight years from the day on which the relevant provisions take effect.Part 29This Part of this Schedule applies where a warrant is issued under section 4A providing for the transfer of responsibility for the detention and release of the relevant person to the relevant Minister (within the meaning of that section).10Paragraphs 2 to 8 above apply as they apply where a warrant is issued under section 1, but with the following modifications.11Any reference to “the relevant provisions” is to be read as a reference to the provisions contained in the warrant by virtue of section 4C(1)(b).121Any reference to the prisoner is to be read as a reference to the relevant person.2Sub-paragraph (1) does not apply to the words “a short-term or long-term prisoner” in paragraph 2(3) (as it applies in Scotland to repatriated prisoners any of whose sentences were imposed on or after 1 October 1993).13In paragraph 2 (as it applies in Scotland to repatriated prisoners any of whose sentences were imposed on or after 1 October 1993) the reference to prisoners repatriated to Scotland is to be read as a reference to any relevant person—ain whose case the warrant under section 4A transfers responsibility for
