Subject to—
(a)
the provisions of the M1Coast Protection Act 1949, the M2Town and Country Planning (Scotland) Acts 1972 to 1974 and the Dumping at Sea Act 1974;
(b)
the functions of statutory undertakers and port authorities; and
(c)
any public rights of way
