Subject to subsection (2) below, the provisions of this Part apply in relation to persons employed by or under the Crown as they apply in relation to persons employed otherwise than by or under the Crown.

The provisions of this Part do not apply in relation to persons serving as members of Her Majesty's forces, in their capacity as such.
