11 Provisions as to offences.
(1)
A local authority may institute proceedings for an offence under this Act or any regulations made under it.
(2)
Where any such offence committed by a body corporate is proved to have been committed with the consent or connivance of or to be attributable to any neglect on the part of any director, manager, secretary or other similar officer of the body corporate, or any person who was purporting to act in any such capacity, he as well as the body corporate shall be guilty of the offence and shall be liable to be proceeded against and punished accordingly.
(3)
Where a person is charged with an offence under section 2(2) or 4(3) above or under regulations made under section 8 above, it shall be a defence to prove that he took all reasonable precautions and exercised all due diligence to avoid the commission of the offence by himself or any person under his control.
