(Scotland) Act 1980(<noteRef href="#c738434" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Repealed 1.4.1996)</docTitle></block><block name="number"><docNumber>1980 CHAPTER 4</docNumber></block><longTitle><p/></longTitle><block name="dateOfEnactment" refersTo="#date-enacted"/></preface><body eId="body"><section eId="section-1"><num>1</num><heading> Release on conditions.</heading><subsection eId="section-1-1"><num>(1)</num><intro><p>After the commencement of this Act, it shall not be lawful to grant bail or release for a pledge or deposit of money, and—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><content><p>release on bail may be granted only on conditions which, subject to subsection (3) below, shall not include a pledge or deposit of money;</p></content></level><level class="para1" eId="section-1-1-b"><num>(b)</num><content><p>liberation may be granted by the police under section 18, 294, 295 or 296 of the 1975 Act as amended by sections 7 to 9 of this Act.</p></content></level></subsection><subsection eId="section-1-2"><num><ins class="first" ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435"><noteRef uk:name="commentary" href="#c738435" class="commentary"/>(2)</ins></num><intro><p><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">In granting bail the court or, as the case may be, the Lord Advocate shall impose on the accused—</ins></p></intro><level class="para1" eId="section-1-2-a"><num><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">(a)</ins></num><content><p><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">the standard conditions; and</ins></p></content></level><level class="para1" eId="section-1-2-b"><num><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">(b)</ins></num><intro><p><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">such further conditions as the court or, as the case may be, the Lord Advocate considers necessary to secure—</ins></p></intro><level class="para2" eId="section-1-2-b-i"><num><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">(i)</ins></num><content><p><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">that the standard conditions are observed; and</ins></p></content></level><level class="para2" eId="section-1-2-b-ii"><num><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">(ii)</ins></num><content><p><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">that the accused makes himself available for the purpose of participating in an identification parade or of enabling any print, impression or sample to be taken from him.</ins></p></content></level></level></subsection><subsection eId="section-1-2A"><num><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">(2A)</ins></num><intro><p><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">The standard conditions referred to in subsection (2) above are conditions that the accused—</ins></p></intro><level class="para1" eId="section-1-2A-a"><num><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">(a)</ins></num><content><p><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">appears at the appointed time at every diet relating to the offence with which he is charged of which he is given due notice;</ins></p></content></level><level class="para1" eId="section-1-2A-b"><num><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">(b)</ins></num><content><p><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">does not commit an offence while on bail;</ins></p></content></level><level class="para1" eId="section-1-2A-c"><num><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">(c)</ins></num><content><p><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">does not interfere with witnesses or otherwise obstruct the course of justice whether in relation to himself or any other person; and</ins></p></content></level><level class="para1" eId="section-1-2A-d"><num><ins ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">(d)</ins></num><content><p><ins class="last" ukl:ChangeId="d30p269" ukl:CommentaryRef="c738435">makes himself available for the purpose of enabling enquiries or a report to be made to assist the court in dealing with him for the offence with which he is charged.</ins></p></content></level></subsection><subsection eId="section-1-3"><num>(3)</num><content><p>The court or, as the case may be, the Lord Advocate may impose as one of the conditions of release on bail a requirement that the accused or a cautioner on his behalf deposits a sum of money in court, but only where the court or, as the case may be, the Lord Advocate is satisfied that the imposition of such condition is appropriate to the special circumstances of the case.</p></content></subsection><subsection eId="section-1-4"><num>(4)</num><intro><p>In any enactment, including the following provisions of this Act and any enactment passed after this Act—</p></intro><level class="para1" eId="section-1-4-a"><num>(a)</num><content><p>any reference to bail shall be construed as a reference to release on conditions in accordance with this Act or to conditions imposed on bail, as the context requires;</p></content></level><level class="para1" eId="section-1-4-b"><num>(b)</num><content><p>any reference to an amount of bail fixed shall be construed as a reference to conditions, including a sum required to be deposited under subsection (3) above;</p></content></level><level class="para1" eId="section-1-4-c"><num>(c)</num><content><p>any reference to finding bail or finding sufficient bail shall be construed as a reference to acceptance of conditions imposed or the finding of a sum required to be deposited under subsection (3) above.</p></content></level></subsection><subsection eId="section-1-5"><num>(5)</num><content><p>In this section and sections 2 to 4 of this Act, references to an accused and to appearance at a diet shall include references respectively to an appellant and to appearance at the court on the day fixed for the hearing of an appeal.</p></content></subsection></section><section eId="section-2"><num>2</num><heading> Provisions supplementary to s. 1.</heading><subsection eId="section-2-1"><num>(1)</num><intro><p>The court shall specify in the order granting bail, a copy of which shall be given to the accused—</p></intro><level class="para1" eId="section-2-1-a"><num>(a)</num><content><p>the conditions imposed; and</p></content></level><level class="para1" eId="section-2-1-b"><num>(b)</num><content><p>an address, within the United Kingdom (being the accused’s normal place of residence or such other place as the court may, on cause shown, direct) which, subject to subsection (2) below, shall be his proper domicile of citation.</p></content></level></subsection><subsection eId="section-2-2"><num>(2)</num><content><p>The court may on application in writing by the accused while he is on bail alter the address specified in the order granting bail, and this new address shall, as from such date as the court may direct, become his proper domicile of citation; and the court shall notify the accused of its decision on any application under this subsection.</p></content></subsection><subsection eId="section-2-3"><num>(3)</num><content><p>In this section “<term refersTo="#term-proper-domicile-of-citation" eId="term-proper-domicile-of-citation">proper domicile of citation</term>” means the address at which the accused may be cited to appear at any diet relating to the offence with which he is charged or an offence charged in the same proceedings as that offence or to which any other intimation or document may be sent; and any citation at or the sending of an intimation or document to the proper domicile of citation shall be presumed to have been duly carried out.</p></content></subsection></section><section eId="section-3"><num>3</num><heading> Breach of conditions.</heading><subsection eId="section-3-1"><num>(1)</num><intro><p>Subject to subsection (3) below, an accused who having been granted bail fails without reasonable excuse—</p></intro><level class="para1" eId="section-3-1-a"><num>(a)</num><content><p>to appear at the time and place appointed for any diet of which he has been given due notice; or</p></content></level><level class="para1" eId="section-3-1-b"><num>(b)</num><content><p>to comply with any other condition imposed on bail;</p></content></level><wrapUp><p>shall <ins class="first last" ukl:ChangeId="d30p607" ukl:CommentaryRef="c738436"><noteRef uk:name="commentary" href="#c738436" class="commentary"/>, subject to subsection (2A) below,</ins>be guilty of an offence and liable on conviction to the penalties specified in subsection (2) below.</p></wrapUp></subsection><subsection eId="section-3-2"><num>(2)</num><intro><p>The penalties mentioned in subsection (1) above are—</p></intro><level class="para1" eId="section-3-2-a"><num>(a)</num><content><p>a fine not exceeding <ins class="first last" ukl:ChangeId="d30p623" ukl:CommentaryRef="c738437"><noteRef uk:name="commentary" href="#c738437" class="commentary"/>level 3 on the standard scale</ins>; and</p></content></level><level class="para1" eId="section-3-2-b"><num>(b)</num><intro><p>imprisonment for a period—</p></intro><level class="para2" eId="section-3-2-b-i"><num>(i)</num><content><p>where conviction is in the district court, not exceeding 60 days; or</p></content></level><level class="para2" eId="section-3-2-b-ii"><num>(ii)</num><content><p>where conviction is in the sheriff court or in the High Court, not exceeding 3 months.</p></content></level></level></subsection><subsection eId="section-3-2A"><num><ins class="first" ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438"><noteRef uk:name="commentary" href="#c738438" class="commentary"/>(2A)</ins></num><intro><p><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">Where, and to the extent that, the failure referred to in subsection (1)(b) above consists in the accused having committed an offence while on bail (in this section referred to as “the subsequent offence”), he shall not be guilty of an offence under that subsection but, subject to subsection (2B) below, the court which sentences him for the subsequent offence shall, in determining the appropriate sentence or disposal for that offence, have regard to—</ins></p></intro><level class="para1" eId="section-3-2A-a"><num><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">(a)</ins></num><content><p><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">the fact that the offence was committed by him while on bail and the number of bail orders to which he was subject when the offence was committed;</ins></p></content></level><level class="para1" eId="section-3-2A-b"><num><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">(b)</ins></num><content><p><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">any previous conviction of the accused of an offence under subsection (1)(b) above; and</ins></p></content></level><level class="para1" eId="section-3-2A-c"><num><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">(c)</ins></num><content><p><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">the extent to which the sentence or disposal in respect of any previous conviction of the accused differed, by virtue of this subsection, from that which the court would have imposed but for this subsection.</ins></p></content></level></subsection><subsection eId="section-3-2B"><num><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">(2B)</ins></num><content><p><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">The court shall not, under subsection (2A) above, have regard to the fact that the subsequent offence was committed while the accused was on bail unless that fact is libelled in the indictment or, as the case may be, specified in the complaint.</ins></p></content></subsection><subsection eId="section-3-2C"><num><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">(2C)</ins></num><intro><p><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">Where the maximum penalty in respect of the subsequent offence is specified by or by virtue of any enactment, that maximum penalty shall, for the purposes of the court’s determination, by virtue of subsection (2A) above, of the appropriate sentence or disposal in respect of that offence, be increased—</ins></p></intro><level class="para1" eId="section-3-2C-a"><num><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">(a)</ins></num><content><p><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">where it is a fine, by the amount for the time being equivalent to level 3 on the standard scale; and</ins></p></content></level><level class="para1" eId="section-3-2C-b"><num><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">(b)</ins></num><intro><p><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">where it is a period of imprisonment—</ins></p></intro><level class="para2" eId="section-3-2C-b-i"><num><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">(i)</ins></num><content><p><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">as respects a conviction in the High Court or the sheriff court, by 6 months; and</ins></p></content></level><level class="para2" eId="section-3-2C-b-ii"><num><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">(ii)</ins></num><content><p><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">as respects a conviction in the district court, by 60 days,</ins></p></content></level><wrapUp><p><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">notwithstanding that the maximum penalty as so increased exceeds the penalty which it would otherwise be competent for the court to impose.</ins></p></wrapUp></level></subsection><subsection eId="section-3-2D"><num><ins ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">(2D)</ins></num><content><p><ins class="last" ukl:ChangeId="d30p645" ukl:CommentaryRef="c738438">Where the sentence or disposal in respect of the subsequent offence is, by virtue of subsection (2A) above, different from that which the court would have imposed but for that subsection, the court shall state the extent of and the reasons for that difference.</ins></p></content></subsection><subsection eId="section-3-3"><num>(3)</num><intro><p>An accused who having been granted bail in relation to solemn proceedings fails without reasonable excuse to appear at the time and place appointed for any diet of which he has been given due notice (where such diet is in respect of solemn proceedings) shall be guilty of an offence and liable on conviction on indictment to the following penalties—</p></intro><level class="para1" eId="section-3-3-a"><num>(a)</num><content><p>a fine; and</p></content></level><level class="para1" eId="section-3-3-b"><num>(b)</num><content><p>imprisonment for a period not exceeding 2 years.</p></content></level></subsection><subsection eId="section-3-4"><num>(4)</num><intro><p>At any time before the trial of an accused under solemn procedure for the original offence, it shall be competent—</p></intro><level class="para1" eId="section-3-4-a"><num>(a)</num><content><p>to amend the indictment to include an additional charge of an offence under this section;</p></content></level><level class="para1" eId="section-3-4-b"><num>(b)</num><content><p>to include in the list of witnesses or productions relating to the original offence, witnesses or productions relating to the offence under this section.</p></content></level></subsection><subsection eId="section-3-5"><num>(5)</num><content><p>The penalties provided for in subsection (2) above may be imposed in addition to any other penalty which it is competent for the court to impose, notwithstanding that the total of penalties imposed may exceed the maximum penalty which it is competent to impose in respect of the original offence.</p></content></subsection><subsection eId="section-3-6"><num>(6)</num><content><p>A court which finds an accused guilty of an offence under this section may remit the accused for sentence in respect of that offence to any court which is considering the original offence.</p></content></subsection><subsection eId="section-3-7"><num>(7)</num><content><p>A constable may arrest without warrant an accused who has been released on bail where the constable has reasonable grounds for suspecting that the accused has broken, is breaking, or is likely to break any condition imposed on his bail.</p></content></subsection><subsection eId="section-3-8"><num>(8)</num><content><p>An accused who is arrested under this section shall wherever practicable be brought before the court to which his application for bail was first made not later than in the course of the first day after his arrest, such day not being a Saturday, a Sunday or a court holiday prescribed for that court under section 10 of this Act:</p><blockContainer ukl:Name="BlockText"><p>Provided that nothing in this subsection shall prevent such person being brought before a court on a Saturday, a Sunday or such a court holiday where the court is, in pursuance of the said section 10, sitting on such day for the disposal of criminal business.</p></blockContainer></content></subsection><subsection eId="section-3-9"><num>(9)</num><intro><p>Where an accused is brought before a court under subsection (8) above, the court, after hearing the parties, may—</p></intro><level class="para1" eId="section-3-9-a"><num>(a)</num><content><p>recall the order granting bail;</p></content></level><level class="para1" eId="section-3-9-b"><num>(b)</num><content><p>release the accused under the original order granting bail; or</p></content></level><level class="para1" eId="section-3-9-c"><num>(c)</num><content><p>vary the order granting bail so as to contain such conditions as the court thinks it necessary to impose to secure that the accused complies with the requirements of paragraphs (a) to (d) of section 1(2) of this Act.</p></content></level></subsection><subsection eId="section-3-10"><num>(10)</num><content><p>The same rights of appeal shall be available against any decision of the court under subsection (9) above as were available against the original order of the court relating to bail.</p></content></subsection><subsection eId="section-3-11"><num>(11)</num><content><p>For the purposes of this section, an extract from the minute of proceedings, containing the order granting bail and bearing to be signed by the clerk of court, shall be sufficient evidence of the making of that order and of its terms and of the acceptance by the accused of the conditions imposed under section 1 of this Act.</p></content></subsection><subsection eId="section-3-12"><num>(12)</num><content><p>In this section “<term refersTo="#term-the-original-offence" eId="term-the-original-offence">the original offence</term>” means the offence with which the accused was charged when he was granted bail or an offence charged in the same proceedings as that offence.</p></content></subsection></section><section eId="section-4"><num>4</num><heading> Provisions relating to monetary conditions.</heading><subsection eId="section-4-1"><num>(1)</num><intro><p>Without prejudice to section 3 of this Act, where the accused or a cautioner on his behalf has deposited a sum of money in court under section 1(3) of this Act, then—</p></intro><level class="para1" eId="section-4-1-a"><num>(a)</num><content><p>if the accused fails to appear at the time and place appointed for any diet of which he has been given due notice, the court may, on the motion of the prosecutor, immediately order forfeiture of the sum deposited:</p><p>Provided that the court, if it is satisfied that it is reasonable in all the circumstances to do so, may recall the order and direct that the money forfeited shall be refunded, and any decision of the court under this proviso shall be final and not subject to review;</p></content></level><level class="para1" eId="section-4-1-b"><num>(b)</num><content><p>if the accused fails to comply with any other condition imposed on bail, the court may, on conviction of an offence under section 3(1)(b) of this Act and on the motion of the prosecutor, order forfeiture of the sum deposited.</p></content></level></subsection><subsection eId="section-4-2"><num>(2)</num><intro><p>A cautioner, who has deposited a sum of money in court under section 1(3) of this Act, shall be entitled to recover the sum deposited at any diet of the court at which the accused appears personally:</p><blockContainer ukl:Name="BlockText"><p>Provided that, where the accused has been charged with an offence under section 3(1)(b) of this Act, nothing in this subsection shall entitle a cautioner to recover the sum deposited unless and until—</p></blockContainer></intro><level class="para1" eId="section-4-2-a"><num>(a)</num><content><p>the charge is not proceeded with; or</p></content></level><level class="para1" eId="section-4-2-b"><num>(b)</num><content><p>the accused is acquitted of the charge; or</p></content></level><level class="para1" eId="section-4-2-c"><num>(c)</num><content><p>on the accused’s conviction of the offence, the court has determined not to order forfeiture of the sum deposited.</p></content></level></subsection><subsection eId="section-4-3"><num>(3)</num><content><p>The references in subsection (1)(b) above and in paragraph (c) of the proviso to subsection (2) above to conviction of an offence shall include references to the making of an order in respect of the offence under section 383 (absolute discharge) or 384 (probation) of the 1975 Act.</p></content></subsection></section><section eId="section-5"><num>5</num><heading> Bail on adjournment before sentence. </heading><intro><p>In each of sections 179 and 380 of the 1975 Act (power of court to adjourn case before sentence)—</p></intro><level class="para1" eId="section-5-a"><num>(a)</num><content><p><mod>there shall be inserted before the proviso the words—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><p>and where the court so adjourns the case it shall remand the accused in custody or on bail</p></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="section-5-b"><num>(b)</num><content><p><mod>at the end there shall be added the following subsection—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(2)</num><intro><p>An accused who is remanded under this section may appeal against the refusal of bail or against the conditions imposed within 24 hours of his remand, by note of appeal presented to the High Court, and the High Court, either in court or in chambers, may, after hearing parties—</p></intro><level class="para1"><num>(a)</num><content><p>review the order and grant bail on such conditions as it thinks fit; or</p></content></level><level class="para1"><num>(b)</num><content><p>confirm the order.</p></content></level></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></section><section eId="section-6"><num>6</num><heading> Remand or inquiry into physical or mental condition. </heading><intro><p>In each of sections 180 and 381 of the 1975 Act (remand for inquiry into physical or mental condition)—</p></intro><level class="para1" eId="section-6-a"><num>(a)</num><content><p>in subsection (2), the words “bail shall be found by bail bond, and”, and subsection (3) shall cease to have effect;</p></content></level><level class="para1" eId="section-6-b"><num>(b)</num><content><p><mod>at the end there shall be added the following subsection—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(5)</num><intro><p>A person remanded under this section may appeal against the refusal of bail or against the conditions imposed within 24 hours of his remand, by note of appeal presented to the High Court, and the High Court, either in court or in chambers, may after hearing parties—</p></intro><level class="para1"><num>(a)</num><content><p>review the order and grant bail on such conditions as it thinks fit; or</p></content></level><level class="para1"><num>(b)</num><content><p>confirm the order.</p></content></level></subsection></quotedStructure></mod></p></content></level></section><section eId="section-7"><num>7</num><heading> Interim liberation by constable of person charged with offence against a person under 17 years. </heading><subsection eId="section-7-1"><num>(1)</num><content><p><mod>In section 18 of the 1975 Act (power of constables to take offenders into custody), for subsection (2) there shall be substituted the following subsections—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(2)</num><intro><p>Where a person has been arrested under this section, the officer in charge of a police station may—</p></intro><level class="para1"><num>(a)</num><content><p>liberate him upon a written undertaking, signed by him and certified by the said officer, in terms of which that person undertakes to appear at a specified court at a specified time; or</p></content></level><level class="para1"><num>(b)</num><content><p>liberate him without any such undertaking; or</p></content></level><level class="para1"><num>(c)</num><content><p>refuse to liberate him; and such refusal and the detention of that person until his case is tried in the usual form shall not subject the officer to any claim whatsoever.</p></content></level></subsection><subsection><num>(3)</num><intro><p>A person in breach of an undertaking given by him under subsection (2)(<i>a</i>) above without reasonable excuse shall be guilty of an offence and liable to the following penalties—</p></intro><level class="para1"><num>(a)</num><content><p>a fine not exceeding £200; and</p></content></level><level class="para1"><num>(b)</num><content><p>imprisonment for a period not exceeding 3 months.</p></content></level></subsection><subsection><num>(4)</num><content><p>The penalties provided for in subsection (3) above may be imposed in addition to any other penalty which it is competent for the court to impose, notwithstanding that the total of penalties imposed may exceed the maximum penalty which it is competent to impose in respect of the original offence.</p></content></subsection><subsection><num>(5)</num><content><p>In any proceedings relating to an offence under this section, a writing, purporting to be such an undertaking as is mentioned in subsection (2)(<i>a</i>) above and bearing to be signed and certified, shall be sufficient evidence of the terms of the undertaking given by the arrested person.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection><subsection eId="section-7-2"><num>(2)</num><content><p><mod>In section 294 of the 1975 Act (power of constables to take offenders into custody), for subsection (2) there shall be substituted the following subsections—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(2)</num><intro><p>Where a person has been arrested under this section, the officer in charge of a police station may—</p></intro><level class="para1"><num>(a)</num><content><p>liberate him upon a written undertaking, signed by him and certified by the said officer, in terms of which that person undertakes to appear at a specified court at a specified time; or</p></content></level><level class="para2"><num>(ii)</num><content><p>where conviction is in the sheriff court, not exceeding 3 months.</p></content></level></level></subsection><subsection><num>(4)</num><content><p>The penalties provided for in subsection (3) above may be imposed in addition to any other penalty which it is competent for the court to impose, notwithstanding that the total of penalties imposed may exceed the maximum penalty which it is competent to impose in respect of the original offence.</p></content></subsection><subsection><num>(5)</num><content><p>In any proceedings relating to an offence under this section, a writing, purporting to be such an undertaking as is mentioned in subsection (2)(<i>a</i>) above and bearing to be signed and certified, shall be sufficient evidence of the terms of the undertaking given by the arrested person.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection></section><section eId="section-8"><num>8</num><heading> Interim liberation by officer in charge of police station. </heading><content><p><mod>For section 295 of the 1975 Act (chief constable may in certain circumstances accept bail) there shall be substituted the following section—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><section><num>295</num><heading> Interim liberation by officer in charge of police station.</heading><subsection><num>(1)</num><intro><p>Where a person has been arrested and charged with an offence which may be tried summarily, the officer in charge of a police station may—</p></intro><level class="para1"><num>(a)</num><content><p>liberate him upon a written undertaking, signed by him and certified by the said officer, in terms of which that person undertakes to appear at a specified court at a specified time; or</p></content></level><level class="para1"><num>(b)</num><content><p>liberate him without any such undertaking; or</p></content></level><level class="para1"><num>(c)</num><content><p>refuse to liberate him, and such refusal and the detention of that person until his case is tried in the usual form shall not subject the officer to any claim whatsoever.</p></content></level></subsection><subsection><num>(2)</num><intro><p>A person in breach of an undertaking given by him under subsection (1) above without reasonable excuse shall be guilty of an offence and liable on summary conviction to the following penalties—</p></intro><level class="para1"><num>(a)</num><content><p>a fine not exceeding £200; and</p></content></level><level class="para1"><num>(b)</num><intro><p>imprisonment for a period—</p></intro><level class="para2"><num>(i)</num><content><p>where conviction is in the district court, not exceeding 60 days; or</p></content></level><level class="para2"><num>(ii)</num><content><p>where conviction is in the sheriff court, not exceeding 3 months.</p></content></level></level></subsection><subsection><num>(3)</num><content><p>Subsections (4) and (5) of section 294 of this Act shall, subject to any necessary modifications, apply for the purposes of this section as they apply for the purposes of that section.</p></content></subsection></section></quotedStructure><inline name="appendText">.</inline></mod></p></content></section><section eId="section-9"><num>9</num><heading> Police liberation or detention of children arrested. </heading><intro><p>In section 296 of the 1975 Act (police liberation or detention of children arrested)—</p></intro><level class="para1" eId="section-9-a"><num>(a)</num><content><p><mod>in subsection (1), for the word “obligation” there shall be substituted the word <quotedText>“
              undertaking
            ”</quotedText> and for the words from “or on bail” to “unless” there shall be substituted <quotedText>“
              ; and such undertaking shall be in writing, signed by the child or the parent or guardian as the case may be, and certified by the said officer; and the said officer shall so liberate the child unless—
            ”</quotedText>;</mod></p></content></level><level class="para1" eId="section-9-b"><num>(b)</num><content><p><mod>at the end there shall be added the following subsections—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(5)</num><content><p>Any person, who without reasonable excuse is in breach of an undertaking entered into by him under subsection (1) above after having been given due notice of the time and place of the diet (including any continuation of the diet), shall be guilty of an offence, and liable on summary conviction in addition to any other penalty which it is competent for the court to impose on him, to a fine not exceeding £200.</p></content></subsection><subsection><num>(6)</num><content><p>In any proceedings relating to an offence under this section, a writing, purporting to be such an undertaking as is mentioned in subsection (1) above and bearing to be signed and certified, shall be sufficient evidence of the undertaking given by the accused.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></section><section eId="section-10"><num>10</num><heading> Sittings of sheriff and district courts.</heading><subsection eId="section-10-1"><num>(1)</num><intro><p>Notwithstanding any enactment or rule of law, a sheriff court or a district court—</p></intro><level class="para1" eId="section-10-1-a"><num>(a)</num><content><p>shall not be required to sit on any Saturday or Sunday or on a day which by virtue of subsection (2) or (3) below is a court holiday; but</p></content></level><level class="para1" eId="section-10-1-b"><num>(b)</num><content><p>may sit on any day for the disposal of criminal business.</p></content></level></subsection><subsection eId="section-10-2"><num>(2)</num><content><p>A sheriff principal may in an order made under section 17(1)(b) of the <noteRef href="#c738449" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Sheriff Courts (Scotland) Act 1971 prescribe in respect of criminal business not more than 10 days (other than Saturdays and Sundays) in a calendar year as court holidays in the sheriff courts within his jurisdiction <ins class="first" ukl:ChangeId="d30p1365" ukl:CommentaryRef="c738450"><noteRef uk:name="commentary" href="#c738450" class="commentary"/>; and may in the like manner prescribe as an additional court holiday any day which has been proclaimed, under section 1(3) of the Banking and Financial Dealings Act </ins><ins class="last" ukl:ChangeId="d30p1365" ukl:CommentaryRef="c738450"><noteRef href="#c738451" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>1971, to be a bank holiday either throughout the United Kingdom or in a place or locality in the United Kingdom within his jurisdiction.</ins></p></content></subsection><subsection eId="section-10-3"><num>(3)</num><content><p>Notwithstanding section 2(1) of the <noteRef href="#c738452" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>District Courts (Scotland) Act 1975, a sheriff principal may, after consultation with the appropriate <ins class="first last" ukl:ChangeId="d30p1378" ukl:CommentaryRef="c738453"><noteRef uk:name="commentary" href="#c738453" class="commentary"/>local authority</ins>, prescribe not more than 10 days (other than Saturdays and Sundays) in a calendar year as court holidays in the district courts within his jurisdiction <ins class="first last" ukl:ChangeId="d30p1382" ukl:CommentaryRef="c738454"><noteRef uk:name="commentary" href="#c738454" class="commentary"/>; and he may, after such consultation, prescribe as an additional court holiday any day which has been proclaimed, under section 1(3) of the said Banking and Financial Dealings Act 1971, to be a bank holiday either throughout the United Kingdom or in a place or locality in the United Kingdom within his jurisdiction.</ins></p></content></subsection><subsection eId="section-10-4"><num>(4)</num><content><p>A sheriff principal may in pursuance of subsection (2) or (3) above prescribe different days as court holidays in relation to different sheriff or district courts.</p></content></subsection></section><section eId="section-11"><num>11</num><heading> Interpretation.</heading><subsection eId="section-11-1"><num>(1)</num><intro><p>In this Act—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-the1975-act" eId="term-the1975-act">the1975 Act</term>” means the Criminal Procedure (Scotland) Act 1975;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-constable" eId="term-constable">constable</term>” means a constable within the meaning of the <noteRef href="#c738456" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>Police (Scotland) Act 1967 acting in the course of his duties;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-diet" eId="term-diet">diet</term>” includes any continuation of a diet.</p></content></hcontainer></subsection><subsection eId="section-11-2"><num>(2)</num><content><p>Except where the context otherwise requires, expressions used in this Act and in the 1975 Act shall have the same meanings in this Act as in that Act.</p></content></subsection></section><section eId="section-12"><num>12</num><heading> Transitional provision, consequential amendments and repeals.</heading><subsection eId="section-12-1"><num>(1)</num><content><p>A provision contained in any of sections 1 to 9 of this Act, and any related amendment or repeal provided for in Schedule 1 or 2 to this Act, shall not apply in relation to bail granted or release authorised before the coming into force of that provision.</p></content></subsection><subsection eId="section-12-2"><num>(2)</num><content><p>The enactments specified in Schedule 1 to this Act shall have effect subject to the amendments there specified, being amendments consequential on the provisions of this Act.</p></content></subsection><subsection eId="section-12-3"><num>(3)</num><content><p>The enactments specified in Schedule 2 to this Act are hereby repealed to the extent specified in the third column of that Schedule.</p></content></subsection></section><section eId="section-13"><num>13</num><heading> Short title, commencement and extent.</heading><subsection eId="section-13-1"><num>(1)</num><content><p>This Act may be cited as the Bail <abbr title="et cetera" xml:lang="la">etc.</abbr>(Scotland) Act 1980.</p></content></subsection><subsection eId="section-13-2"><num>(2)</num><content><p>This Act (except this section) shall come into force on such day as the Secretary of State may appoint by order made by statutory instrument.</p></content></subsection><subsection eId="section-13-3"><num>(3)</num><content><p>Any order under subsection (2) above may make such transitional provision as appears to the Secretary of State to be expedient in connection with the provisions thereby brought into force.</p></content></subsection><subsection eId="section-13-4"><num>(4)</num><content><p>This Act extends to Scotland only.</p></content></subsection></section><hcontainer name="schedules" eId="schedules"><heading> SCHEDULES</heading><hcontainer name="schedule" eId="schedule-1"><num>SCHEDULE 1<authorialNote class="referenceNote"><p>Section 12(2)</p></authorialNote></num><heading> Consequential Amendments</heading><hcontainer name="crossheading" ukl:Name="Pblock" eId="schedule-1-crossheading-the-licensing-scotland-act-1903-c-25"><heading> The Licensing (Scotland) Act 1903 (c. 25)</heading><hcontainer name="subheading" class="schGroup7" eId="d24e1131"><heading/><paragraph eId="schedule-1-paragraph-1" class="schProv1"><num>1</num><intro><p>In section 70(1)
