or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/1/b" id="section-16-1-b"><Pnumber>b</Pnumber><P3para><Text>for the use of any land associated with that monument for any of those purposes.</Text></P3para></P3></P2para></P2><BlockText><Para><Text><Addition ChangeId="d29p1722" CommentaryRef="c250890">Where the land in question is situated in England, the Secretary of State shall consult with the Commission before entering into the agreement or making the compulsory purchase order (as the case may be).</Addition></Text></Para></BlockText><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/1A" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/1A" id="section-16-1A"><Pnumber><Addition ChangeId="d29p1728" CommentaryRef="c250891">1A</Addition></Pnumber><P2para><Text><Addition ChangeId="d29p1728" CommentaryRef="c250891">The Commission may by agreement acquire over land adjoining or in the vicinity of any monument which is under their ownership by virtue of this Act, any such easement as the Secretary of State may acquire by virtue of subsection (1) above.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/2" id="section-16-2"><Pnumber>2</Pnumber><P2para><Text>A local authority may by agreement acquire over land adjoining or in the vicinity of any monument which is under their ownership by virtue of this Act any such easement as the Secretary of State may acquire by virtue of subsection (1) above.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/3" id="section-16-3"><Pnumber>3</Pnumber><P2para><Text>The power of acquiring an easement under subsection (1) <Addition ChangeId="d29p1748" CommentaryRef="c250892">or (1A)</Addition> or (2) above shall include power to acquire any such easement by the grant of a new right.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/4" id="section-16-4"><Pnumber>4</Pnumber><P2para><Text>The Secretary of State <Addition ChangeId="d29p1758" CommentaryRef="c250893">or the Commission</Addition> or any local authority may acquire, for the benefit of any monument or land under his or their guardianship by virtue of this Act, a right of any description which he or they would be authorised to acquire under any of the preceding provisions of this section if the monument or land was under his or their ownership by virtue of this Act, and those provisions shall apply accordingly in any such case.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/5" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/5" id="section-16-5"><Pnumber>5</Pnumber><P2para><Text>Any right to which subsection (4) above applies—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/5/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/5/a" id="section-16-5-a"><Pnumber>a</Pnumber><P3para><Text>shall be treated for the purposes of its acquisition under this section and in all other respects as if it were a legal easement; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/5/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/5/b" id="section-16-5-b"><Pnumber>b</Pnumber><P3para><Text>may be enforced by the guardians for the time being of the monument or land for whose benefit it was acquired as if they were the absolute owner in possession of that monument or land.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/6" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/6" id="section-16-6"><Pnumber>6</Pnumber><P2para><Text>Any right to which subsection (4) above applies which is acquired by agreement under this section for a purpose relating to any monument under guardianship, or for the use of any land associated with any such monument for any purpose relating to that monument—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/6/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/6/a" id="section-16-6-a"><Pnumber>a</Pnumber><P3para><Text>subject to any provision to the contrary in the agreement under which it was acquired, may be revoked by the grantor; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/6/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/6/b" id="section-16-6-b"><Pnumber>b</Pnumber><P3para><Text>may be revoked by any successor in title of the grantor as respects any of the land over which it is exercisable in which he has an interest;</Text></P3para></P3><Text>if the monument ceases to be under guardianship otherwise than by virtue of being acquired by its guardians or ceases to exist.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/7" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/7" id="section-16-7"><Pnumber>7</Pnumber><P2para><Text>References above in this section to an easement or (as the case may be) to a legal easement shall be construed in relation to land in Scotland as references to a servitude.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/8" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/8" id="section-16-8"><Pnumber>8</Pnumber><P2para><Text>Any right to which subsection (4) above applies—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/8/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/8/a" id="section-16-8-a"><Pnumber>a</Pnumber><P3para><Text>shall be a local land charge, if it relates to land in England and Wales; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/8/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/8/b" id="section-16-8-b"><Pnumber>b</Pnumber><P3para><Text>may be recorded in the Register of Sasines, if it relates to land in Scotland.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/9" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/9" id="section-16-9"><Pnumber>9</Pnumber><P2para><Text>The <CommentaryRef Ref="c250894"/><Addition ChangeId="d29p1832" CommentaryRef="c250895">Acquisition of Land Act 1981</Addition> shall apply to any compulsory acquisition by the Secretary of State under this section of any easement over land in England and Wales . . . <CommentaryRef Ref="c250896"/></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/10" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/10" id="section-16-10"><Pnumber>10</Pnumber><P2para><Text>The <CommentaryRef Ref="c250897"/>Acquisition of Land (Authorisation Procedure) (Scotland) Act 1947 shall apply to any compulsory acquisition by the Secretary of State under this section of any servitude over land in Scotland as it applies to a compulsory acquisition by another Minister or by the Secretary of State under section 58 of the <CommentaryRef Ref="c250898"/>National Health Service (Scotland) Act 1972 in a case falling within section 1(1) of the said Act of 1947.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/11" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/11" id="section-16-11"><Pnumber>11</Pnumber><P2para><Text>The provisions of Part I of the <CommentaryRef Ref="c250899"/>Compulsory Purchase Act 1965 (so far as applicable) other than sections 4 to 8, section 10 and section 31, shall apply in relation to any acquisition by agreement under this section of any easement over land in England and Wales.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/12" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/12" id="section-16-12"><Pnumber>12</Pnumber><P2para><Text>For the purposes of any acquisition by agreement under this section of any servitude over land in Scotland—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/12/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/12/a" id="section-16-12-a"><Pnumber>a</Pnumber><P3para><Text>the Lands Clauses Acts (with the exception of the provisions excluded by subsection (13) below) and sections 6 and 70 to 78 of the <CommentaryRef Ref="c250900"/>Railways Clauses Consolidation (Scotland) Act 1845 (as originally enacted and not as amended by section 15 of the <CommentaryRef Ref="c250901"/>Mines (Working Facilities and Support) Act 1923) shall be incorporated with this section; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/12/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/12/b" id="section-16-12-b"><Pnumber>b</Pnumber><P3para><Text>in construing those Acts for the purposes of this section, this section shall be deemed to be the special Act and the Secretary of State or the local authority acquiring the servitude shall be deemed to be the promoter of the undertaking or company (as the case may require).</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/13" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/13" id="section-16-13"><Pnumber>13</Pnumber><P2para><Text>The provisions of the Lands Clauses Acts excluded from being incorporated with this section are—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/13/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/13/a" id="section-16-13-a"><Pnumber>a</Pnumber><P3para><Text>those which relate to the acquisition of land otherwise than by agreement;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/16/13/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/16/13/b" id="section-16-13-b"><Pnumber>b</Pnumber><P3para><Text>those which relate to access to the special Act;
