            Part I</Strong></Number><Title> Ancient Monuments</Title><Pblock DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/part/I/crossheading/guardianship-of-ancient-monuments" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/part/I/crossheading/guardianship-of-ancient-monuments" NumberOfProvisions="3" id="part-I-crossheading-guardianship-of-ancient-monuments" RestrictExtent="E+W+S" RestrictStartDate="2011-06-30"><Title> Guardianship of ancient monuments</Title><P1group RestrictStartDate="2005-02-01"><Title> Termination of guardianship.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/14" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/14" id="section-14"><Pnumber><CommentaryRef Ref="key-c2ec74edbbc532a3921b29a32070b43e"/><CommentaryRef Ref="key-ba45a667a141c3d80d457d15c385b649"/>14</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/14/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/14/1" id="section-14-1"><Pnumber>1</Pnumber><P2para><Text>Subject to the following provisions of this section, where the Secretary of State <Addition ChangeId="d29p1498" CommentaryRef="c250882">or the Commission</Addition> or a local authority have become guardians of any monument under this Act, they may by agreement made with the persons who are for the time being immediately affected by the operation of the guardianship deed—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/14/1/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/14/1/a" id="section-14-1-a"><Pnumber>a</Pnumber><P3para><Text>exclude any part of the monument from guardianship; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/14/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/14/1/b" id="section-14-1-b"><Pnumber>b</Pnumber><P3para><Text>renounce guardianship of the monument;</Text></P3para></P3><Text>but except as provided above the monument shall remain under guardianship (unless it is acquired by its guardians) until an occupier of the monument who is entitled to terminate the guardianship gives notice in writing to that effect to the guardians of the monument.</Text></P2para><P2para><Text>An occupier of a monument is entitled to terminate the guardianship of the monument if—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/14/1/an1" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/14/1/an1" id="section-14-1-an1"><Pnumber>a</Pnumber><P3para><Text>he has any interest in the monument which would qualify him to establish guardianship of the monument under section 12 of this Act; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/14/1/bn1" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/14/1/bn1" id="section-14-1-bn1"><Pnumber>b</Pnumber><P3para><Text>he is not bound by the guardianship deed.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/14/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/14/2" id="section-14-2"><Pnumber>2</Pnumber><P2para><Text>A local authority shall consult with the Secretary of State before entering into any agreement under this section.</Text></P2para></P2><UnorderedList Decoration="none"><ListItem><Para><Text><Addition ChangeId="d29p1538" CommentaryRef="c250883">Where the monument in question is situated in England, the Secretary of State shall consult with the Commission before entering into any such agreement.</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="d29p1538" CommentaryRef="c250883">The Commission shall consult with the Secretary of State before entering into any such agreement.</Addition></Text></Para></ListItem></UnorderedList><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/14/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/14/3" id="section-14-3"><Pnumber>3</Pnumber><P2para><Text>Neither the Secretary of State <Addition ChangeId="d29p1554" CommentaryRef="c250884">nor the Commission</Addition> nor a local authority may enter into any such agreement unless he or they are satisfied with respect to the part of the monument or (as the case may be) with respect to the whole of the monument in question—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1979/46/section/14/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1979/46/section/14/3/a" id="section-14-3-a"><Pnumber>a</Pnumber><P3para><Text>that satisfactory arrangements have been made for ensuring its preservation after termination of the guardianship;
