or</p></content></level><level class="para1" eId="section-21-4-b"><num>(b)</num><content><p>any other interest in any such land in which he has a personal interest.</p></content></level></subsection><subsection eId="section-21-5"><num>(5)</num><intro><p>For the purposes of this section, an estate agent has a personal interest in land if—</p></intro><level class="para1" eId="section-21-5-a"><num>(a)</num><content><p>he has a beneficial interest in the land or in the proceeds of sale of any interest in it; or</p></content></level><level class="para1" eId="section-21-5-b"><num>(b)</num><intro><p>he knows or might reasonably be expected to know that any of the following persons has such a beneficial interest, namely,—</p></intro><level class="para2" eId="section-21-5-b-i"><num>(i)</num><content><p>his employer or principal, or</p></content></level><level class="para2" eId="section-21-5-b-ii"><num>(ii)</num><content><p>any employee or agent of his, or</p></content></level><level class="para2" eId="section-21-5-b-iii"><num>(iii)</num><content><p>any associate of his or of any person mentioned in sub-paragraphs (i) and (ii) above.</p></content></level></level></subsection><subsection eId="section-21-6"><num>(6)</num><content><p>Failure by an estate agent to comply with any of the preceding provisions of this section may be taken into account by the  <ins class="substitution first last" ukl:ChangeId="key-8c505e41df054fd4c1855ef6c62c5efd-1512551548393" ukl:CommentaryRef="key-8c505e41df054fd4c1855ef6c62c5efd"><noteRef uk:name="commentary" href="#key-8c505e41df054fd4c1855ef6c62c5efd" class="commentary"/>lead enforcement authority</ins>  in accordance with section 3(1)(c) above but shall not render the estate agent liable to any criminal penalty nor constitute a ground for any civil claim.</p></content></subsection></section></hcontainer></body></act></akomaNtoso>
