id="section-12"><Pnumber>12</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/1" id="section-12-1"><Pnumber>1</Pnumber><P2para><Text><Addition ChangeId="d30p127" CommentaryRef="c725572">Subject to subsection (3) and (4)</Addition> below, no person shall execute any controlled id="section-12-1-a"><Pnumber>a</Pnumber><P3para><Text>he is authorised in writing by <Addition ChangeId="d30p137" CommentaryRef="c725573">the Secretary of State</Addition> to do so and the works are in accordance with the terms of the authorisation; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/1/b" id="section-12-1-b"><Pnumber>b</Pnumber><P3para><Text>the works are executed in accordance with planning permission in force in pursuance of the <CommentaryRef Ref="c725574"/>Town and Country Planning Act 1971 or the <CommentaryRef Ref="c725575"/>Town and Country Planning (Scotland) Act 1972 and granted (otherwise than by a development order within the meaning of that Act) either before the passing of this Act or in consequence of an application for such permission which was made before 12th April 1976.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2" id="section-12-2"><Pnumber>2</Pnumber><P2para><Text>In this Part of this Act—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-controlled-works">controlled works</Term>” means—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>works for the construction of controlled premises or of a controlled extension of controlled premises; or</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>works for converting any premises into controlled premises; </Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text><Addition ChangeId="d30p174" CommentaryRef="c725576">“</Addition><Term id="term-hospital-premises"><Addition ChangeId="d30p174" CommentaryRef="c725576">hospital premises</Addition></Term><Addition ChangeId="d30p174" CommentaryRef="c725576">” means premises at which there are or are to be facilities for the provision of hospital services;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="d30p174" CommentaryRef="c725576">“</Addition><Term id="term-hospital-services"><Addition ChangeId="d30p174" CommentaryRef="c725576">hospital services</Addition></Term><Addition ChangeId="d30p174" CommentaryRef="c725576">” means all or any of the following services, namely—</Addition></Text></Para></ListItem></UnorderedList><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2/a" id="section-12-2-a"><Pnumber><Addition ChangeId="d30p174" CommentaryRef="c725576">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p174" CommentaryRef="c725576">the carrying out of surgical procedures under general anaesthesia;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2/b" id="section-12-2-b"><Pnumber><Addition ChangeId="d30p174" CommentaryRef="c725576">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p174" CommentaryRef="c725576">obstetrics;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2/c" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2/c" id="section-12-2-c"><Pnumber><Addition ChangeId="d30p174" CommentaryRef="c725576">c</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p174" CommentaryRef="c725576">radiotherapy;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2/d" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2/d" id="section-12-2-d"><Pnumber><Addition ChangeId="d30p174" CommentaryRef="c725576">d</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p174" CommentaryRef="c725576">haemodialysis or peritoneal dialysis;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2/e" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2/e" id="section-12-2-e"><Pnumber><Addition ChangeId="d30p174" CommentaryRef="c725576">e</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p174" CommentaryRef="c725576">pathology or diagnostic radiology;</Addition></Text></P3para><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text><Addition ChangeId="d30p174" CommentaryRef="c725576">“</Addition><Term id="term-relevant-hospital-premises"><Addition ChangeId="d30p174" CommentaryRef="c725576">relevant hospital premises</Addition></Term><Addition ChangeId="d30p174" CommentaryRef="c725576">” means hospital premises occupied otherwise than by or on behalf of the Crown or for the purposes of a visiting force.</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="d30p228" CommentaryRef="c725577">“</Addition><Term id="term-controlled-premises"><Addition ChangeId="d30p228" CommentaryRef="c725577">controlled premises</Addition></Term><Addition ChangeId="d30p228" CommentaryRef="c725577">” means hospital premises which provide or will provide beds for the use of patients, being hospital premises—</Addition></Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text><Addition ChangeId="d30p228" CommentaryRef="c725577">in the case of which the number of beds which are or will be so provided is one hundred and twenty or more; or</Addition></Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text><Addition ChangeId="d30p228" CommentaryRef="c725577">which are or are to be situated in an area designated by the Secretary of State under subsection (2A) below;</Addition></Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-controlled-extension">controlled extension</Term>” , in relation to any controlled premises, means works designed—</Text></Para></ListItem></UnorderedList></P3><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2/a" id="section-12-2-a"><Pnumber>a</Pnumber><P4para><Text>to extend, adapt or be used in conjunction with the controlled premises; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2/b" id="section-12-2-b"><Pnumber>b</Pnumber><P4para><Text>to extend or adapt works used in conjunction with the controlled premises.</Text></P4para></P4></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2A" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2A" id="section-12-2A"><Pnumber><Addition ChangeId="d30p265" CommentaryRef="c725578">2A</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p265" CommentaryRef="c725578">If, on an application by a health authority, the Secetary of State is satisfied that relevant hospital premises in the whole or any part of their area or district provide or will provide, if taken together, one hundred and twenty or more beds for the use of patients, he may, after consulting with such persons and representative bodies as appear to him to be concerned, by regulations designate the whole or, as the case may be, that part of the authority’s area or district as an area in which all hospital premises which provide or will provide beds for the use of patients shall be controlled premises; and regulations under this subsection—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2A/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2A/a" id="section-12-2A-a"><Pnumber><Addition ChangeId="d30p265" CommentaryRef="c725578">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p265" CommentaryRef="c725578">may contain such transitional provisions as appear to the Secretary of State to be necessary or expedient; and</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2A/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2A/b" id="section-12-2A-b"><Pnumber><Addition ChangeId="d30p265" CommentaryRef="c725578">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p265" CommentaryRef="c725578">shall have effect for such period not exceeding five years as may be prescribed.</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2B" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2B" id="section-12-2B"><Pnumber><Addition ChangeId="d30p265" CommentaryRef="c725578">2B</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p265" CommentaryRef="c725578">In determining for the purposes of subsection (2A) above how many beds relevant hospital premises will provide, the Secretary of State shall not take into account the proposed execution of any works unless—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2B/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2B/a" id="section-12-2B-a"><Pnumber><Addition ChangeId="d30p265" CommentaryRef="c725578">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p265" CommentaryRef="c725578">an authorisation for the execution of those works has been granted; or</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2B/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2B/b" id="section-12-2B-b"><Pnumber><Addition ChangeId="d30p265" CommentaryRef="c725578">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p265" CommentaryRef="c725578">a contract for the execution of those works has been entered into.</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/2C" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/2C" id="section-12-2C"><Pnumber><Addition ChangeId="d30p265" CommentaryRef="c725578">2C</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p265" CommentaryRef="c725578">The Secretary of State shall not exercise the power conferred by subsection (2A) above unless, having regard to the matters mentioned in subsection (3)(</Addition><Emphasis><Addition ChangeId="d30p265" CommentaryRef="c725578">a</Addition></Emphasis><Addition ChangeId="d30p265" CommentaryRef="c725578">) of section 13 below, he considers that the execution of works which, if the power were exercised, would be controlled works would be likely to interfere as mentioned in paragraph (</Addition><Emphasis><Addition ChangeId="d30p265" CommentaryRef="c725578">a</Addition></Emphasis><Addition ChangeId="d30p265" CommentaryRef="c725578">) or operate as mentioned in paragraph (</Addition><Emphasis><Addition ChangeId="d30p265" CommentaryRef="c725578">b</Addition></Emphasis><Addition ChangeId="d30p265" CommentaryRef="c725578">) of subsection (2) of that section.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/3" id="section-12-3"><Pnumber>3</Pnumber><P2para><Text>Subsection (1) above—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/3/a" id="section-12-3-a"><Pnumber>a</Pnumber><P3para><Text>does not apply in the case of works that are to be executed by or on behalf of the Crown or for the purposes of a visiting force; but</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/3/b" id="section-12-3-b"><Pnumber>b</Pnumber><P3para><Text>in the case of works that are to be executed otherwise than as aforesaid, shall apply notwithstanding any interest of the Crown in the land on which, or in any premises in connection with which, the works are to be executed.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/4" id="section-12-4"><Pnumber><Addition ChangeId="d30p336" CommentaryRef="c725579">4</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p336" CommentaryRef="c725579">Subsection (1) above does not apply in the case of works for the construction of a controlled extension of controlled premises if—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/4/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/4/a" id="section-12-4-a"><Pnumber><Addition ChangeId="d30p336" CommentaryRef="c725579">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p336" CommentaryRef="c725579">the premises are situated elsewhere than in an area designated by the Secretary of State under subsection (2A) above; and</Addition></Text></P3para></P3><P3 CommentaryRef="c725579">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p336" CommentaryRef="c725579">the premises were constructed as controlled premises, or were converted into controlled premises, whether before or after the coming into force of this Part of this Act; and</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/4/c" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/4/c" id="section-12-4-c"><Pnumber><Addition ChangeId="d30p336" CommentaryRef="c725579">c</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p336" CommentaryRef="c725579">where the works will enable additional beds to be provided, the aggregate number of additional beds which will then have been provided at the premises since the beginning of the current three year period (or, if later, the time when the premises were constructed or converted) will not exceed the permitted number.</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/12/5" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/12/5" id="section-12-5"><Pnumber><Addition ChangeId="d30p336" CommentaryRef="c725579">5</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p336" CommentaryRef="c725579">In subsection (4) above—</Addition></Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text><Addition ChangeId="d30p336" CommentaryRef="c725579">“</Addition><Term id="term-permitted-number"><Addition ChangeId="d30p336" CommentaryRef="c725579">permitted number</Addition></Term><Addition ChangeId="d30p336" CommentaryRef="c725579">” , in relation to a three year period, means one fifth of the number of beds provided at the premises in question at the beginning of that period or, if later, the time when the premises were constructed or converted;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="d30p336" CommentaryRef="c725579">“</Addition><Term id="term-three-year-period"><Addition ChangeId="d30p336" CommentaryRef="c725579">three year period</Addition></Term><Addition ChangeId="d30p336" CommentaryRef="c725579">” means the period of three years beginning with the passing of the </Addition><Addition ChangeId="d30p336" CommentaryRef="c725579"><CommentaryRef Ref="c725580"/>Health Services Act 1980 and each successive period of three years.</Addition></Text></Para></ListItem></UnorderedList></P2para></P2></P1para></P1></P1group><P1group><Title> Authorisations to construct or extend controlled premises.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/13" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/13" id="section-13"><Pnumber>13</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/13/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/13/1" id="section-13-1"><Pnumber>1</Pnumber><P2para><Text>Every application for an authorisation shall be made to <Addition ChangeId="d30p399" CommentaryRef="c725581">the Secretary of State</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/13/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/13/2" id="section-13-2"><Pnumber>2</Pnumber><P2para><Text>On receiving an application for an authorisation <Addition ChangeId="d30p408" CommentaryRef="c725582">the Secretary of State</Addition> shall consider whether, having regard to the matters mentioned in subsection (3) below, the execution of the works in question—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/13/2/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/13/2/a" id="section-13-2-a"><Pnumber>a</Pnumber><P3para><Text>would to a significant extent interfere with the performance by the Secretary of State of any duty imposed on him by <Addition ChangeId="d30p418" CommentaryRef="c725583">the principal Act</Addition> to provide accommodation or services of any kind; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/13/2/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/13/2/b" id="section-13-2-b"><Pnumber>b</Pnumber><P3para><Text>would to a significant extent operate to the disadvantage of persons seeking or afforded admission or access to any accommodation or services provided by the Secretary of State under <Addition ChangeId="d30p428" CommentaryRef="c725583">that Act</Addition> (whether as resident or non-resident patients) otherwise than as private patients,</Text></P3para></P3><Text>and shall grant the authorisation unless, having regard to those matters, <Addition ChangeId="d30p434" CommentaryRef="c725585">he</Addition> is satisfied that the executed of the works would do either or both of the things mentioned in paragraphs (<Emphasis>a</Emphasis>) and (<Emphasis>b</Emphasis>) above.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/13/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/13/3" id="section-13-3"><Pnumber><Addition ChangeId="d30p444" CommentaryRef="c725586">3</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p444" CommentaryRef="c725586">The matters referred to in subsection (2) above are—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/13/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/13/3/a" id="section-13-3-a"><Pnumber><Addition ChangeId="d30p444" CommentaryRef="c725586">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p444" CommentaryRef="c725586">how much accommodation and what facilities are or will be provided at, and what are or will be the staffing requirements of, relevant hospital premises in the area or areas served by the health service hospital or hospitals concerned;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/13/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/13/3/b" id="section-13-3-b"><Pnumber><Addition ChangeId="d30p444" CommentaryRef="c725586">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p444" CommentaryRef="c725586">how much accommodation or additional accommodation the works would provide;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/13/3/c" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/13/3/c" id="section-13-3-c"><Pnumber><Addition ChangeId="d30p444" CommentaryRef="c725586">c</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p444" CommentaryRef="c725586">what facilities or additional facilities the works would enable to be provided; and</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/13/3/d" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/13/3/d" id="section-13-3-d"><Pnumber><Addition ChangeId="d30p444" CommentaryRef="c725586">d</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p444" CommentaryRef="c725586">what staffing requirements or additional staffing requirements the works would give rise to.</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/13/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/13/4" id="section-13-4"><Pnumber>4</Pnumber><P2para><Text>An authorisation may contain such terms as <Addition ChangeId="d30p482" CommentaryRef="c725582">the Secretary of State</Addition> thinks appropriate, including in particular, without prejudice to the generality of the preceding provisions of this subsection, terms as to <Addition ChangeId="d30p486" CommentaryRef="c725588">the use of the premises</Addition> the duration of the authorisation and the place at which or area within which the works may be executed; and <Addition ChangeId="d30p490" CommentaryRef="c725582">the Secretary of State</Addition> may, with the consent of the person to whom an authorisation was issued, alter any of its terms at any time.</Text></P2para></P2></P1para></P1></P1group><P1group><Title> Notice of notifiable works.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14" id="section-14"><Pnumber>14</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/1" id="section-14-1"><Pnumber><CommentaryRef Ref="c725590"/>1</Pnumber><P2para><Text>Any person who proposes to make, after the coming into force of this Part of this Act, </Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/1/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/1/a" id="section-14-1-a"><Pnumber><Addition ChangeId="d30p509" CommentaryRef="c725591">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p509" CommentaryRef="c725591">an application for planning permission for any notifiable works; or</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/1/b" id="section-14-1-b"><Pnumber><Addition ChangeId="d30p509" CommentaryRef="c725591">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p509" CommentaryRef="c725591">a notifiable change,</Addition></Text></P3para></P3></P2para><P2para><Text>must, before making the application <Addition ChangeId="d30p526" CommentaryRef="c725592">or change</Addition> , notify <Addition ChangeId="d30p530" CommentaryRef="c725593">the Secretary of State</Addition> of the proposed application <Addition ChangeId="d30p534" CommentaryRef="c725592">or change</Addition> by giving to <Addition ChangeId="d30p538" CommentaryRef="c725595">him</Addition> a notice in the prescribed form.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/2" id="section-14-2"><Pnumber>2</Pnumber><P2para><Text>A notice under this section must contain the prescribed information about—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/2/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/2/a" id="section-14-2-a"><Pnumber>a</Pnumber><P3para><Text>the notifiable works for which planning permission is to be applied for <Addition ChangeId="d30p554" CommentaryRef="c725596">or the notifiable change</Addition>; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/2/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/2/b" id="section-14-2-b"><Pnumber>b</Pnumber><P3para><Text><Addition ChangeId="d30p563" CommentaryRef="c725596">in the case of notifiable works,</Addition> the purposes for which any hospital premises that will result from or be directly affected by the execution of those works are to be used.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/3" id="section-14-3"><Pnumber>3</Pnumber><P2para><Text>On receipt of a notice under this section which is in the prescribed form and contains the information required by subsection (2) above <Addition ChangeId="d30p573" CommentaryRef="c725593">the Secretary of State</Addition> shall issue to the person by whom the notice was given a written acknowledgment—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/3/a" id="section-14-3-a"><Pnumber>a</Pnumber><P3para><Text>identifying the notice and stating the date on which it was received by <Addition ChangeId="d30p583" CommentaryRef="c725593">the Secretary of State</Addition> ; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/3/b" id="section-14-3-b"><Pnumber>b</Pnumber><P3para><Text>acknowledging that it complies with the requirements of this section.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/4" id="section-14-4"><Pnumber>4</Pnumber><P2para><Text>In any proceedings for an offence under section 18(2)(<Emphasis>a</Emphasis>) below, an acknowledgment under subsection (3) above shall be conclusive evidence of the matters which it states or acknowledges.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/5" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/5" id="section-14-5"><Pnumber>5</Pnumber><P2para><Text>. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . <CommentaryRef Ref="c725600"/></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/6" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/6" id="section-14-6"><Pnumber><Addition ChangeId="d30p609" CommentaryRef="c725601">6</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p609" CommentaryRef="c725601">Subsection (1) above—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/6/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/6/a" id="section-14-6-a"><Pnumber><Addition ChangeId="d30p609" CommentaryRef="c725601">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p609" CommentaryRef="c725601">does not apply in the case of works that are to be executed or a change that is to be made by or on behalf of the Crown or for the purposes of a visiting force; but</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/6/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/6/b" id="section-14-6-b"><Pnumber><Addition ChangeId="d30p609" CommentaryRef="c725601">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p609" CommentaryRef="c725601">in the case of works that are to be executed or a change that is to be made otherwise than as aforesaid, shall apply notwithstanding any interest of the Crown in the land on which, or in any premises in connection with which, the works are to be executed or the change is to be made.</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/14/7" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/14/7" id="section-14-7"><Pnumber>7</Pnumber><P2para><Text>In this Part of this Act—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-notifiable-works">notifiable works</Term>” means—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>works for the construction of hospital premises or of an extension of hospital premises; or</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>works for converting any premises into hospital premises, not being, in either case, works for which an authorisation is required; </Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text><Addition ChangeId="d30p652" CommentaryRef="c725602">“</Addition><Term id="term-notifiable-change"><Addition ChangeId="d30p652" CommentaryRef="c725602">notifiable change</Addition></Term><Addition ChangeId="d30p652" CommentaryRef="c725602">” means—</Addition></Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text><Addition ChangeId="d30p652" CommentaryRef="c725602">any change in the nature or extent of the hospital services provided at controlled premises; or</Addition></Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text><Addition ChangeId="d30p652" CommentaryRef="c725602">any change in the facilities or the number of beds provided at any premises which results in their becoming controlled premises;</Addition></Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-extension">extension</Term>”, in relation to any hospital premises, means works designed—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>to extend, adapt or be used in conjunction with the hospital premises; or</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>to extend or adapt works used in conjunction with the hospital premises.</Text></Para></ListItem></OrderedList></ListItem></UnorderedList></P2para></P2></P1para></P1></P1group><P1group><Title> Planning permission for works requiring authorisation.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/15" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/15" id="section-15"><Pnumber>15</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/15/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/15/1" id="section-15-1"><Pnumber>1</Pnumber><P2para><Text>This section applies to works that consist of, or include, controlled works.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/15/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/15/2" id="section-15-2"><Pnumber>2</Pnumber><P2para><Text>An application made after the coming into force of this Part of this Act for planning permission for works to which this section applies shall be of no effect unless it is accompanied by a copy of an authorisation in force for all of those works in the planning area or district concerned for which an authorisation is required.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/15/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/15/3" id="section-15-3"><Pnumber>3</Pnumber><P2para><Text>Where at the time when this Part of this Act comes into force—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/15/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/15/3/a" id="section-15-3-a"><Pnumber>a</Pnumber><P3para><Text>an application for planning permission made on or after 12th April 1976 is pending, or any appeal to the Secretary of State connected with such an application is pending, or the time within which such an appeal may be begun has not expired; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/15/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/15/3/b" id="section-15-3-b"><Pnumber>b</Pnumber><P3para><Text>if the application had been made after the coming into force of this Part of this Act it would have been of no effect by virtue of subsection (2) above,</Text></P3para></P3><Text>the application shall be of no effect, or as the case may be the appeal shall be stayed or sisted or not begun, until the authority to which the application was made is furnished with the document which would under subsection (2) above have been required to accompany the application if it had been made after the coming into force of this Part of this Act.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/15/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/15/4" id="section-15-4"><Pnumber>4</Pnumber><P2para><Text>Where by virtue of the preceding subsection a prohibition imposed by that subsection on the beginning of an appeal ceases to be so imposed, the appeal may be begun during a period which begins with the cesser and is equal to so much of the time within which the appeal could have been begun apart from the prohibition as was unexpired when the prohibition was so imposed.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/15/5" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/15/5" id="section-15-5"><Pnumber>5</Pnumber><P2para><Text>In this section:—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-local-planning-authority">local planning authority</Term>” has the same meaning as in the <CommentaryRef Ref="c725603"/>Town and Country Planning Act 1971;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-planning-authority">planning authority</Term>” has the same meaning as in the <CommentaryRef Ref="c725604"/>Town and Country Planning (Scotland) Act 1972;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-planning-permission">planning permission</Term>” has the same meaning as in the said Act of 1971 or 1972, as the case may be;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-planning-area-or-district-concerned">the planning area or district concerned</Term>” means, in England and Wales, the area of the local planning authority or, in Scotland, the district of the planning authority, as the case may be.</Text></Para></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/15/6" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/15/6" id="section-15-6"><Pnumber>6</Pnumber><P2para><Text>Subsection (3) of section 12 above shall apply in relation to subsection (2) above as it applies in relation to subsection (1) of that section.</Text></P2para></P2></P1para></P1></P1group><P1group><Title> Regulations in connection with provisions of Part III.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16" id="section-16"><Pnumber>16</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/1" id="section-16-1"><Pnumber>1</Pnumber><P2para><Text>The Secretary of State may by regulations make provision—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/1/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/1/a" id="section-16-1-a"><Pnumber>a</Pnumber><P3para><Text>as to the manner and form in which any application for an authorisation is to be made to <Addition ChangeId="d30p797" CommentaryRef="c725605">the Secretary of State</Addition> ;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/1/b" id="section-16-1-b"><Pnumber>b</Pnumber><P3para><Text>as to the manner in which any notice under section 14 above is to be given to <Addition ChangeId="d30p807" CommentaryRef="c725605">the Secretary of State</Addition>, and as to the form in which any acknowledgment under subsection (3) of that section is to be issued by <Addition ChangeId="d30p811" CommentaryRef="c725605">the Secretary of State</Addition> ;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/1/c" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/1/c" id="section-16-1-c"><Pnumber>c</Pnumber><P3para><Text>for requiring such reasonable fees as may, with the consent of the Treasury, be prescribed to be paid in connection with any application for an authorisation;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/1/d" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/1/d" id="section-16-1-d"><Pnumber><Addition ChangeId="d30p821" CommentaryRef="c725608">d</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p821" CommentaryRef="c725608">for enabling the Secretary of State to require such person or persons as he may appoint to afford the applicant for an authorisation a hearing and to report thereon to the Secretary of State;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/1/e" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/1/e" id="section-16-1-e"><Pnumber><Addition ChangeId="d30p821" CommentaryRef="c725608">e</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p821" CommentaryRef="c725608">for determining the locality of, and entitling persons other than the applicant to appear and be heard at, such a hearing;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/1/f" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/1/f" id="section-16-1-f"><Pnumber>f</Pnumber><P3para><Text>as to the time to be allowed on any such application for the production of evidence or the taking of any prescribed steps for the purposes of such a hearing;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/1/g" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/1/g" id="section-16-1-g"><Pnumber>g</Pnumber><P3para><Text>for requiring persons to attend and give evidence or produce documents at such hearings, and for authorising the administration of oaths to persons so attending;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/1/h" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/1/h" id="section-16-1-h"><Pnumber>h</Pnumber><P3para><Text>for enabling any person entitled to appear otherwise than as a witness at any such hearing to be represented by another person, whether professionally qualified or not;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/1/i" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/1/i" id="section-16-1-i"><Pnumber>i</Pnumber><P3para><Text>for prescribing anything which under this Part of this Act is required or authorised to be prescribed.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/2" id="section-16-2"><Pnumber>2</Pnumber><P2para><Text>. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . <CommentaryRef Ref="c725609"/></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/3" id="section-16-3"><Pnumber>3</Pnumber><P2para><Text>Regulations under subsection (1) above may, for the purpose of securing compliance with requirements imposed by virtue of any provisions included in the regulations by virtue of paragraph (<Emphasis>g</Emphasis>) of that subsection, provide that a person who without reasonable excuse fails to comply with such a requirement shall be liable on summary conviction to a fine not exceeding such amount not greater than £100 as may be prescribed.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/4" id="section-16-4"><Pnumber>4</Pnumber><P2para><Text>The Secretary of State may be regulations provide for the apointment by him of inspectors to act, <Addition ChangeId="d30p881" CommentaryRef="c725610">under his direction</Addition>, for the purposes of this Part of this Act, except so far as it relates to notifiable works <Addition ChangeId="d30p885" CommentaryRef="c725611">or a notifiable change</Addition>, and for conferring on such inspectors such powers (including powers of entry and inspection) as the Secretary of State considers necessary for those purposes.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/5" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/5" id="section-16-5"><Pnumber>5</Pnumber><P2para><Text>Any powers conferred on inspectors by regulations made in pursuance of subsection (4) above shall, to the extent that the regulations so provide, be exercisable in relation to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/5/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/5/a" id="section-16-5-a"><Pnumber>a</Pnumber><P3para><Text>premises or land owned by, but not occupied by or for the purposes of, the Crown:</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/16/5/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/16/5/b" id="section-16-5-b"><Pnumber>b</Pnumber><P3para><Text>works on such land which have been or are being executed otherwise than by or on behalf of the Crown or for the purposes of a visiting force.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group><Title> Appeals.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17" id="section-17"><Pnumber>17</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/1" id="section-17-1"><Pnumber>1</Pnumber><P2para><Text>Where an application for an authorisation is refused or granted by <Addition ChangeId="d30p921" CommentaryRef="c725612">the Secretary of State</Addition> and the decision to refuse or grant it, as the case may be, involves a question of law, then—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/1/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/1/a" id="section-17-1-a"><Pnumber>a</Pnumber><P3para><Text>if the application is refused, the applicant or, if the applicant was afforded a hearing by <Addition ChangeId="d30p931" CommentaryRef="c725612">a person or persons appointed by the Secretary of State</Addition>, the applicant or any other person who appeared (in person or not) and was heard at the hearing may on that question appeal from <Addition ChangeId="d30p935" CommentaryRef="c725614">the Secretary of State’s</Addition> decision to the court; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/1/b" id="section-17-1-b"><Pnumber>b</Pnumber><P3para><Text>if the application is granted in a case in which the applicant was afforded a hearing by <Addition ChangeId="d30p945" CommentaryRef="c725612">a person or persons appointed by the Secretary of State</Addition>, any other person who so appeared and was heard may on that question appeal as aforesaid.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/2" id="section-17-2"><Pnumber>2</Pnumber><P2para><Text>In the preceding subsection “<Term id="term-the-court">the court</Term>” means—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/2/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/2/a" id="section-17-2-a"><Pnumber>a</Pnumber><P3para><Text>in England and Wales, the High Court;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/2/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/2/b" id="section-17-2-b"><Pnumber>b</Pnumber><P3para><Text>in Scotland, the Court of Session.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/3" id="section-17-3"><Pnumber>3</Pnumber><P2para><Text>An appeal under this section must be brought before the end of the three months beginning with the date on which the applicant is notified of the Board’s decision on his application.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/4" id="section-17-4"><Pnumber>4</Pnumber><P2para><Text><Addition ChangeId="d30p981" CommentaryRef="c725616">The Secretary of State</Addition> and (if he would not be so entitled apart from this subsection) the applicant shall each be entitled to appear and be heard on any appeal under this section.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/5" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/5" id="section-17-5"><Pnumber>5</Pnumber><P2para><Text>Rules of court relating to appeals under this section may provide for excluding so much of section 63(1) of the <CommentaryRef Ref="c725617"/>Supreme Court of Judicature (Consolidation) Act 1925 as requires appeals to the High Court to be heard and determined by a Divisional Court; but no appeal to the Court of Appeal shall be brought by virtue of this section except with the leave of the High Court or the Court of Appeal.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/6" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/6" id="section-17-6"><Pnumber>6</Pnumber><P2para><Text>In relation to proceedings in the High Court or the Court of Appeal or the Court of Session brought by virtue of this section the power to make rules of court shall include power to make rules prescribing the powers of the court with respect to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/6/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/6/a" id="section-17-6-a"><Pnumber>a</Pnumber><P3para><Text>the giving of any decision which might have been given by <Addition ChangeId="d30p1005" CommentaryRef="c725618">the Secretary of State</Addition> on the application;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/6/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/6/b" id="section-17-6-b"><Pnumber>b</Pnumber><P3para><Text>the remitting of the application, with the court’s decision on any question of law decided by it on appeal, for re-hearing and determination by <Addition ChangeId="d30p1015" CommentaryRef="c725618">the Secretary of State</Addition>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/6/c" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/6/c" id="section-17-6-c"><Pnumber>c</Pnumber><P3para><Text>the giving of directions to <Addition ChangeId="d30p1025" CommentaryRef="c725618">the Secretary of State</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/7" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/7" id="section-17-7"><Pnumber>7</Pnumber><P2para><Text>On any appeal brought under or by virtue of this section the court may, if the decision is in favour of the appellant, order <Addition ChangeId="d30p1034" CommentaryRef="c725618">the Secretary of State</Addition> (whether or not <Addition ChangeId="d30p1038" CommentaryRef="c725622">he</Addition> appears on the appeal) to pay the costs or, in Scotland, the expenses of the appellant or any other person.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/17/8" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/17/8" id="section-17-8"><Pnumber>8</Pnumber><P2para><Text>An appeal shall lie, with the leave of the Court of Session or the House of Lords, from any decision of the Court of Session under this section, and such leave may be given on such terms as to costs or otherwise as the Court of Session or the House of Lords may determine.</Text></P2para></P2></P1para></P1></P1group><P1group><Title> Offences.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/18" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/18" id="section-18"><Pnumber>18</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/18/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/18/1" id="section-18-1"><Pnumber>1</Pnumber><P2para><Text>Any person who contravenes section 12(1) of this Act shall be guilty of an offence and liable on summary conviction to a fine not exceeding £400 or on conviction on indictment to a fine.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/18/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/18/2" id="section-18-2"><Pnumber>2</Pnumber><P2para><Text>Any person who—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/18/2/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/18/2/a" id="section-18-2-a"><Pnumber>a</Pnumber><P3para><Text>without reasonable excuse fails to comply with the requirements of section 14(1) and (2) above in relation to an application for planning permission for any notifiable works <Addition ChangeId="d30p1074" CommentaryRef="c725623">or the making of any notifiable change</Addition>; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/18/2/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/18/2/b" id="section-18-2-b"><Pnumber>b</Pnumber><P3para><Text>knowingly or recklessly furnishes a notice which is false in a material particular in purported compliance with section 14(1) above,</Text></P3para></P3><Text>shall be guilty of an offence and liable on summary conviction to a fine not exceeding £400.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/18/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/18/3" id="section-18-3"><Pnumber>3</Pnumber><P2para><Text>Any person who—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/18/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/18/3/a" id="section-18-3-a"><Pnumber>a</Pnumber><P3para><Text>intentionally obstructs an inspector appointed by virtue of regulations made in pursuance of section 16(4) above in the exercise of any power of entry or inspection conferred on him by regulations so made; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/18/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/18/3/b" id="section-18-3-b"><Pnumber>b</Pnumber><P3para><Text>without reasonable excuse fails to comply with any requirement imposed by such an inspector by virtue of regulations so made,</Text></P3para></P3><Text>shall by guilty of an offence and liable on summary conviction to a fine not exceeding £400.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/18/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/18/4" id="section-18-4"><Pnumber>4</Pnumber><P2para><Text>Where an offence under any of the preceding provisions of this section has been committed by a body corporate and is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, a director, manager, secretary or other similar officer of the body corporate or any person who was purporting to act in any such capacity, he as well as the body corporate shall be guilty of that offence and shall be liable to be proceeded against and punished accordingly.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/18/5" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/18/5" id="section-18-5"><Pnumber>5</Pnumber><P2para><Text>Where the affairs of a body corporate are managed by its members, subsection (4) above shall apply in relation to the acts and defaults of a member in connection with his functions of management as if he were a director of the body corporate.</Text></P2para></P2></P1para></P1></P1group><P1group><Title> Amendments to provisions about registration of nursing homes and private hospitals.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/19" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/19" id="section-19"><Pnumber>19</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/19/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/19/1" id="section-19-1"><Pnumber>1</Pnumber><P2para><Text>The paragraph set out in subsection (2) below shall be inserted—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/19/1/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/19/1/a" id="section-19-1-a"><Pnumber>a</Pnumber><P3para><Text>after paragraph (<Emphasis>c</Emphasis>) of section 4 of the <CommentaryRef Ref="c725624"/>Nursing Homes Act 1975, as paragraph (<Emphasis>cc</Emphasis>); and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/19/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/19/1/b" id="section-19-1-b"><Pnumber>b</Pnumber><P3para><Text>after paragraph (<Emphasis>b</Emphasis>) of the proviso in section 1(3) of the <CommentaryRef Ref="c725625"/>Nursing Homes Registration (Scotland) Act 1938, as paragraph (<Emphasis>bb</Emphasis>),</Text></P3para></P3><Text>so as to afford, in each case, an additional ground for refusing to register, or cancelling the registration of, a person in respect of a nursing home or mental nursing home.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/19/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/19/2" id="section-19-2"><Pnumber><CommentaryRef Ref="c725626"/>2</Pnumber><P2para><Text>The said paragragh is—</Text><BlockAmendment TargetClass="unknown" TargetSubClass="unknown" Context="unknown" Format="default"><P3><Pnumber>0</Pnumber><P3para><Text>that the home or any premises to used in connection therewith consist of or include works executed in contravention of section 12(1) of the Health Services Act 1976;</Text></P3para></P3></BlockAmendment><AppendText>.</AppendText></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/19/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/19/3" id="section-19-3"><Pnumber><CommentaryRef Ref="c725626"/>3</Pnumber><P2para><Text>In section 16(1) of the <CommentaryRef Ref="c725628"/>Mental Health (Scotland) Act 1960 (prerequisites of registration of private hospital) the following paragragh shall be inserted after paragraph (<Emphasis>b</Emphasis>)—</Text><BlockAmendment TargetClass="primary" TargetSubClass="unknown" Context="main" Format="default"><P3><Pnumber>bb</Pnumber><P3para><Text>that neither the hospital nor any premises to be used in connection therewith consist of or include works executed in contravention of section 12(1) of the Health Services Act 1976;</Text></P3para></P3></BlockAmendment><AppendText>.</AppendText></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/19/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/19/4" id="section-19-4"><Pnumber><CommentaryRef Ref="c725626"/>4</Pnumber><P2para><Text>In each of the following provisions (penalties for carrying on a nursing home, mental nursing home or private hospital without registration) namely—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/19/4/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/19/4/a" id="section-19-4-a"><Pnumber>a</Pnumber><P3para><Text>section 12 of the <CommentaryRef Ref="c725630"/>Nursing Homes Act 1975;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/19/4/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/19/4/b" id="section-19-4-b"><Pnumber>b</Pnumber><P3para><Text>section 1(1) of the <CommentaryRef Ref="c725631"/>Nursing Homes Registration (Scotland) Act 1938;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/19/4/c" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/19/4/c" id="section-19-4-c"><Pnumber>c</Pnumber><P3para><Text>section 22(1) of the Mental Health (Scotland) Act 1960;</Text></P3para></P3><Text>for the words from “shall be liable” onwards there shall be substituted the words “shall be liable on summary conviction to a fine not exceeding £400 or on conviction on indictment to a fine”.</Text></P2para></P2></P1para></P1></P1group><P1group><Title> Interpretation of Part III.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/20" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/20" id="section-20"><Pnumber>20</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1976/83/section/20/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1976/83/section/20/1" id="section-20-1"><Pnumber>1</Pnumber><P2para><Text>In this Part of this Act—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-authorisation">authorisation</Term>” means an authorisation required by section 12(1) above;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-controlled-works">controlled works</Term>” has the meaning given by section 12(2) above; </Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="d30p1262" CommentaryRef="c725632">“</Addition><Term id="term-health-authority"><Addition ChangeId="d30p1262" CommentaryRef="c725632">health authority</Addition></Term><Addition ChangeId="d30p1262" CommentaryRef="c725632">” means, for England and Wales, an Area Health Authority or a District Health Authority or, for Scotland, a Health Board;</Addition></Text></Para></ListItem><ListItem><Para><Text>“hospital premises”
