RestrictStartDate="2003-04-01"><Title> Act not to be evaded by use of security.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1974/39/section/113/2012-03-21" IdURI="http://www.legislation.gov.uk/id/ukpga/1974/39/section/113" id="section-113"><Pnumber>113</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1974/39/section/113/1/2012-03-21" IdURI="http://www.legislation.gov.uk/id/ukpga/1974/39/section/113/1" id="section-113-1"><Pnumber>1</Pnumber><P2para><Text>Where a security is provided in relation to an actual or prospective regulated agreement, the security shall not be enforced so as to benefit the creditor or owner, directly or indirectly, to an extent greater (whether as respects the amount of any payment or the time or manner of its being made) than would be the case if the security were not provided and any obligations of the debtor or hirer, or his relative, under or in relation to the agreement were carried out to the extent (if any) to which they would be enforced under this Act.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1974/39/section/113/2/2012-03-21" IdURI="http://www.legislation.gov.uk/id/ukpga/1974/39/section/113/2" RestrictEndDate="2014-04-01" id="section-113-2"><Pnumber>2</Pnumber><P2para><Text>In accordance with subsection (1), where a regulated agreement is enforceable on an order of the court or the  <Substitution ChangeId="d29p13762" CommentaryRef="c4983191"><Acronym Expansion="Office of Fair Trading">OFT</Acronym></Substitution>  only, any security provided in relation to the agreement is enforceable (so far as provided in relation to the agreement) where such an order has been made in relation to the agreement, but not otherwise.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1974/39/section/113/3/2012-03-21" IdURI="http://www.legislation.gov.uk/id/ukpga/1974/39/section/113/3" RestrictEndDate="2014-04-01" id="section-113-3"><Pnumber>3</Pnumber><P2para><Text>Where—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1974/39/section/113/3/a/2012-03-21" IdURI="http://www.legislation.gov.uk/id/ukpga/1974/39/section/113/3/a" id="section-113-3-a"><Pnumber>a</Pnumber><P3para><Text>a regulated agreement is cancelled under section 69(1) or becomes subject to section 69(2), or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1974/39/section/113/3/b/2012-03-21" IdURI="http://www.legislation.gov.uk/id/ukpga/1974/39/section/113/3/b" id="section-113-3-b"><Pnumber>b</Pnumber><P3para><Text>a regulated agreement is terminated under section 91, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1974/39/section/113/3/c/2012-03-21" IdURI="http://www.legislation.gov.uk/id/ukpga/1974/39/section/113/3/c" RestrictEndDate="2014-04-01" id="section-113-3-c"><Pnumber>c</Pnumber><P3para><Text>in relation to any agreement an application for an order under section 40(2), 65(1), 124(1) or 149(2) is dismissed (except on technical grounds only), or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1974/39/section/113/3/d/2012-03-21" IdURI="http://www.legislation.gov.uk/id/ukpga/1974/39/section/113/3/d" id="section-113-3-d"><Pnumber>d</Pnumber><P3para><Text>a declaration is made by the court under section 142(1)

							(refusal of enforcement order) as respects any regulated agreement,</Text></P3para></P3><Text>section 106 shall apply to any security provided in relation to the agreement.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1974/39/section/113/4/2012-03-21" IdURI="http://www.legislation.gov.uk/id/ukpga/1974/39/section/113/4" id="section-113-4"><Pnumber>4</Pnumber><P2para><Text>Where subsection (3)(d) applies and the declaration relates to a part only of the regulated agreement, section 106 shall apply to the security only so far as it concerns that part.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1974/39/section/113/5/2012-03-21" IdURI="http://www.legislation.gov.uk/id/ukpga/1974/39/section/113/5" id="section-113-5"><Pnumber>5</Pnumber><P2para><Text>In the case of a cancelled agreement, the duty imposed on the debtor or hirer by section 71 or 72 shall not be enforceable before the creditor or owner has discharged any duty imposed on him by section 106 (as applied by subsection (3)(a)).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1974/39/section/113/6/2012-03-21" IdURI="http://www.legislation.gov.uk/id/ukpga/1974/39/section/113/6" id="section-113-6"><Pnumber>6</Pnumber><P2para><Text>If the security is provided in relation to a prospective agreement or transaction, the security shall be enforceable in relation to the agreement or transaction only after the time (if any) when the agreement is made;
