or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1973/23/section/1/2/b/england+wales" IdURI="http://www.legislation.gov.uk/id/ukpga/1973/23/section/1/2/b" id="section-1-2-b"><Pnumber>b</Pnumber><P3para><Text>section 1(2) of the <CommentaryRef Ref="c825390"/>Employment of Women, Young Persons and Children Act 1920 or <Addition ChangeId="d29p600" CommentaryRef="c825391">section 55(1) of the Merchant Shipping Act 1995</Addition> (prohibition of employment of children in ships);</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1973/23/section/1/3/england+wales" IdURI="http://www.legislation.gov.uk/id/ukpga/1973/23/section/1/3" id="section-1-3"><Pnumber>3</Pnumber><P2para><Text>No arrangements shall be made under subsection (1) above for a child to be employed in any way which would be contrary to an enactment prohibiting or regulating the employment of young persons if he were a young person (within the meaning of that enactment) and not a child; and where a child is employed in pursuance of arrangements so made, then so much of any enactment as regulates the employment of young persons (whether by excluding them from any description of work, or prescribing the conditions under which they may be permitted to do it, or otherwise howsoever) and would apply in relation to him if he were of an age to be treated as a young person for the purposes of that enactment shall apply in relation to him, in and in respect of the employment arranged for him, in all respects as if he were of an age to be so treated.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1973/23/section/1/4/england+wales" IdURI="http://www.legislation.gov.uk/id/ukpga/1973/23/section/1/4" id="section-1-4"><Pnumber>4</Pnumber><P2para><Text>In this Act—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-enactment">enactment</Term>” includes any byelaw, regulation or other provision having effect under an enactment;</Text></Para></ListItem></UnorderedList><Text>other expressions which are also used in the Education Acts shall have the same meaning in this section as in those Acts; and</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-the-education-acts">the Education Acts</Term>” means in England and Wales the Education Acts 1944 to <Addition ChangeId="d29p634" CommentaryRef="c825392">1996</Addition> and, in Scotland, the Education (Scotland) Acts 1939 to 1971;</Text></Para></ListItem></UnorderedList><Text>and for the purposes of subsection (1) above <Addition ChangeId="d29p640" CommentaryRef="c825393">a child shall be taken to be in his last year of compulsory schooling from the beginning of the term at his school which precedes the beginning of the school year in which by virtue of section 9 of the Education Act 1962 he would be entitled to leave school.</Addition></Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="E+W+S" RestrictEndDate="1996-11-01" Match="false"><Title> Citation and extent.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1973/23/section/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1973/23/section/2" id="section-2"><Pnumber>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1973/23/section/2/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1973/23/section/2/1" id="section-2-1"><Pnumber>1</Pnumber><P2para><Text>This Act may be cited as the Education (Work Experience) Act 1973;
