or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/1/b" id="section-54-1-b"><Pnumber><Addition ChangeId="d29p12807" CommentaryRef="c14920361">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d29p12807" CommentaryRef="c14920361">a building for the time being included in the Schedule of monuments compiled and maintained under section 1 of the </Addition><Addition ChangeId="d29p12807" CommentaryRef="c14920361"><CommentaryRef Ref="c14920371"/>Ancient Monuments and Archaeological Areas Act 1979</Addition>.</Text></P3para></P3><Text>For the purposes of this subsection, a building used or available for use by a minister of religion wholly or mainly as a residence from which to perform the duties of his office shall be treated as not being an ecclesiastical building.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/2" id="section-54-2"><Pnumber>2</Pnumber><P2para><Text>. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . <CommentaryRef Ref="c14920381"/></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/3" id="section-54-3"><Pnumber>3</Pnumber><P2para><Text>In considering whether to grant planning Permission for development which <Addition ChangeId="d29p12833" CommentaryRef="c14920391">affects a listed building or its setting</Addition>, and in considering whether to grant listed building consent for any works, the. . . <CommentaryRef Ref="c14920401"/> planning authority or the Secretary of State, as the case may be, shall have special regard to the desirability of preserving the building <Addition ChangeId="d29p12839" CommentaryRef="c14920411">or its setting</Addition> or any features of special architectural or historic interest which it possesses.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/4" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/4" id="section-54-4"><Pnumber><Addition ChangeId="d29p12843" CommentaryRef="c14920421">4</Addition></Pnumber><P2para><Text><Addition ChangeId="d29p12843" CommentaryRef="c14920421">Listed building consent may be granted subject to conditions; and, without prejudice to the generality of the foregoing provisions of this subsection, the conditions may</Addition> include conditions with respect to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/4/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/4/a" id="section-54-4-a"><Pnumber>a</Pnumber><P3para><Text>the preservation of particular features of the building, either as part of it or after severance therefrom;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/4/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/4/b" id="section-54-4-b"><Pnumber>b</Pnumber><P3para><Text>the making good, after the works are completed, of any damage caused to the building by the works;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/4/c" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/4/c" id="section-54-4-c"><Pnumber>c</Pnumber><P3para><Text>the reconstruction of the building or any part of it following the execution of any works, with the use of original materials so far as practicable and with such alterations of the interior of the building as may be specified in the conditions.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/4A" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/4A" id="section-54-4A"><Pnumber><Addition ChangeId="d29p12870" CommentaryRef="c14920431">4A</Addition></Pnumber><P2para><Text><Addition ChangeId="d29p12870" CommentaryRef="c14920431">Listed building consent may be granted subject to a condition reserving specified details of the works (whether or not set out in the application) for subsequent approval by the planning authority or, in the case of consent granted by the Secretary of State, specifying whether the reserved details are to be approved by the planning authority or by him.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/5" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/5" id="section-54-5"><Pnumber><Addition ChangeId="d29p12878" CommentaryRef="c14920441">5</Addition></Pnumber><P2para><Text><Addition ChangeId="d29p12878" CommentaryRef="c14920441">In granting a listed building consent a planning authority may attach to the consent a condition that no demolition of the listed building shall take place until either or both of the following requirements have been met—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/5/a" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/5/a" id="section-54-5-a"><Pnumber><Addition ChangeId="d29p12878" CommentaryRef="c14920441">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d29p12878" CommentaryRef="c14920441">an agreement for the regulation of the development of the site of the listed building has been made and recorded under section 50 of this Act;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/5/b" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/5/b" id="section-54-5-b"><Pnumber><Addition ChangeId="d29p12878" CommentaryRef="c14920441">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d29p12878" CommentaryRef="c14920441">the planning authority are satisfied that contracts have been placed either—</Addition></Text><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/5/b/i" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/5/b/i" id="section-54-5-b-i"><Pnumber><Addition ChangeId="d29p12878" CommentaryRef="c14920441">i</Addition></Pnumber><P4para><Text><Addition ChangeId="d29p12878" CommentaryRef="c14920441">for the redevelopment of the site; or</Addition></Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/5/b/ii" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/5/b/ii" id="section-54-5-b-ii"><Pnumber><Addition ChangeId="d29p12878" CommentaryRef="c14920441">ii</Addition></Pnumber><P4para><Text><Addition ChangeId="d29p12878" CommentaryRef="c14920441">for its conversion to an acceptable open space,</Addition></Text></P4para></P4></P3para></P3><Text><Addition ChangeId="d29p12878" CommentaryRef="c14920441">in accordance with a current planning permission.</Addition></Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1972/52/section/54/6" IdURI="http://www.legislation.gov.uk/id/ukpga/1972/52/section/54/6" id="section-54-6"><Pnumber>6</Pnumber><P2para><Text>Part I of Schedule 10 to this Act shall have effect with respect to applications to. . . <CommentaryRef Ref="c14920401"/> planning authorities for listed building consent, the reference of such applications to the Secretary of State and appeals against decisions on such applications;
