RestrictStartDate="2011-11-15"><Title> Interpretation.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/1971/38/section/37" IdURI="http://www.legislation.gov.uk/id/ukpga/1971/38/section/37" id="section-37"><Pnumber><CommentaryRef Ref="c8173841"/>37</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1971/38/section/37/1" IdURI="http://www.legislation.gov.uk/id/ukpga/1971/38/section/37/1" id="section-37-1"><Pnumber><CommentaryRef Ref="c8173851"/><CommentaryRef Ref="c8173861"/>1</Pnumber><P2para><Text>In this Act, except in so far as the context otherwise requires, the following expressions have the meanings hereby assigned to them respectively, that is to say:—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-the-advisory-council">the Advisory Council</Term>” means the Advisory Council on the Misuse of Drugs established under this Act; </Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="d29p1950" CommentaryRef="c8173871">“cannabis”
							(except in the expression “cannabis resin”) means any plant of the genus</Addition><Emphasis><Addition ChangeId="d29p1950" CommentaryRef="c8173871">Cannabis</Addition></Emphasis><Addition ChangeId="d29p1950" CommentaryRef="c8173871">or any part of any such plant (by whatever name designated) except that it does not include cannabis resin or any of the following products after separation from the rest of the plant, namely—</Addition></Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text><Addition ChangeId="d29p1950" CommentaryRef="c8173871">mature stalk of any such plant,</Addition></Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text><Addition ChangeId="d29p1950" CommentaryRef="c8173871">fibre produced from mature stalk of any such plant, and</Addition></Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text><Addition ChangeId="d29p1950" CommentaryRef="c8173871">seed of any such plant;</Addition></Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-cannabis-resin">cannabis resin</Term>” means the separated resin, whether crude or purified, obtained from any plant of the genus<Emphasis>Cannabis;</Emphasis></Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-contravention">contravention</Term>” includes failure to comply, and “<Term id="term-contravene">contravene</Term>” has a corresponding meaning;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-controlled-drug">controlled drug</Term>” has the meaning assigned by section 2 of this Act;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-corresponding-law">corresponding law</Term>” has the meaning assigned by section 36(1) of this Act;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-dentist">dentist</Term>” means a person registered in the dentists register under the  <Addition ChangeId="d29p2012" CommentaryRef="c8173881">Dentists Act 1984 </Addition><CommentaryRef Ref="key-240123ae926d8b87858cf94460afbbdb"/><Addition ChangeId="d29p2012" CommentaryRef="c8173881">...</Addition><Acronym Expansion="European Economic Area"/><Addition ChangeId="d29p2012" CommentaryRef="c8173881">;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="d29p2019" CommentaryRef="c8173901">“</Addition><Term id="term-doctor"><Addition ChangeId="d29p2019" CommentaryRef="c8173901">doctor</Addition></Term><Addition ChangeId="d29p2019" CommentaryRef="c8173901">” means a registered medical practitoner within the meaning of Schedule 1 to the Interpretation Act 1978;</Addition></Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-enactment">enactment</Term>” includes an enactment of the Parliament of Northern Ireland;</Text></Para></ListItem><ListItem><Para><Text>“person lawfully conducting a retail pharmacy business”<CommentaryRef Ref="key-7e9303ecb3b912dfc0433cd02e08bd18"/>... means a person lawfully conducting such a business in accordance with section 69 of the  <CommentaryRef Ref="c8173911"/>Medicines Act 1968;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-pharmacist">pharmacist</Term>” has the same meaning as in the  <CommentaryRef Ref="c8173921"/>Medicines Act 1968;</Text></Para></ListItem><ListItem><Para><Text>“practitioner”
							(except in the expression “veterinary practitioner”) means a doctor, dentist, veterinary practioner or veterinary surgeon;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-prepared-opium">prepared opium</Term>” means opium prepared for smoking and includes dross and any other residues remaining after opium has been smoked;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-prescribed">prescribed</Term>” means prescribed by regulations made by the Secretary of State under this Act;</Text></Para></ListItem><ListItem><Para><Text>“produce”, where the reference is to producing a controlled drug, means producing it by manufacture, cultivation or any other method, and “<Term id="term-production">production</Term>” has a corresponding meaning;</Text></Para></ListItem><ListItem><Para><Text>“supplying” including distributing;</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-5bd768e1091582ef647b5ceeee5d1613-1488810557876" CommentaryRef="key-5bd768e1091582ef647b5ceeee5d1613">“</Addition><Term><Addition ChangeId="key-5bd768e1091582ef647b5ceeee5d1613-1488810557876" CommentaryRef="key-5bd768e1091582ef647b5ceeee5d1613">temporary class drug order</Addition></Term><Addition ChangeId="key-5bd768e1091582ef647b5ceeee5d1613-1488810557876" CommentaryRef="key-5bd768e1091582ef647b5ceeee5d1613">” means an order made under section 2A(1);</Addition> </Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-veterinary-practitioner">veterinary practitioner</Term>” means a person registered in the supplementary veterinary register kept under section 8 of the  <CommentaryRef Ref="c8173931"/>Veterinary Surgeons Act 1966;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-veterinary-surgeon">veterinary surgeon</Term>” means a person registered in the register of veterinary surgeons kept under section 2 of the  <CommentaryRef Ref="c8173941"/>Veterinary Surgeons Act 1966.</Text></Para></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1971/38/section/37/2" IdURI="http://www.legislation.gov.uk/id/ukpga/1971/38/section/37/2" id="section-37-2"><Pnumber>2</Pnumber><P2para><Text>References in this Act to misusing a drug are references to misusing it by taking it; and the reference in the foregoing provision to the taking of a drug is a reference to the taking of it by a human being by way of any form of self-administration, whether or not involving assistance by another.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/1971/38/section/37/3" IdURI="http://www.legislation.gov.uk/id/ukpga/1971/38/section/37/3" id="section-37-3"><Pnumber>3</Pnumber><P2para><Text>For the purposes of this Act the things which a person has in his possession shall be taken to include any thing subject to his control which is in
