http://www.legislation.gov.uk/ukla/2025/2/section/13/enactedGeneral Cemetery Act 2025King's Printer of Acts of Parliament2025-10-28 Part 3 13 1 The appointed day is fixed by a decision of the Company in accordance with this section. 2 The appointed day must not be before the Charitable Transferee is registered by the Charity Commission as a charity. 3 Before the appointed day, the Company must— a publish notice of the day appointed in the London Gazette, stating that it is the appointed day for the purposes of this Part; and b serve a copy of the notice on— i the Bishop of the diocese in which the cemetery is situated; ii the Commonwealth War Graves Commission; iii the Historic Buildings and Monuments Commission for England; and iv the local planning authorities for the cemetery. 4 The publication of a notice under subsection (3) is conclusive evidence of the date of the appointed day in question, and a photocopy or other reproduction, certified by one of the directors or the company secretary of the Company, of a page or part of a page of the London Gazette containing the notice is conclusive evidence of publication.
