The appointed day is fixed by a decision of the Churchwardens.

The appointed day must not be before the Trust is registered by the Charity Commission as a charity.

Before the appointed day, the Churchwardens must publish notice of the day appointed in the London Gazette, stating that it is the appointed day for the purposes of the relevant provision of this Act.

The publication of a notice under subsection (3) is conclusive evidence of the date of the appointed day in question, and a photocopy or other reproduction, certified by one of the Churchwardens or the clerk to the Churchwardens, of a page or part of a page of the London Gazette containing the notice is conclusive evidence of publication.
