The Minister for the Cabinet Office makes these Regulations in exercise of the powers conferred by sections 39(1), (2), (3) and (4) and 161(2) of the Small Business, Enterprise and Employment Act 2015.

In accordance with section 39(6) of the Small Business, Enterprise and Employment Act 2015, the Minister for the Cabinet Office has undertaken such consultation as the Minister considers appropriate. Contracts which fall within the scope of Chapter 8 must be published on Contracts Finder, an online database of public sector online contract opportunities. Contracting authorities must not include a pre-qualification stage in relation to these contracts.

These Regulations also provide that NHS Foundations Trusts are to be treated in the same way as NHS Trusts for the purposes of Chapter 8.
