The Secretary of State may at any time withdraw a notice of intent or a final notice by giving notice in writing to the person to whom the notice was given.

Any notice given under these Regulations must be in writing and is validly given to a person if—
a
it is delivered to that person at their proper address;
b
it is sent to that person’s proper address by first class post, recorded delivery or prepaid registered post;
c
it is sent by electronic means to that person’s proper address.

In the case of a body corporate, a notice may be given to an officer of that body.

In the case of a partnership, a notice may be given to a partner or a person having control or management of the partnership business.

Service is deemed to have been given—
a
in the case of notifications given under paragraph (2)(a), on the day on which the notice is delivered;
b
in the case of notifications given under paragraph (2)(b), on the third working day after the day on which the notice is sent;
c
in the case of notifications given under paragraph (2)(c), on the first working day after the day on which the notice is sent.

For the purposes of this regulation—
“proper address” means—
- a
in the case of a body corporate or an officer of that body—
- i
the registered or principal office of that body; or
- ii
the email address of that officer;
- i
- b
in the case of a partnership or a partner or a person having control or management of the partnership business—
- i
the principal office of the partnership; or
- ii
the email address of the partner or person having that control or management;
- i
- c
in any other case, a person’s last known address, which may be an email address;
- a
“working day” means any day other than a Saturday, a Sunday, Christmas Day, Good Friday or a bank holiday in England under the Banking and Financial Dealings Act 19716.
