Amendments to Commission Delegated Regulation (EU) 2019/2017: household dishwashers

7.—(1) Commission Delegated Regulation (EU) 2019/2017 of 11 March 2019 supplementing Regulation (EU) 2017/1369 of the European Parliament and of the Council with regard to energy labelling of household dishwashers and repealing Commission Delegated Regulation (EU) No 1059/2010(1), as modified by the Ecodesign for Energy-Related Products and Energy Information (Amendment) (EU Exit) Regulations 2020, is amended as follows.

(2) In Article 3(1) (obligations of suppliers), for point (b) substitute—

(b)the information set out in Table 3 of Annex 5 is made available on a publicly accessible website;.

(3) In Annex 1 (definitions applicable for Annexes), after point (23) insert—

(24) ‘declared values’ means the values provided by the supplier in the technical documentation in accordance with point 1(d) of Annex 6 for the verification of conformity by the market surveillance authority..

(4) In Annex 2, in point A (energy efficiency classes), in the heading of Table 1 for “electronic displays” substitute “household dishwashers”.

(5) In Annex 4 (measurement methods and calculations)—

(a)after the first paragraph insert—

Where a calculation in this Annex uses a parameter listed in Table 4 of Annex 6 (technical documentation), the supplier must use the declared value for that parameter.;

(b)in point 2 (cleaning performance index), in each place that it occurs, for “two decimal places” substitute “three decimal places”;

(c)in point 3 (drying performance index), in each place that it occurs, for “two decimal places” substitute “three decimal places”;

(d)for point 4 (low power modes) substitute—

LOW POWER MODES

4.  Where applicable, the power consumption of the off mode (Po), standby mode (Psm) and delay start (Pds) must be measured.

The measured values must be expressed in W and rounded to two decimal places.

During measurements of the power consumption in low power modes, the following must be checked and recorded—

(a)whether information is displayed;

(b)whether any network connection is activated..

(6) In Annex 5 (product information sheet)—

(a)number the first paragraph as paragraph 1;

(b)number the second paragraph as paragraph 2;

(c)in Table 3—

(i)in the second column of the entry relating to each of the following parameters, for “x,xx” substitute “x.xxx”—

(aa)“Cleaning performance index”;

(bb)“Drying performance index”;

(ii)omit footnotes (b) and (c) and the references to them;

(d)after Table 3 insert—

3.  The following items in Table 3 are not relevant for the purposes of determining whether a model is an equivalent model under Article 2(6) of the Framework Regulation—

(a)supplier’s name or trade mark;

(b)supplier’s address;

(c)model identifier;

(d)dimensions in cm;

(e)minimum duration of the guarantee given by the supplier;

(f)additional information..

(7) In Annex 6 (technical documentation), in point (1)—

(a)for points (a) and (b) substitute—

(a)a general description of the model, sufficient for it to be unequivocally and easily identified;

(b)references to the designated standards applied or other measurement standards used;

(c)specific precautions that must be taken when the model is assembled, installed, maintained or tested;

(d)the values of the technical parameters set out in Table 4;

(e)the details and the results of the calculations performed in accordance with Annex 4;

(f)the testing conditions, if not fully described in point (b);

(g)the model identifier of all equivalent models already placed on the market;;

(b)in Table 4—

(i)before the entry relating to “Eco programme energy consumption” insert—

Rated capacity in place settings-X;

(ii)in the first column of the entry relating to each of the following parameters, at the end insert “if applicable”—

(aa)“Power consumption in ‘off mode’ (Po)”;

(bb)“Power consumption in ‘standby mode’ (Psm)”;

(iii)in the third column of the entry relating to each of the following parameters, for “X,XX” substitute “X.XXX”—

(aa)“Cleaning performance index (IC)”;

(bb)“Drying performance index (ID)”;

(c)after Table 4, omit points (c) to (f).

(8) In Annex 9—

(a)for the first (unnumbered) paragraph substitute—

The verification tolerances set out in this Annex relate only to the verification by the market surveillance authority of the declared values.

The supplier of a product must not use the verification tolerances—

(a)to establish the declared values;

(b)to interpret the declared values; or

(c)to communicate better performance.

The values and classes published on the label or in the product information sheet must not be more favourable to the supplier than the declared values.;

(b)in point (2)(a), for “values given in the technical documentation pursuant to Article 3(3) of Regulation (EU) 2017/1369 (declared values),” substitute “declared values”;

(c)in the final paragraph before Table 5, for “points 1 to 7” substitute “points 1 to 6”.
