4.—(1) Commission Delegated Regulation (EU) 2019/2013 of 11 March 2019 supplementing Regulation (EU) 2017/1369 of the European Parliament and of the Council with regard to energy labelling of electronic displays and repealing Commission Delegated Regulation (EU) No 1062/2010(1), as modified by Schedule 1 to the Ecodesign for Energy-Related Products and Energy Information (Amendment) (EU Exit) Regulations 2020, is amended as follows.
(2) In Article 1(2) (subject matter and scope), in point (g), for “of products covered by implementing measures adopted under the Ecodesign for Energy-Related Products Regulations 2010” substitute “within the meaning given by regulation 2(1) of the Ecodesign for Energy-Related Products Regulations 2010”.
(3) In Article 2 (definitions)—
(a)in point (10), for “as defined in Article 1” substitute “and is to be construed in accordance with the definitions of ‘networked equipment with high network availability’ and ‘networked equipment with high network availability functionality’ in Article 2”;
(b)omit point (17).
(4) In Article 3(1) (obligations of suppliers), for point (b) substitute—
“(b)the information set out in table 4 of Annex 5 (product information sheet) is made available on a publicly accessible website;”.
(5) In Annex 1 (definitions for the purposes of the Annexes), after point (28) insert—
“(29) ‘declared values’ means the values provided by the supplier in the technical documentation in accordance with point (4) of Annex 6 for the verification of conformity by the market surveillance authority;
(30) ‘guarantee’ means any undertaking by the dealer or the supplier to the consumer that, if an electronic display does not meet the specifications set out in the guarantee statement or in any associated advertising—
(a)the consumer will be reimbursed for the price paid for the electronic display; or
(b)the electronic display will be repaired, replaced or handled in any way.”.
(6) In Annex 2, in point B (energy efficiency index)—
(a)after the formula, in the explanation of term “A” in the formula, for “viewing surface area” substitute “visible screen area”;
(b)after the explanation of term “corr1” in the formula, insert—
“For the purposes of the EEI calculation, the declared values of the following technical parameters listed in Table 5 of Annex 6 (technical documentation) must be used—
(a)on mode power demand (Pmeasured );
(b)visible screen area.”.
(7) In Annex 3, in point 2 (label design)—
(a)at the beginning of point (f) insert “Subject to point (g)”;
(b)after point (f) insert—
“(g)If the electronic display does not support HDR—
(i)the following must not be displayed—
(aa)the HDR pictogram; and
(bb)the energy efficiency class; and
(ii)the screen pictogram, indicating screen size and resolution, must be vertically centred in the area below the indication of the energy consumption.”.
(8) In Annex 5 (product information sheet)—

(10) In Annex 9 (verification procedure for market surveillance purposes)—
(a)for the first paragraph substitute—
“The verification tolerances set out in this Annex relate only to the verification by the market surveillance authority of the declared values.
The supplier of a product must not use the verification tolerances—
(a)as allowed tolerances to establish the declared values;
(b)to interpret the declared values; or
(c)to communicate better performance.
The values and classes published on the label or in the product information sheet must not be more favourable to the supplier than the declared values.”;
(b)in point 2—
(i)in point (a), for “values given in the technical documentation pursuant to point 3 of Article 3 of Regulation (EU) 2017/1369 (declared values)” substitute “declared values”;
(ii)in point (c), for the words after “comply with” substitute—

5.—(1) Commission Delegated Regulation (EU) 2019/2014 of 11 March 2019 supplementing Regulation (EU) 2017/1369 of the European Parliament and of the Council with regard to energy labelling of household washing machines and household washer-dryers and repealing Commission Delegated Regulation (EU) No 1061/2010 and Commission Directive 96/60/EC(2), as modified by Schedule 2 to the Ecodesign for Energy-Related Products and Energy Information (Amendment) (EU Exit) Regulations 2020, is amended as follows.
(2) In Article 3(1) (obligations of suppliers), for point (b) substitute—
“(b)the information set out in Table 5 of Annex 5 (product information sheet for household washing machines) or, as the case may be, Table 6 of Annex 5 (product information sheet for household washer-dryers) is made available on a publicly accessible website;”.
(3) In Annex 1 (definitions applicable for the Annexes), after point (32) insert—
“(33) ‘declared values’ means the values provided by the supplier in the technical documentation in accordance with point 1(d) of Annex 6 (household washing machines) or point 2(d) of Annex 6 (household washer-dryers) for the verification of conformity by the market surveillance authority;
(34) ‘wash and dry cycle’ means a complete cycle for cotton laundry—
(a)which is continuous if the household washer-dryer provides a continuous cycle;
(b)where the washing cycle is the eco 40-60 programme; and
(c)where the drying cycle achieves cupboard dry status.”.
(4) In Annex 4 (measurement methods and calculations)—
(a)after the first paragraph insert—
“Where a calculation in this Annex uses a parameter listed in Table 7 of Annex 6 (technical documentation for household washing machines) or Table 8 of Annex 6 (technical documentation for household washer-dryers), the supplier must use the declared value for that parameter.”;
(b)in point 1 (rated capacity of household washer-dryers), in the first sentence, for “shall be measured, using” substitute “is the rated capacity of”;
(c)in point 3 (washing efficiency index)—
(i)in the existing paragraph, for “two decimal places” substitute “three decimal places”;
(ii)after the existing paragraph, insert as a paragraph—
“For household washing machines with a rated capacity higher than 3 kg and for the washing cycle of household washer-dryers with a rated washing capacity higher than 3 kg, the value to be entered on the Product Information sheet for IW is the lowest of the values for—
(a)the washing efficiency index at the rated washing capacity;
(b)the washing efficiency index at half of the rated washing capacity; and
(c)the washing efficiency index at quarter of the rated washing capacity.
For household washing machines with a rated capacity lower than or equal to 3 kg and for the washing cycle of household washer-dryers with a rated capacity lower than or equal to 3 kg, the value to be entered on the Product Information Sheet for IW is the value for the washing efficiency index at the rated washing capacity.
For household washer-dryers with a rated capacity higher than 3 kg, the value to be entered on the Product Information sheet for JW is the lower of the values for—
(a)the washing efficiency index at the rated capacity; and
(b)the washing efficiency index at half of the rated capacity.
For household washer-dryers with a rated capacity lower than or equal to 3 kg, the value to be entered on the Product Information Sheet for JW is the value for the washing efficiency index at the rated capacity.”;
(d)in point 4 (rinsing effectiveness), after the existing paragraph insert—
“For household washing machines with a rated capacity higher than 3 kg and for the washing cycle of household washer-dryers with a rated capacity higher than 3 kg, the value to be entered on the Product Information Sheet for the IR is the highest of the values for—
(a)the rinsing effectiveness at rated washing capacity;
(b)the rinsing effectiveness at half of the rated washing capacity; and
(c)the rinsing effectiveness at quarter of the rated washing capacity.
For household washing machines with a rated capacity lower than or equal to 3 kg and for the washing cycle of household washer-dryers with a rated capacity lower than or equal to 3 kg, no value is to be entered on the Product Information Sheet for IR.
For household washer-dryers with a rated capacity higher than 3 kg, the value to be entered on the Product Information Sheet for JR is the higher of the values for—
(a)the rinsing effectiveness index at the rated capacity; and
(b)the rinsing effectiveness index at half of the rated capacity.
For household washer-dryers with a rated capacity lower than or equal to 3 kg, no value is to be indicated on the Product Information sheet for JR.”;
(e)in point 6(2) (weighted water consumption), in the first paragraph, after “weighted water consumption” insert “of the wash and dry cycle”;
(f)in point 7 (remaining moisture content)—
(i)in the first paragraph, for “the nearest whole percent” substitute “one decimal place”;
(ii)after the formula, in the explanations of the terms used in the equation, in each place that it occurs, for “one decimal place” substitute “two decimal places”.
(g)in point 9 (low power modes)—

7.—(1) Commission Delegated Regulation (EU) 2019/2017 of 11 March 2019 supplementing Regulation (EU) 2017/1369 of the European Parliament and of the Council with regard to energy labelling of household dishwashers and repealing Commission Delegated Regulation (EU) No 1059/2010(4), as modified by the Ecodesign for Energy-Related Products and Energy Information (Amendment) (EU Exit) Regulations 2020, is amended as follows.
