The Secretary of State makes the following Regulations in exercise of the powers conferred by section 2(1) of the Parks Regulation (Amendment) Act 1926(1) and now vested in the Secretary of State(2), and by section 62 of the Road Traffic Regulation Act 1984(3).

A draft of these Regulations has been laid before Parliament for a period of forty days pursuant to section 6 of the Statutory Instruments Act 1946(4), and that period has expired without either House resolving that the Regulations be not made.

Citation and commencement

1.  These Regulations may be cited as the Royal Parks and Other Open Spaces (Amendment) etc. Regulations 2020 and come into force on the day after the day on which they are made.

Amendment of the Royal Parks and Other Open Spaces Regulations 1997

2.—(1) The Royal Parks and Other Open Spaces Regulations 1997(5) are amended as follows.

(2) In Part 2 of Schedule 2–

(a)for paragraph 1 substitute the following–

1.  On a Park road in Bushy Park, The Green Park, Greenwich Park, Hyde Park (other than the Serpentine Road), St James’s Park, The Regent’s Park or Richmond Park, at a speed not exceeding 20 mph.;

(b)omit paragraph 2; and

(c)in paragraph 4 after “other than one mentioned in paragraphs 1” omit “, 2”.

Amendment of the Hyde Park and The Regent’s Park (Vehicle Parking) Regulations 1995

3.—(1) The Hyde Park and The Regent’s Park (Vehicle Parking) Regulations 1995(6) are amended as follows.

(2) In regulation 6(a), for “35 pence” substitute “50 pence”.

(3) In regulation 6(b), for “60 pence” substitute “70 pence”.

Amendment of the Greenwich Park (Vehicle Parking) Regulations 2000

4.—(1) The Greenwich Park (Vehicle Parking) Regulations 2000(7) are amended as follows.

(2) In regulation 2, after the definition of “constable”, insert the following–

“holiday” means Christmas Day, Good Friday or any day which is a bank holiday in England in accordance with The Banking and Financial Dealings Act 1971(8);.

(3) For regulation 5 substitute the following–

5.(1) The charge for a parking ticket shall be—

(a)for parking on a Sunday or holiday, 50 pence for every fifteen minutes or part thereof;

(b)for parking on any other day, 35 pence for every fifteen minutes or part thereof..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Royal Parks and Other Open Spaces Regulations 1997 (S.I. 1997/1639), the Hyde Park and The Regent’s Park (Vehicle Parking) Regulations 1995 (S.I. 1995/993) and the Greenwich Park (Vehicle Parking) Regulations 2000 (S.I. 2000/934).

Regulation 2 amends the Royal Parks and Other Open Spaces Regulations 1997 to reduce the speed limit at which a vehicle may be driven or ridden on a Park road in The Green Park, Hyde Park (other than the Serpentine Road), St James’s Park or The Regent’s Park from 30 mph to 20 mph.

Regulation 3 amends the Hyde Park and The Regent’s Park (Vehicle Parking) Regulations 1995 to increase the parking charges payable in respect of a vehicle parked in a parking place in Hyde Park between 08:30 hours and 18:30 hours, or The Regent’s Park between 09:00 hours and 18:30 hours. The parking charge increases from 35 pence to 50 pence for every fifteen minutes (or part thereof) on a Sunday or holiday and from 60 pence to 70 pence on any other day.

Regulation 4 amends the Greenwich Park (Vehicle Parking) Regulations 2000 to increase the parking charges payable in respect of a vehicle parked in a parking place in Greenwich Park between 09:00 hours and 18:00 hours. The parking charge increases from 30 pence to 50 pence for every fifteen minutes (or part thereof) on a Sunday or holiday and from 30 pence to 35 pence on any other day.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.

The functions of the Commissioners of Works were transferred to the Minister of Works by section 1 of the Minister of Works Act 1942 (c.23) (repealed), and S.I. 1945/991. The Minister of Works was renamed the Minister of Public Building and Works by S.I. 1962/1549. The functions of the Minister of Public Building and Works were transferred to the Secretary of State by virtue of S.I. 1970/1681, and then to the Secretary of State for National Heritage by article 7 of S.I. 1992/1311. The Secretary of State for National Heritage was renamed the Secretary of State for Culture, Media and Sport by S.I. 1997/1744. The functions of the Secretary of State for Culture, Media and Sport were transferred to the Secretary of State for Culture, Olympics, Media and Sport by article 4 of S.I. 2010/1551, then to the Secretary of State for Culture, Media and Sport by article 3 of S.I. 2012/2590, and then to the Secretary of State for Digital, Culture, Media and Sport by article 4 of S.I. 2017/979.
