In accordance with section 7(3) of the Political Parties, Elections and Referendums Act 20001, the Electoral Commission has been consulted prior to this Order being laid before Parliament.
In accordance with section 84(4) of the Northern Ireland Act 19982 a draft of this Order has been laid before and approved by a resolution of each House of Parliament.
Accordingly, Her Majesty, in exercise of the powers conferred on Her by section 84(1) of the Northern Ireland Act 1998, is pleased, by and with the advice of Her Privy Council, to order as follows:
Citation, commencement and interpretation1

This Order may be cited as the Local Elections (Northern Ireland) (Election Expenses) Order 2019.

This Order comes into force on the day after the day on which it is made.

In this Order “the 1962 Act” means the Electoral Law Act (Northern Ireland) 19623.
Exclusion of personal expenses from election expenses limits2
Amendment of election expenses return requirements3
In subsection 46(3) of the 1962 Act (return as to election expenses)6, after paragraph (c) insert—

a statement of the amount of the part of election expenses incurred by or on behalf of the candidate consisting of the candidate’s personal expenses;
Exclusion of disability related expenses from election expenses4
In Part 2 of Schedule 3B to the 1962 Act (local election: election expenses)7, after paragraph 12 insert—

Any matter that is reasonably attributable to the candidate’s disability, to the extent that the expenses in respect of the matter are reasonably incurred.

In this paragraph “disability” has the same meaning as in section 1 of the Disability Discrimination Act 19958.
