Amendment of the Security of Gas Supply Regulation21
The Security of Gas Supply Regulation is amended as follows.
Amendment of Article 322
In Article 3 (responsibility for the security of gas supply), omit paragraph 8.
Amendment of Article 723
In Article 7 (risk assessment)—
a
in paragraph 5, omit the third sentence;
b
after paragraph 5 insert—
5A
The Secretary of State may, by regulations, amend the template set out in Annex V in order to reflect the experience gained in the application of this Regulation and to reduce administrative burdens.
Amendment of Article 824
In Article 8 (establishment of preventive action plans and emergency plans)—
a
in paragraph 5, omit the second sentence;
b
after paragraph 5 insert—

The Secretary of State may, by regulations, amend the templates set out in Annexes VI and VII in order to reflect the experience gained in the application of this Regulation and to reduce administrative burdens.
Omission of Article 1925
Omit Article 19 (exercise of the delegation).

After Article 19 insert—

Any power to make regulations conferred on the Secretary of State by this Regulation is exercisable by statutory instrument.

Before making regulations which apply to Northern Ireland, the Secretary of State must consult—
a
the Department for the Economy; and
b
the competent authority of the Republic of Ireland for the purposes of this Regulation as it applies in EU law.

A statutory instrument containing regulations made under this Regulation is subject to annulment in pursuance of a resolution of either House of Parliament.
