Data Protection Act 199830

In section 55A(9) of the Data Protection Act 1998 (power of Commissioner to impose monetary penalty)49—

a

in the definition of “data controller”, after “Commissioners” insert “, a relevant person”, and

b

after the definition of “prescribed”, insert—

  • ; and

  • “relevant person” means a person who is discharging functions in relation to the management of any property, rights or interests to which section 90B(5) of the Scotland Act 1998 applies.
