commencement</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Passenger and Goods Vehicles (Tachographs) (Amendment) Regulations 2016.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations come into force on 2nd March 2016.</p></content></paragraph></hcontainer></part><part eId="part-2"><num>PART 2</num><heading>Amendments to primary legislation</heading><hcontainer name="crossheading" ukl:Name="P1group"><heading>Transport Act 1968</heading><hcontainer name="regulation" eId="regulation-2"><num>2.</num><content><p>The Transport Act 1968 is amended as follows.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-3"><num>3.</num><content><p><mod>After section 96 insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="ukdsi" ukl:TargetClass="secondary" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><article><heading>Authorisation of field tests</heading><num>96A.</num><paragraph><num>(1)</num><intro><p>The Secretary of State may authorise a person to carry out tests (“field tests”) of—</p></intro><level class="para1"><num>(a)</num><content><p>recording equipment that has not been type-approved under Article 13 of the <abbr class="acronym" title="European Union">EU</abbr> Tachographs Regulation (granting of type-approval), or</p></content></level><level class="para1"><num>(b)</num><content><p>modifications or additions to recording equipment that has been so approved.</p></content></level></paragraph><paragraph><num>(2)</num><content><p>An authorisation is to be in writing.</p></content></paragraph><paragraph><num>(3)</num><content><p>The Secretary of State may withdraw an authorisation by giving written notice.</p></content></paragraph><paragraph><num>(4)</num><intro><p>An authorisation may contain conditions which may in particular relate to—</p></intro><level class="para1"><num>(a)</num><content><p>the places where and equipment by means of which a field test is, or is to be, carried out;</p></content></level><level class="para1"><num>(b)</num><content><p>the procedure to be adopted in carrying out a field test;</p></content></level><level class="para1"><num>(c)</num><content><p>the records to be kept and the evidence to be furnished of the carrying out of a field test;</p></content></level><level class="para1"><num>(d)</num><content><p>the training of persons for carrying out field tests;</p></content></level><level class="para1"><num>(e)</num><content><p>the inspection by or on behalf of the Secretary of State of places where and equipment by means of which field tests are, or are to be, carried out;</p></content></level><level class="para1"><num>(f)</num><content><p>the display, at the places where field tests are carried out, of signs indicating that field tests are carried out there by persons approved by the Secretary of State.</p></content></level></paragraph><paragraph><num>(5)</num><content><p>The Secretary of State must from time to time publish lists of type-approval mark issued under Article 14 of the <abbr class="acronym" title="European Union">EU</abbr> Tachographs Regulation if he proves to the court that the use of the recording equipment was in the course of a field test authorised under section 96A.</p></content></paragraph><paragraph><num>(4C)</num><intro><p>Where a person (“the driver”)—</p></intro><level class="para1"><num>(a)</num><content><p>in the course of the driver’s employment, uses a vehicle in contravention of subsection (1), and</p></content></level><level class="para1"><num>(b)</num><content><p>is liable to be convicted under that subsection in respect of that use,</p></content></level><wrapUp><p>the employer also commits an offence and shall be liable on summary conviction to a fine.</p></wrapUp></paragraph><paragraph><num>(4D)</num><content><p>A person shall not be liable to be convicted under subsection (4C) in respect of the use of a vehicle if the requirements of Article 10(1) and (2) of the Community Drivers’ Hours Regulation (liability of transport undertakings) and Article 33(1) of the <abbr class="acronym" title="European Union">EU</abbr> Tachographs Regulation (responsibility of transport undertakings) were complied with in relation to that use.</p></content></paragraph></quotedStructure><inline class="acronym" title="European Union">EU</abbr> Regulation repeals a previous <abbr class="acronym" title="European Union">EU</abbr> Regulation on recording equipment in road transport. It sets out obligations and requirements in relation to the construction, installation, use, testing and control of tachographs used in road transport, reflecting the fact that tachographs now use global positioning system technology. It also sets out the conditions and requirements under which the information and data, other than personal data, recorded, processed or stored by tachographs may be used.</p></blockContainer><blockContainer ukl:Name="P"><p>An impact assessment has been prepared for these Regulations together with a transposition note setting out how the main elements of the <abbr class="acronym" title="European Union">EU</abbr> Regulation are transposed into <abbr class="acronym" title="United Kingdom">UK</abbr> law.
