SCHEDULE 2MEMBERS OF HER MAJESTY’S FORCES: EXCLUDED PERSONS

Regulation 19(2)

The following persons are not members of Her Majesty’s forces for the purpose of these Regulations -

a

subject to paragraph (2), any person who is serving as a member of any naval force of Her Majesty’s forces and who locally entered that force at a naval base outside the United Kingdom;

b

any person who is serving as a member of any military force of Her Majesty’s forces and who entered that force, or was recruited for that force, outside the United Kingdom, and the depot of whose unit is situated outside the United Kingdom;

c

any person who is serving as a member of any air force of Her Majesty’s forces and who entered that force, or was recruited for that force, outside the United Kingdom, and is liable under the terms of engagement to serve only in a specified part of the world outside the United Kingdom.

Paragraph (1)(a) does not include any person who –

a

has previously been an insured person under Part 1 of the National Insurance Act 196543; or

b

is paying or has previously paid one or more of the following classes of contributions under the Social Security Act 197544 or the Social Security Contributions and Benefits Act 199245–

i

primary Class 1;

ii

Class 2; or

iii

Class 3.
