The Big Lottery Fund (Prescribed Expenditure) Order 2006
Citation, commencement and interpretation1.
(1)
This Order may be cited as the Big Lottery Fund (Prescribed Expenditure) Order 2006 and shall come into force on 1st December 2006 or on the day after the day on which it is made, whichever is the later.
(2)
In this Order—
“the Act” means the National Lottery etc. Act 1993; and
“the Fund” means the Big Lottery Fund.
Devolved expenditure2.

The descriptions of expenditure are—
(a)
expenditure on or connected with the promotion of community learning;
(b)
expenditure on or connected with the promotion of community safety and cohesion;
(c)
expenditure on or connected with the promotion of physical and mental well being.
(3)
The reference in paragraph (2)(b) to promoting community safety is to making communities places in which it is, or is perceived to be, safer to live or work, in particular by the reduction of actual or perceived levels of crime and other anti-social behaviour.
Devolved expenditure: small grants3.
(1)
Expenditure that is charitable or connected with health, education or the environment of the description specified in paragraph (2) is prescribed in relation to each of England, Wales, Scotland and Northern Ireland for the purposes of section 22(3)(d) of the Act.
(2)
The description of expenditure is expenditure on or connected with small scale projects in local communities which involve people within those communities.
Non-devolved expenditure: transformational grants4.
(1)
Expenditure that is charitable or connected with health, education or the environment of the description specified in paragraph (2) is prescribed for the purposes of section 22(3)(d) of the Act.
(2)
The description of expenditure is expenditure on or connected with projects which are intended to transform communities, regions or the nation as a whole.
(3)
The maximum amount that may be distributed by the Fund before 1st April 2008 under section 36B(1) of the Act for such expenditure shall be £140 million.
This Order prescribes the descriptions of expenditure for the purposes of section 22(3)(d) of the National Lottery etc. Act 1993 and thereby defines the extent of the power of the Big Lottery Fund to distribute Lottery money under section 36B(1) of that Act. Article 2 prescribes descriptions of expenditure which are to have effect in relation to each of England, Scotland, Wales, Northern Ireland and the Isle of Man (devolved expenditure). The Fund’s functions in relation to Scottish, Welsh and Northern Ireland devolved expenditure will be exercised by the committees established under paragraph 7 of Schedule 4A to that Act and will be subject to the directions given by Scottish Ministers, the National Assembly for Wales and the Northern Ireland Department of Culture, Arts and Leisure under section 36E of that Act. Article 3 prescribes a further description of devolved expenditure relating to small grants under which the Awards for All programme will continue to be funded (see www.awardsforall.org.uk).
Article 4 prescribes a description of non-devolved expenditure which allows the Fund to make grants for expenditure on or connected with projects which are intended to transform communities, regions or the nation as a whole. The Fund’s functions in relation to this description of expenditure will be exercised by the main board and will be subject to directions given by the Secretary of State under section 36E of the National Lottery etc. Act 1993. Article 4(3) prescribes the maximum amount that may be distributed by the Fund by 1st April 2008 for this description of expenditure.
