Whereas—

(1) in pursuance of section 60A(1)(a) of the Police and Criminal Evidence Act 1984(1) (“the Act”) the Secretary of State has the power to issue a code of practice for the visual recording of interviews held by police officers at police stations;

(2) in pursuance of section 67(1) of the Act the Secretary of State has prepared and published a draft code of practice in connection with the said matter and has considered representations made to him thereon and modified the draft code of practice accordingly;

(3) in pursuance of section 67(3) of the Act the Secretary of State has laid a draft of the code of practice before both Houses of Parliament;

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 67(4) of the Act, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Police and Criminal Evidence Act 1984 (Codes of Practice) (Visual Recording of Interviews) Order 2002 and shall come into force on 7th May 2002.

Visual recording of interviews

2.  The code of practice laid in draft before Parliament on 10th April 2002 for the visual recording of interviews held by police officers at police stations shall come into operation on 7th May 2002.

Explanatory Note

(This is not part of the Order)

This Order appoints 7th May 2002 as the date on which the code of practice for the visual recording for police interviews under section 60A(1) of the Police and Criminal Evidence Act 1984 will come into operation.

When the Order is in operation, it will apply to the visual recording of police interviews in any area where visual recording is required by virtue of an order under section 60A(1)(b) of the Act of 1984.
