Asylum Support (Repeal) Order 2002

Coming into force

Whereas a draft of this Order has been approved by a resolution of each House of Parliament;

Now, therefore, in exercise of the powers conferred upon him by section 96(5) of the Immigration and Asylum Act 19991, the Secretary of State hereby makes the following Order:

Citation and commencement1

This Order may be cited as the Asylum Support (Repeal) Order 2002 and shall come into force on 8th April 2002.

Repeal of section 96(3) of the Immigration and Asylum Act 19992

Subsection (3) of section 96 of the Immigration and Asylum Act 1999 (ways in which support may be provided) is hereby repealed.

This Order repeals section 96(3) of the Immigration and Asylum Act 1999 which provides that asylum support provided by the Secretary of State under subsections (1)(a) or (b) or (2) of that section must not, unless the circumstances of a particular case are exceptional, be wholly or mainly by way of payments made (by whatever means) to the supported person or to his dependants (if any).
