Whereas a draft of this Order has been laid before and approved by a resolution of each House of Parliament pursuant to section 77(2) of the Deregulation and Contracting Out Act 1994(1):

Now, therefore, the Secretary of State, in exercise of the powers conferred upon her by section 69 of that Act, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Contracting Out (Functions in relation to Apsley House) Order 2002 and shall come into force on the day after the day on which it is made.

Contracting out of functions

2.  The functions now vested in the Secretary of State under sections 2, 5(1) and 5(3) of the Wellington Museum Act 1947(2) may be exercised by, or by employees of, such person (if any) as may be authorised in that behalf by the Secretary of State.

Explanatory Note

(This note is not part of the Order)

This Order enables the Secretary of State for Culture, Media and Sport to authorise another person (or that person’s employees) to perform her functions under sections 2, 5(1) and (3) of the Wellington Museum Act 1947 in relation to the maintenance of Apsley House and using specified parts of it as a museum for the preservation and exhibition to the public of certain chattels associated with the first Duke of Westminster or his times, and for the purpose of Government entertainment and, with the Duke of Wellington’s consent, for any other public purpose not inconsistent with its use as a museum.
