52Appeal etc to court

(1)

The respondent to a complaint may appeal against a penalty imposed by the bishop’s disciplinary tribunal or the Vicar-General’s court.

(2)

The respondent to a complaint may appeal on a question of law or fact against a finding of the bishop’s disciplinary tribunal or the Vicar-General’s court.

(3)

The Investigation and Tribunals Team may appeal on a question of law against a finding of the bishop’s disciplinary tribunal or the Vicar-General’s court.

(4)

The Investigation and Tribunals Team may, if it appears to the Team that the penalty imposed on a respondent to a complaint is unduly lenient, apply for a review of the penalty.

(5)

An appeal or application for review under this section must be made to the Arches Court of Canterbury or the Chancery Court of York (depending on the province in which the penalty was imposed or the finding was made).
